    Hi everyone

Should we just try to keep calling NVC on our own? do we ask for a supervisor? we arent really sure what to do

Unless I am mistaken, you should feel lucky that you get the RFE's, because, I've read that recent changes in policy, they do not even have to issue an RFE at all, it's up to the person doing your paperwork.  They can just deny the whole thing and start over from scratch.  Others would know better than me if it applies to the NVC level or not.

We don’t know if we should tell the truth to the officer because it might end up to a denial of my adjustment of status. He wants me stay here for my future as a nurse. I am a registered nurse here and I’m just waiting for my EAD to get started working. He still cares for me and wants me to have a great life here in america but the thing is he doesn’t want to be with me anymore because I’ve been emotional ever since I got here, we’ve been fighting a lot over small things, I don’t know what i’ve done wrong for him to change the way he feel towards me. I just got here 4 months ago—adjusting with my new family (we live in his parents house), i have no job and I still don’t know how to drive and i don’t have friends here. I think he is fed up with all my drama. Clearly he doesn’t understand what I am going through because he grew up here.

No that it helps you, but my wife and I argued a lot during the long wait for the EAD as I am sure she felt useless and all.  But we stuck it out, like most here and every day we are happy we did.  We are a team, partners, not just married.  We make each other laugh all the time, and we are together constantly, we have movie night, date night, etc.  Ask yourself what it was you saw in him and he in you that you were sweethearts back then, and now don't want to be at all...      I can understand as well, your lack of work plays a big part, especially since he can't afford to leave his parents house to even have your own lives together, alone.  That can play a big part of the frustrations.  Perhaps get some time away,  use FB to meet some friends, or go and volunteer somewhere.  Give him time to miss you. Things might change for the better, so I would not give up so easily.  just my humble Opine.

This kind of tells you the level of the story at Vox

"Some immigrants, mostly family members of US citizens or green card holder, can apply for lawful permanent residency abroad and obtain a green card almost immediately."

Since when was anything dealing with immigration immediate?

I know a woman in he Philippines, who, on a family petition, is still waiting after more than a decade.  However, once approved, she will most likely get her green card "almost immediately"

Oh I read this the other day and it is horse poop at best. Someone posted it on the Reddit Immigration page it is so made up

Time will tell I guess.  Some things appear as "fact" that turn out to be fake news.  (MSM)  Other things start out as a "conspiracy" stuff, and eventually turn out to be truth.  Time will tell I guess.  I don't do Reddit, so I don't know the level of BS they post, and for Vox, I really don't know their level of truth or BS.

I wouldn’t worry about the new rules. Surely your husband is adding you to his healthcare anyway? He shouldn’t need a law in place to do that - it’s part of being married. Nothing has changed yet and in a spousal visa situation nothing should need to change. If he loves you surely he will ensure you have what you need here, and that includes healthcare.

But if the new policy is enforced it will be determined at interview.

I'm still wondering....  A K1 is a NON immigrant, but at what legal step turns the non immigrant in to an immigrant?  Wedding?  Filing AOS, or AOS approval, or the forth option, a non immigrant is considered an immigrant for all legal purposes of the rule.

There is no new I-864.  There is no Oct 15th USCIS public charge rule affecting immigrant visa applicants.  It was delayed by Federal Judges yesterday.  There is currently a Nov 4th Department of State policy stemming from a Presidential proclamation which requires immigrant visa seeker to have medical insurance within 30 days of entry into the US.

Oct 15th public charge rule-  Currently has been stayed (delayed) by federal judges.  The new I-864 and I-944 have been removed from the USCIS web site.

By now, it looks like you have a copy of this text on your desktop to easily copy/paste.. LOL

The children are considered as household members for the affidavit of support. They are your children and they are dependent on you. So your household size is 8,

O.k, so even though the kids are not actually living in the house,  support is provided, thus calculated in.  O.K.,, was wondering.    Thanks for the update.

It will be LAX. It's where my fiancee and I came thru. Really quick and easy. You will arrive in the international terminal, go thru POE, then got to another terminal to take your domestic flight to Atlanta. Make sure you have a minimum of 2 hours between flights, I would recommend 4 hours to really be safe.

Mine was not as smooth.  the big screens that show the arrivals, her flight number was there but it said a different gate that it arrived at (domestic),  I asked a couple of employees and they were a bit confused, but paid my parking fee and drove over to the international terminal, paid more parking fees and walked around looking for where the international flights were.  Went all the way to the end of the baggage claim area and ran out of terminal. LOL.  Then I found a secret little area hidden from view where I waited for like 45 min more before the fiancee came out.    Still to this day, I haven't a clue why an international flight was "directed" on the board for a domestic gate.  Fun times. ! LOL

I’m obligated to pay roughly $4000 per month in child support and my income has grown over the last three years. My current income amount is even higher. No previous I-864s

Even at your 2018 of 103K, minus your 48K child support, leaves 55K, more than enough for 2 (you and your wife).  I wonder if they are counting the 6 kids as household members for a total of 8 people?  Thinking you have 55K left for a family of 8.  Just guessing.

You can take all of that, but don’t be surprised if they don’t ask for any of it.  I had my interview with my husband last November and I brought a binder with all evidence and the interviewer asked for none of it.   He had our file and all evidence from the I129 file.  He looked through that and asked a couple of questions to my husband in Spanish and then the same to me in English and approved our case.  I know all cases are different, so don’t stress about it.  Just show what you have but don’t go overboard.

I can't help but wonder.  When my wife had her interview, they took her folder in the back,  then eventually called her to a window, and did not look at anything she brought, just what was filed.  I wondered if there is a back room of people who look things over quickly and give to the IO with a nod or a shake of the head, which the IO takes it from there.  Don't know. Just a guess.

I'm really not an expert, but the way I understand it, K-1's are non-immigrant anyway. So I don't know that this will technically apply to them because they are coming on a K-1 Visa not an immigrant Visa.

That's a good point!  Yes, the K1 is a non immigrant, and until they have their AOS approved, I would think they stay as a non immigrant until which time their "Adjustment of Status" is approved.

I wonder how the thirty days will work with K-1. We can't add them to our insurance at work until we are married, right ?

Well. especially when sometimes K1's don't get married until the near end of their 90 day's.    Open enrollment, I don't know.  I just hit up a couple places and picked a plan for my wife.  Only used it one time so far,  they paid and we paid our co pay.  Tons of competing Ins co's out there.

    Hi all,

Recently accepted a job offer and was given a start date. The day before they tell me I wont be starting as they cannot determine if I am eligible to work with an EAD. It looks like its going towards the company saying that I am not a permanent resident and they will not hire me. Not sure what to do here. Can anyone pass on some advice!!

EAD stands for Employment Authorization Document and obviously the company does not know that.  My wife only had her EAD and temporary SSN and she got employment at a national chain employee.

Now I'm worried that because the my father on the I-129f and the DS-160 do not match it could cause an issue.

Has anybody got any experience in this? Or any advise?

    Thanks in advance.

I guess that depends on the legal definition of "parent".  Since you were not adopted, your biological father is your legal parent, and your stepdad, even if he raised you from 6 months, is your "dad".. but not your legal parent.  As others said, they could or should fix it once they understand your situation.  At this point in your life, I don't think they should care at all about the biological parent after all this time.  I hope you update us after your interview, as many here learn from others experiences.

It could be a chance of a lifetime, let him become a doctor or lawyer in Philippines and live a good life over there

You are correct. I've heard of some who have their doctorates in the PH, but in the US they are lucky to get a job at a pharmacy, so they scale back their resume.  Someone who is a licensed MD in the PH makes a much better living than a pharmacist in the US.

You don't need to include him,  Let him stay in PI and give him an allowance or put him in college in Philippines.

Yeah, this a a route some take, as the child does not want to immigrate. I'd like to know what the teen thinks about it.  Perhaps he would be happy living with a relative and going to school.

We are about to start this process, and I have been receiving mixed messages over whether or not I should be engaging the services of an Immigration Attorney to help with it.

However, I know that this doesn't come cheap so I only want to do it if it is really going to benefit us to do so.

Could anyone offer any advice on this please? Is it straight forward enough to go through the process ourselves, or should I be looking at using a specialist?

Will having an Immigration Attorney speed up the process, reducing the time between filing the I-130 Petition to receiving my Interview invitation?

Thanks for your help, in advance.

    Ben

We did it ourselves, by reading,  downloading blank forms to study, and of course, asking questions here.  You can do it too, unless you have a lot of complications of the couple where some legal expertise is needed.  They ask you questions, you answer, they check the box yes or now and charge you thousands to do that for you.  Yes, there are many who successfully  used legal help and those with horror stories of lost paperwork.  And when you have only one original, and it gets lost.  oh oh...   My advice,  spend a few days and look at the blank forms you would be required to file, then make up your mind.

Here is some info for healthcare for LPR's,  GC holders, etc...

Medicaid, CHIP, and “public charge” status

Applying for Medicaid or CHIP, or getting savings for health insurance costs in the Marketplace, doesn’t make someone a "public charge." This means it won’t affect their chances of becoming a Lawful Permanent Resident or U.S. citizen.

There’s one exception. People receiving long-term care in an institution at government expense may face barriers getting a green card.

I went on the state health department website (IL) and it just pointed me to Medicaid/CHIP.  It did, however, make it clear that if one is a GC holder, they should speak to a specialist to make sure they are not a public charge.
