    We had a similar experience at a Virginia DMV some time ago. We handed over the expiring GC and extn letter, they said they needed to run it by Legal. I could see the extn letter being put into something along the lines of a fax machine nearby. After a half hour wait, no approval and told to go home and await a verification call. Well, no call, but we decided to go to a different DMV a couple of days later. Started the same with the extn letter being 'faxed', but about 10 minutes later the agent said they'll approve us. We think they did a manual override in their System because a supervisor was involved. We ended up with a 1-yr license. Another VJ member went to that same DMV and got a 8-yr license extension with the letter a few days earlier.
     
    Moral: no one knows for sure what the heck goes on behind the scene..

    Today we sent our ROC package via USPS Priority Mail Box w/Tracking. We didn't count number of pages, but reckon ~200. We divided the evidence into two stacks, using 2 ACCO fasteners. 
    We included a 2-pg cover letter, 1-pg table of contents summary, followed by detailed Table of Content sheets (15) for each exhibit (A-O). Each set of evidence followed under each tab (we made our own Index tabs). The 3 photos attached here shows our package.

    In order for her to be approved for Naturalization under the 3 year rule, she has to be living in marital union with you on the date of oath.

    Look at it this way.. the ones those undocumented ones get are a single purpose one, and no additional benefit.. your fiance should eventually be eligible for Real ID compliant one. Someone once asked me why CR1 applicants married to USCs have to wait a year or so, while H1b spouses could travel to the US soon after a wedding.. I responded with the shpeal about CR1s get a green card, so have to wait for background checks etc, while H4s dont have such long term benefits.

    The son cannot enter the US on an ESTA (or a B2 visa) with the intend to AOS. After being petitioned he should go for consular processing in his home country. 
     
    PS this thread ought to serve as an example to those NIV applicants who believe young kids are ties to home.

    This is but one example why India is considered high fraud. Applicants (or their agents) are willing to misrepresent the truth for a better shot at a visa. Stating an applicant would be visiting a higher-aged friend when in fact it's his gf was misrep. 
     
    Anyhow, while information from previous applications and interviews are available to COs, this doesn't appear egregious enough to affect a K1. COs can put two and two together about the b2 attempt. K1 would be decided on it's own merit, ie documentation. Fyi, Indians with white American fiances/spouses DO attract scrutiny in Mumbai.

    According to posts in other forums, a retired CO understood that to be usually a thinly-guised attempt to enter the US and code or seek H1B etc.
     
    Any company that sends employees on business demonstrates clearly why they need to send that individual(s) to the US, and not just for "..various business meetings with various clients, stakeholders, business partners.."

    I thought parent child visas were based on birth (or adoption) certificates, not photos?

    So long story short drove from indy to Chicago today and brasilian consolate.  She did not have her birth certificate so they would not renew her passport.  They did give her a one way passport entry for Brasil.  She lives in argentiana as a brasilian citizen with no current ties to brasil.  However Brasil and Argentina have a no passport requirement.  So we booked her a one way flight to rio.  When landing she will then board a separate airline to argentina where they will recognize her Argentine Id to board that flight.  Had to be really creative on this one.  Wish us luck on Monday.  She should go through customs in Brasil and be good to go at that point.  We hope

    A visa isn't stolen, only a passport can be stolen. 
     
    With all the safeguards in place in recent years, nearly impossible to misuse a passport or US visa.

    Another individual's itinerary has no bearing on your application. You or your company has to document why they need to send you for a 3-mo stint in the US.

    If the petitioner becomes a USC and you remain unmarried then it becomes F1 and unless you are from Mexico or the Philippines your priority would be current. You would turn be invited to submit relevant documents to the NVC and complete the visa application form. 
     
    I know you are desperate to live here any way you can. You mentioned a K-1 yesterday. That would be the fastest of your available options. It looks like you are used to doing things very fast, given the speed with which you have gone from meeting your boyfriend for the first time to wanting to file a K-1. But nothing in immigration is fast. It requires a lot of patience and long-term planning.

    @geowrian yes I know the government is just doing their job.... just wishful thinking for my own situation. 
     
    I want to to thank everyone again who has contributed to my post whether it be a fact or opinion... good or bad .... it has helped me to get my head out of the fog and have a deeper understanding of what Path we should take. I will update this story on my website as well as here. I will also post my vlog on YouTube in a couple of days filming this event  in case you want to put a face with this story. I’ll post a link to the video later.

    Yup, here it is:
    A section 245(c)(4) renders aliens admitted under the VWP ineligible to adjust status to that of a person admitted for permanent residence. This provision, however, includes an exception for immediate relatives of U.S. citizens.

    None of all the things mentioned above would be looked at. 
     
    Applicant takes all originals to the interview, incl the i864 and PCC. The CO would make a visa determination at the interview.

    She returns to her country before i94 expires. She got a visitor visa by showing ties to her country. Presumably those ties to her country are still strong. And if she really wants to study in the US, she returns home to her country and applies for an i20 (college admission) and a student visa interview.

    US embassy by law presumes all B2 applicants would not return home. Your wife has to prove that she will. And in this case, the CO isn't convinced.
