Jenny17655 reacted to powerpuff in withdraw I-751
~~ Topic moved from Removal of Conditions on Residency to Effects of Major Family Changes where similar topics are discussed ~~
I’m sorry to hear about your situation.
You cannot withdraw that petition, that is your husband’s petition and it is solely in his hands. There are no next steps for the spouse of the immigrant in regards to USCIS.

Jenny17655 reacted to Family in withdraw I-751
He filed a Joint I-751 ( you signed and on the basis of that he was granted an extension) , therefore you most certainly can do a few things:
1. send a letter to USCIS stating that the marriage is no longer viable, divorce proceedings filed include copy AND add reference to the CPS investigation case number and contact.
If you have any court case number for his pending criminal charges , include that.
2. file TRO ( domestic violence restraining orders protecting you and your child ) if you have not done so yet, even if there are CPO ( criminal protective orders ) in place.
3. Get all the help and support you can for you and your child. Remember they teach parents on airplanes to first put their own oxygen mask before attempting to put it on the child.
You are a strong woman and a good mother. CPS may get a bad rap for failing to protect many children, but I am grateful they were there to yours from any further pain.

Jenny17655 reacted to Boiler in withdraw I-751
He has been charged not convicted
It could be a felony or a misdemeanor.

Assuming he has not been granted removal of conditions then certainly I can see he has a number of issues but they do not involve you.

Jenny17655 reacted to geowrian in Abandon K1, Marry on ESTA and adjust status?
Doing AOS is a legal option here, although the misrepresentation (if deemed material) is not something that goes away. A waiver may be necessary. It is also because of stuff like this that others in the future may not have such luxuries.
They do, although they may or may not fall under a petty offense exceptio for a visa (but not an ESTA AFAIK). Battery might not fall under that.

Jenny17655 reacted to The_Empyrean in Adjustment of Status for Tourist Visa Holder
I dare you to tell on the border that she'll adjust status while VISITING.. see how that goes..

Jenny17655 reacted to Boiler in Adjustment of Status for Tourist Visa Holder
So when she enters and is asked the purpose of her visit she will say Immigrating?

Jenny17655 reacted to Boiler in K1 visa- automatically entitled to work?
I also question the Lawyer competency as this is pretty basic stuff, is this Lawyer an Immigration Lawyer?
SSN is not work authorisation, it is a Social Security Number, useful as effectively it is used as an identity card in the US. Even if it is not.
Used to be that you could get EAD associated with the K1 as a stamp on arrival or very soon after, could still be useful if you expedite, but might make more sense just to marry file to adjust and expedite EAD associated with that that asap.

Jenny17655 reacted to WandY in K1 visa- automatically entitled to work?
Hire a more competent lawyer. The difference between getting married and going the CR-1 route instead of the K-1 is that the CR-1 provides an EAD (ready to work when he/she lands in the U.S.). Not so with the K-1.

Jenny17655 reacted to Jessica Robertson in Help! K-1 visa expired and haven't sent any document to USCIS yet.
Visa. We didn't apply for I94. This is also my concern, isn't it (I94) optional? CMIIW

Jenny17655 reacted to Crazy Cat in USCIS visit
It has been said that visa overstay is the biggest source for illegal presence.......How do you propose to solve the issue other than seeking them out?
-
Jenny17655 reacted to portorusa in USCIS visit
The USCIS has nothing better to do than searching for K-1visa overstays, good grief! What a waste of the taxpayers money😬

Jenny17655 reacted to Lebanese23 in AOS is ready to be scheduled for and interview but no EAd
your interview is coming up, once you get your Green card, the EAD is cancelled, so you won't need it. Your green card replaces it anyways. best of luck!!

Jenny17655 reacted to Ola4Ola in Visas Issued
After 8 months in AP and 2 interviews we were finally issued a visa. I give God all the glory and thanks to the VJ family for your unwavering support.

Jenny17655 reacted to Zach2015 in AOS and final paperwork
The Petitioner is now the beneficiary (the person you brought over from another country) Not the USC. So only the beneficiary which is now the petitioner submits passport photos.
No, you do not include the entire packet. Just the NOA1 from the K1 process
No. Just the marriage certificate. All the paperwork and photos will be for the actual interview.

-
Jenny17655 reacted to Crazy Cat in New rule regarding health insurance
I see no reason a spouse would not have health insurance by the time of AOS interview.......

Jenny17655 reacted to designguy in K1 Visa refused
They wouldn't hold on to your passport or request more documents if it was a straight up refusal

Jenny17655 got a reaction from Jmeleecur in Communication Issues
Well I belong to an amazing group of women who have husbands and fiancees in Jamaica and I can tell you for certain that all of our relationships have been stressed to an extent by the process. And once he arrives in the US please expect an adjustment period of 6 months to a year or more! My husband was great upon arrival, then had a bout of depression after not being able to work or contribute to the household while waiting for EAD (One issue you won't have to deal with as your spouse will be coming in with a green card!) We had a few ups and downs getting used to living together and blending the family. It is definitely normal just remain focused and committed and you should come out the other end just fine. It gets better!!!!
