Timona reacted to Redro in Can I get married while my IR5 immigration is pending ?
Generally only parents and spouses can be qualifying relatives IIRC. @Family do I get an A?
-
Timona reacted to SalishSea in Can I get married while my IR5 immigration is pending ?
This sounds like a marriage for the purpose of obtaining an immigration benefit, which is fraud.
If you do choose to go this route, expect scrutiny with that misrep history.

Timona reacted to OldUser in Removal of Conditions and Adoption
If your wife:
- Has been married to you, US citizen, for 3+ years
- Has been a permanent resident for 3 years
- Never had trips for over 180 days at a time since becoming LPR
- Spend at least half of her time in the US
Then she is eligible for N-400. Even with I-751 pending. Yes, conditions have to be removed, but the petitions can be pending in parallel. And can be adjudicated together if I-751 is not approved when N-400 interview is scheduled.

Thats going up a long road.
Just apply for your wife's N400 online today. They're being adjudicated fast. That'll push the I-751.
As soon as she gets N400, daughter becomes citizen too..less of a hustle. Save your money. No need for lawyers, etc and adoption headaches
-
Timona got a reaction from OldUser in Removal of Conditions and Adoption
Isn't the mother not already eligible for N400? If that's the case, her naturalization will be faster than you spending $$ on adoption, court cases etc
As soon as she naturalizes, the 13 year old pighy rides too

Timona got a reaction from SalishSea in F4 visa refused - divorce wasn't final before current marriage
Exactly.
Even if his other divorce would have been finalized 1 day, 1 min, 1 month before the interview, his current wife would still have been denied visa. Why? 2 marriages overlapped.
For you to benefit, there shouldn't be any overlap, regardless that there's one ongoing divorce case. US divorce and marriages are dependent, nor independent. One has to end before the other starts.
While you can remarry in Pakistan while your current divorce is processing, if you're to seek US immigration benefit, there shouldn't be any overlap. If overlap occurred years ago when you had no interest in going to US, but now things have changed, you'll still have to divorce current wife, then remarry her to seek benefit. Dates can't overlap

Timona reacted to nastra30 in Is filing the Abandonment of Lawful Permanent Resident (LPR) Status (I-407 form) required BEFORE filing a Petition for Alien Relative (I-130 form)?
I don't think interviewing officer has that authority to determine abandonment in this case. It will become a court case at that point if op is willing to fight it. Also, the person can't just enter and naturalize; they'll have to meet a fresh set of residency and physical presence requirements.

The US Embassy, though in Pakistan, is an extension of USA. When you step inside the embassy gates, you're technically supposed to follow US laws. That's how politicians used to claim asylum back in the days.
Now, polygamy is legal in Pakistan but not US. So, not sure what your relative was arguing about. Infact, he or she can't marry and bring 2 spouses successively to US because "polygamy is legal in my religion."

Timona reacted to Family in F4 visa refused - divorce wasn't final before current marriage
Looks like Applicant won’t be traveling soon either due to AP. Definitely do the divorce from current spouse now , remarry so that when Applicant finally gets visa and enters the US, she can file I-130.
Did they use an attorney to file this case ? Did anyone review these documents when sent to NVC? Hard for me to imagine NO ONE knew of the date problem until the interview.

Timona reacted to powerpuff in F4 visa refused - divorce wasn't final before current marriage
That’s a futile argument as the consulate relies on US laws, not the applicant country’s laws. “About to be finalized” is not the same as fully finalized so CO is right about that as well.
They can’t travel on the same case as the marriage was/is not valid at the time of adjudication and there is no basis for him to travel as a spouse on a F4 case.
I believe that’s the only option. The wife will have to sponsor the husband. Keep in mind it takes 5+ years for a Lawful Permanent resident to sponsor a spouse.

Timona reacted to OldUser in Naturalization with COVID-19 Absence, Frequent Travel, and Divorce - Advice Needed
That would be my advice. I know you don't have crimes, but divorce and long absense together already may create a bit of complication when adjudicating the case. At least the continuous residence won't be an issue if you want a little longer. When I-751 was approved, were you still married, in process of being divorced or divorced? Did you live with your ex at the time when I-751 was approved? Did you file jointly or with divorce waiver?

Timona reacted to Crazy Cat in AOS from a visitor's visa (through marriage)
That just seems like a long trip to the US without also planning to meet a boyfriend. I wish you good luck on your journey. If you apply to adjust status, remember that you cannot travel outside the US or work in any way inside the US without proper authority (Advance Parole and Employment Authorization Document). That could take 3 to 6 months. Good luck.

So who is this woman? Is she a licensed lawyer? Sounds fishy / not trustworthy to me. For anybody reading: be careful and check credentials before trusting anybody with your personal information or paying somebody to do any immigration work for you.

This story is too good to be true...how is this *woman* who keeps telling people to go to Sierra Leone come across intending immigrants? Why is she the one that calls you and is the middleman between you and the hospital?
And as you said, you got to the embassy and met other people linked to the same woman? If you were able to find this information easily, how come US embassy Sierra Leone hasn't sniffed this woman and what role she's playing? And the hospital hasn't sniffed her too?
I don't believe this. Reads like an attempt to solicit clients off VJ, who'll regret later. Why you trust strangers with your case number?
