  1. Yes it is still in the petition stage. We have sent in additional photos and a joint lease on our rental property as further proof. Working on getting a joint bank account and sending proof of that to the USCIS Field office as well. Approval of the parents of adult couples who have willingly entered marriage and living as a married couple for over a year should not be a requirement. We'll see how it pans out.

  4. hank you @Amadia This is what the link says If I have a driver license from another country and I have a NY State learner permit, can I drive without a supervising driver? Yes. Your valid foreign driver license allows you to drive without a supervising driver. You can drive on any street, road, highway, bridge, or tunnel, except in a DMV road test area. If your driver license is printed in any language except English, you must bring an International Driving Permit or a certified translation of your driver license to the road test. The translation must be certified by a consulate, the US Department of State, or another official agency. The translation must include your name your date of birth the expiration date of your foreign driver license a list of the types of vehicles that your foreign driver license allows you to drive If you have a NY State learner permit, and you do not have a valid foreign driver license, NY State law requires a supervising driver to ride with you. The supervising driver must be age 21 or over and must have a valid driver license to operate the vehicle that you drive.

  6. We are hoping to get back to the United States soon. I (the beneficiary) already have an unexpired Indian Driver's license. Would that expedite the process in getting a driver's license in the state of New York? Would I be able to apply for a license at the DMV on the very first day or is it only possible to get it once the conditional resident green card is in hand?
  7. We received a notice of additional processing requirements today in the mail. It says to provide evidence to establish our marriage is bonafide by submitting wedding pictures of the ceremony and wedding receptions with family and friends and the wedding invitations. It says we may also include joint bank accounts, joint leases, joint mortgage, insurance policies, cancelled checks, joint bills, income tax returns, affidavits from the beneficiary's family, photos. We got married at the Sub Registrar's Office at the area of our residence with 3 of our friends as witnesses. We did not have a big ceremony or a reception and no wedding invitations were passed out. We married this way only because we had no approval from the beneficiary's family. Our bank also said we cannot have a joint bank account even though we are married because they are not allowed to make a joint bank account with an Indian national and a foreign national. The only evidence we can send back is the new joint lease on our rented house that we have since June 6th 2019 and a letter explaining our situation in detail. Maybe a letter from the bank saying why they can't let us have a joint bank account if that is possible to get. Would that be sufficient along with some additional photos to satisfy the field office director? We have plenty of proof as evidence from the Indian visa paperwork for the petitioner's Indian residency visa to show that we have been living under the same roof for over 11 months now. and they are all submitted already.

  9. @Kuneesa Did you guys receive any updates from the USCIS after filing the petition through email or sms? We filled out the e-notification form but we haven't received any form of notification concerning the petition yet. Should we give them a call and ask about the status of our petition?

  11. Did you use a tax consultant in the US to file your taxes from abroad or did you mail in your filled out 1040 to the IRS? Did you fill out a W7 form for your spouse to get a Individual Taxpayer Identification Number when you filed your 2018 tax return? TurboTax would not let us file jointly without me having a Individual Taxpayer Identification Number. Also there is a Form 4506-T Request for Transcript of Tax Return. Will the IRS mail it to india if we fill it out and send it to them or would a third party in the US need to do it for us?
  12. We tried to front load the petition with as much evidence as possible like people here recommend. Proof of residency, Proof of identity of both the petitioner and beneficiary and proof of a bonafide relationship all compiled into separate subsections with a contents page explaining what we have submitted in order. We also added 30 pages filled with 70 pictures of us together during our engagement and marriage. The lady asked us for our marriage pictures and I explained to her that we got married at the sub registrar's office where they did not allow us to take pictures. What other evidence did she suggest you guys have for the interview other than the sponsorship documents?
  13. Also there are more appointment dates available for filing I-130 petitions in Delhi for the first 2 weeks of June.
  14. We filed our I-130 petition in New Delhi on May 30th. The lady at the counter took our passports and went back inside to check it out for an hour. Another Indian lady came out and took our petition in. She went through the petition and she asked us to fill in our mailing address on our I-130 application which we had missed. She asked both of us if this marriage was the first marriage in our lives and we said yes. She explained that if the USCIS Delhi wants more document they will contact us and if it is approved they will notify us through email and to our mailing address. The filing process was very smooth and there are hardly anyone waiting in line for these particular services. We had to turn in our electronics and our bags at a tiny kiosk across the road from the embassy. 50 rupees for an article of prohibited item. Thank you to @Kuneesa for being a tremendous help to us!
