I couldn't find the same for the Netherlands but perhaps they did consular processing for a CR1 in NL and they were ok with the BC (or someone reviewing it really didn't care....).

I did K1 and AOS and now have 10 year GC. No issue ever came up with the BC (or anything else for that matter, and my packet for the 10 year GC was super light compared to what others seem to send)

Since your spouse asserted in the I-751 interview that the marriage was solid, if your spouse says in a different document the marriage had irretrievably broken down for at least 6 months then your spouse is committing perjury.  Either at the I-751 interview or in the divorce filing.  But either way it is perjury.

Let  your spouse commit perjury. Then report your spouse to a New York state or local police department for a false statement in the divorce filing.

Your spouse might then assert that the divorce filing is true, and the state/local police might then decline to file charges.   Thus your spouse would  be admitting to perjury in the I-751 interview.  In that case report your spouse to the FBI for a false statement in the I-751 interview.

With a criminal record and perhaps a conviction and time in a state or federal prison, it will be more difficult for your spouse to get custody of your child.

If your spouse is convicted of federal perjury I suppose you run the risk of denaturalization but you could then re-file I-751 on the basis of a divorce waiver or an abuse waiver.  And then re-naturalize with 5 years as an LPR.

Well it is not necessarily perjury. It could be that she honestly thought that the marriage was not broken. But then, 3 months later, in hindsight, it has been broken for 6 months. No perjury, just optimism/delusion depending on how you look at it.

  3. Yes, that is still the current form. Did you print it out fully? By that I mean make sure your printer scaled the document to the page's printable area so that no parts of the form got cut off. Sometimes when printing a document, if the printer can't print something that is really close to the edge of the page, there is such an option that scales down the document so that everything fits. I've seen someone on this forum have their I751 rejected for this reason.

Won't be telling our story here if we filed incorrectly. We followed the Filing Calculator on when to do it, you can safely presume we followed it, and USCIS for some supernatural reason, said we filed too early, Nov 20, 2020.

According to the Calculator, our 90-day opening was on December 12, 2020 because her conditional I-551 ends on March 12, 2021. So,  for good measure, we filed December 14, 2020. That's 88 days before her I-551 expires, if anyone is counting; just within 90 days right?

Yeah they make mistakes. There was someone else in one of the i751 threads that had the same issue. Although they didn't mention a wrong filing date. It sucks but it happens, and there seems to be nothing you can do about it, besides filing again.

The tracking website and number I refer to is the USPS tracking number and website. We have received nothing. Is that clear?

Oh OK i thought you meant USCIS tracking. In that case, you mention ISC New York, did you send your 2nd packet directly to New York? I think you're supposed to send them to Phoenix, AZ, even when re-filing (But I may be wrong on that).

It takes about 6 weeks (at least it did in January, you should follow the February thread to get more recent dates) so you should get your NOA in a couple weeks. If you don't, and your check (or other method of payment) has been cashed, call them to get your tracking number. And then I suppose you can ask for an infopass appointment to at least get a i551 stamp in your passport. I hope there is a USCIS office where you are.

We obviously did not forget to file an AR-11, Address Change. But of course, we can't put in Oversea Address, so our only choice was to put our military PO BOX.

Yeah I went through a change of address when doing my AOS. Filed a first AR-11, kept receiving notices at the old address, filed another AR-11, the Green Card was sent to the old address (and returned). Sigh... It took months to get it re-sent to my new address.

At first few months we didn't anticipate trying out forums like VJ but here we are. We're supposed to be December 2020 Filers too but our first attempt of i751 was deemed too early. Like Lockbox (the office that receives our envelopes) said we filed on November 2020. Kept banging my head on how that became to be.

Yeah that happens. Was it a USCIS error or did you really file early? What is your exact filing date and what is your green card (i551) expiration date?

And to think the only information we've gotten all these headaches was from an email that was sent on 18 MAR 2021.

    What did that email say?

However, now our 2nd packet is stuck on ISC New York since feb 20, 2021 at least from the web tracking.

OK so your case is being processed and you have a tracking number. Did you receive the 1st NOA that extends your I551?

Life for a K-1 entrant is much easier with a SSN.....and applying immediately after entering the US is the recommended procedure as explained in the VJ SSN guide.  Your experience was far from the average.  In the end, a SSN is needed for much more than employment.

Well I guess they updated the guide or maybe i mis-remember it. Like I said I did that 3 years ago. Other ppl in the forum seemed to do the same I did: wait for the EAD to get a SSN.

But many people end up having to file taxes without having their EAD yet.

It is easier to open a bank account when you have a SSN, so you don't have to shop around to find a bank that lets you open an account without one.

Not all landlords will add you to a lease without a SSN.

All these things may be possible without a SSN; however, having a SSN makes it so much easier to get all this sorted.

I guess I was lucky... I didn't shop around for a bank, I walked into a Wells Fargo (because my wife already had an account with them) to ask what documents I needed to open an account and it turned out I just needed my passport. And I had it with me so I opened one on the spot. (OK, they wanted 2 government IDs and didn't like my foreign driver's license with no expiration, but they accepted my K1 visa as a 2nd ID. It is government issued and has a picture...)

Maybe living in a big city where they see non-immigrants with no SSNs all the time helps.

To go back to OP's lack of SSN: I would say don't worry too much, most things can be done without an SSN. You'll get your SSN when you get your EAD.

Not true.  Filing Taxes, opening a bank account, renting an apartment, etc. are all much easier with a Social Security number.....they are used for a lot more than employment.

Well by the time I had to file taxes, I had my EAD, and my SSN.

Opening a bank account, Wells Fargo let me open one without.

Renting an apartment, I was added to my wife's lease without an SSN. So maybe if I had to look for a new apartment on my own it would have been a problem?

For health insurance the Gov says to do the following: https://www.irs.gov/affordable-care-act/questions-and-answers-about-reporting-social-security-numbers-to-your-health-insurance-company "You should advise your coverage provider that you do not have an SSN or TIN and give them the date of birth for each covered individual."

Yep I was added to my wife's insurance without a SSN. The only thing that was a slight problem was being added as a user on her Amex. They asked for driver's license, I had only a foreign one that doesn't have an expiration date which seemed to confuse them a lot, but I ended up getting it.

In the end, since you're not allowed to work without an EAD, you don't really need an SSN...

Please i will like to ask, i submitted my I-751 removal of condition application at Texas Service Centre in December 31, 2020. Am still waiting for notice from USCIS. Is anyone here with an idea of what is really going on because my green card elapses today. Please i need your contribution.

    Thanks.

You mean you sent it to an address in Texas? The correct address is in Phoenix, AZ : https://www.uscis.gov/i-751-direct-filing-addresses. It seems, from other people's experience, your packet will get forwarded to the correct centre anyway but it adds some delay.
If you mean your case is being processed by the Texas SC... then how do you know that if you didn't get the notice? Did you call them?
