    The case worked said that she is not eligible for Emergency Medicaid since she is not "illegal here". That Emergency Medicaid is only for "Illegals"

    My wife and I ( we live in Mexico) originally had a k1 visa application in process.  She is a third country national living in Mexico. We were actually at the embassy stage, but decided to cancel and apply for DCF.  Long story why that took place. But in the end, it was the best decision.
     
    Our process here in Mexico took around 2-3 months. When I submitted the 1-130, my wife's k1 case was still at the consulate in her home country. I asked USCIS if this would be an issue, and they said no I can go ahead and submit the 1-130 to them and it would be processed even though the K1 had still not been cancelled. Make sure, if you take this route, to cancel the k1 visa. In the end we did not have any issues, but keep in mind I sent a letter asking for it to be cancelled the day before I went to USCIS in Mexico City. By the time she had her interview at the consulate, we already had a letter confirming that her k1 case had been completely withdrawn. I would check with USCIS in Guanzhou if this will be an issue first. 
     
    If you do take this route, submit ALL OF YOUR EVIDENCE OF MARRIAGE to USCIS in Guanzhou. My wife and I did not submit a whole lot to USCIS in Mexico City. When we got to the consulate stage, she took a whole binder filled with information. They did not take any of it. I'm guess it's best to submit everything in the very first stage. Better to be safe than sorry. 
     
    DCF gives your wife permanent residency once she is admitted into the country. With a k1 visa, it can be a long process applying for that residency. Hence she would not be allowed to work for some time. 
     
    Cancelling the k1 and going for the cr-1 WITH DCF was the best decision we could make. Give it some thought.

    This must be very upsetting for you. Why were the police called? Did he physically assault you? Threaten you? Damage property in a heated argument? If he has committed a crime then it’s possible that his visa journey has effectively ended.
     
    You mentioned an annulment. Is that because you believe it will get him deported? Annulments are very difficult to obtain. Is he saying he doesn’t want to be married to you and this was all a sham marriage just to get into the USA or is he just curious as to what it might be like to be intimate with another man? I doubt you’ll get an annulment if he’s just wanting to try something different or experiment. But if he defrauded you that might be something else. 
     
    We are all comfortable with different things when it comes to sexuality. If this is something you are not comfortable with then you should seek the advice of a divorce lawyer in your state.

    Just to help others - we communicated with each other via DM.    My wife was also a third country national.  It took us a week to get the visa / passport back. We got back a packet about two inches thick.   I am sure it took time for DOS to assemble it all. My wife called in after 4 days and it hadn't been issued but they confirmed it was approved.

    Not really. They're going to want to see your Virginia driver's licence, your bank statements going to your new address etc. Also, you don't need to bother with notaries, you just include the phrase " l declare under penalty of perjury (under the laws of the United States of America) that the foregoing is true and correct". A notary just proves the identity of the person who signed it; not that they're telling the truth. 

    Also, if you're trying to hide where you now live, the zipcode gives it away (I live close by, recognize it). 
     
    I think that this point, you need to involve a lawyer. NOIRs are serious, you've got a few other complications and don't seem to be understanding what people are telling you to do (and... are you really moving to Virginia? If you're not, they will know in 5 seconds). 
     
    The bottom line here is that people who are married almost always share finances. That is pretty much the #1 proof they're looking for. You can find whatever excuse you want for not being able to provide that kind of proof, but thousands of people in your situation manage to every year. And they're not even trying to generate proof for immigration-- they're just living their lives as typical married couples (although separated by distance). You keep saying "we can't, we don't live together yet" as if there aren't thousands of other married couples who don't live together yet. I won't pass judgement on the bona fides of the marriage (bona fide is different than legal), but I will tell you that given the lack of evidence you gave, the NOIR and your general approach to this, it is clear that you left a strong impression with the government that you're doing this for immigration purposes. You'll need more help than Visajourney can give to overcome that impression.

    you are asking if she can travel outside of her home country? I do not see why not as long as you are not there for longer than 6 months. You'd need a police certificate from Mexico if you were in Mexico for 6 months or longer

    I really have to read stuff more. Yeah this is wrong. I don't get why he blames the lawyer for telling him to do Nikah when he goes and gets married after applying for k1.

    From the first post, that’s the timeline:
     
    Met
    Fiancé visits first time and they have the nikah (considered as marriage)
    file for i129f
    Fiancé and family visit Pakistan and they get married
    interview and denial
     
     
    Filing a i129f was the wrong path from the start and then actually applying for the k1 was knowingly misrepresenting themselves as single people

    Did the officer say why you were denied?
    1. You need to be married before applying for cr-1.
    2. Your marriage date would be after your k1 visa interview date if you are not yet married. I do not see how this would be classified as fraudulent if you applied for cr-1 visa without cancelling k1 visa. Someone correct me if i'm wrong.

    I just got back from my appointment to hand in my documents at the Mexico City uscis office. They acted very professional and kind. 
     
    It is is true that they now require all forms to be submitted in person. I overheard about a situation they had where some individuals were committing fraud by telling applicants that it was necessary to have a lawyer when applying for spousal visa. In order to combat, they require all forms to be submitted in person and no longer accept spousal visa applications through mail. They're cracking down on fraud it seems.

    Fantastic information Jorge! This is exactly what I needed. I'm in cancun so If i take the marriage route  I imagine it's quick for the marriage certificate. I'm going to make phone calls on Monday. Once again thank you so much. You were a tremendous help.

    You can look at the timeline in my signature to get a detailed look and a link to a DCF Mexico guide I wrote based on my experience.
     
    But in short, getting married in Mexico will take a few days - a couple weeks at least. You need to do blood tests and attend a 4-6 hour group course with a lawyer and marriage counselor (this may vary by state, we got married in Jalisco). Depending on where you live all openings for this course may be booked up. We had to drive a bit out of the way to find a place that wasn't booked up. This is for a civil wedding, if you want to do a religious ceremony then you'll have to allow for more time.
     
    Once you get married you may have to wait for an official copy of your marriage certificate to become available. This only took a few days for us but I've read about couples living in other states and/or small towns where this has taken longer.
     
    After this your wife can apply for residency. As mentioned, this took 8 weeks for us but it can take as little as 5 weeks. Our lawyer quoted us 6-10 weeks. I'm not sure if she'll be placed in an some form of temporary status, but I would assume so. Many countries do this but I would suggest asking a lawyer. I paid around USD$600 for the total process, about half of that was government fees and the other half lawyer fees. The lawyer did everything, including sending someone to wait in line for our marriage certificate and translations.
     
    Once your wife's residency is approved then you can apply for the CR1 via DCF. The process in Mexico is pretty fast, with the wait time for the interview being the most time consuming. The initial I-130 is typically approved within a week, and some times even the same day. Our process took 7 weeks, but we were able to save around 5 weeks because we got lucky and found a cancelled appointment that was 5 weeks earlier than our original appointment. I always recommend that people check for cancelled appointments as often as possible.
     
    Once your wife attends her interview in Ciudad Juarez (you won't be allowed to attend) and is approved, they'll keep her passport so that they can attach the visa. They'll mail it back to you within 1-2 weeks but some people get placed in AP (administrative processing) which can add several weeks to the wait. Your wife being from Venezuela could lead to delays in AP.
     
    So overall you're looking at
    About 1 week preparing for your wedding (blood tests, government mandated courses) About 1 week (though could be more) for your marriage certificate to become available. About 6 weeks for her Mexican residency (though it could be 5-8 weeks) About 3 months total for the DCF process. Fastest Mexico DCF reported on VisaJourney was 33 days, but that was in 2006 when things went much faster. Ours is the third fastest at 49 days. Average seems to be 90 days. Grand total: about 5 months.

    Hey everyone!
     
    Just thought I'd share some info. I realize the crumbling situation taking place in Venezuela right now is only progressing and that many people have to leave. You fiance may be a part of that group.  They may also be going to a country in South America such as Ecuador, Colombia, or Peru. Right now, i'm in the same situation. My fiance is from Venezuela and we are living together in Ecuador.  You may also be worried about whether they can change the consulate to another one. You can change once the application hits the NVC. From there this is an average additional two months waiting time. Now if you are yet to send out the application, then you can put another country down . As far as im aware they will only be allowed entrance if they have  residency for the country that is chosen.. Well here is the good news. Ecuador has a temporary residency visa called MERCOSUR for Venezuela nationals. It is relatively quick to get.  This allows a stay of two years and gives permission to work in Ecuador. This would give your fiance permission to enter the embassy since they are classified as residents in Ecuador. If you have any questions ask away. Take care.

    While on a tourist visa in Colombia in May of 2017 I had the pleasure of meeting my Fiancee when I went to the Ruta 55 Restobar restaurant, in Bello, Antioquia, where she was my server. Our relationship developed and continues to develop today. We are currently living together in Quito, Ecuador. In the attached pages, you can find documents supporting our past and current relationship.

    In my opinion that is way too long and detailed for how we met..  It does sound like a good narrative in terms of front loading the application to show proof of real relationship to make her interview easier when it comes time.   So what I would suggest is that the narrative you have written simplify it to something like this...
      While on a tourist visa in Columbia in May of 2017 I had the pleasure of meeting my Fiancee when I went to the ___________ restaurant where she was my server.. Our relationship developed and continues to develop today.  I have included pictures and documents of how our relationship has developed on matured on the following pages. 

    You would then provide whatever pictures, receipts passport stamps etc. that support the narrative that you have written... Good luck in your continued journey and God Bless.
