You are in danger of deportation until you get the receipt for your I-485..you will then be granted authorized stay until the decision is made on your adjustment of status......this is not Trump's fault.  Congress must provide funding....

"USCIS first brought its request to Congress on May 15 and is asking for the $1.2 billion over a two-year period."

Yes, the House holds the purse strings and were too busy with "other matters" to deal with it.  Since USCIS is somewhat self funding through fees collected, and with fees down about 50 percent due to the shutdown, they don't have much of a choice, unless employees just volunteer to work for free to do everyone's paperwork, and that's not going to happen.

    Hi,

My husband quit his job friday a day after i asked him if he thinks we should try to expedite our Case which is still at The NVC.

    Thanks

Don't know about his state, but in all the states I've been in, if you QUIT your job, you are not eligible for unemployment.  Only when you are laid off due to no fault of your own.  If one is fired for most activities, they are not eligible either.

  3. The Supreme Court unanimously upheld a federal statute that outlaws encouraging illegal aliens to remain in the U.S. unlawfully in a decision Thursday. This is from a 10 year old case.  The case involves a woman who coached Illegals how to skirt the system and stay in the US.  She made over $3 million for her services.  Now that the SG ruled and the US Federal law stays, I wonder if City Counsels,   County Boards, and  State Legislators / Governors  who protect illegals with Sanctuary laws will be arrested at some point, or forced to deny sanctuary.  Something to keep an eye on.

Granted, the SG ruled on the appeal for the Ninth District, who relied on a "Friend of the Court" in their decision is why the SG tossed it, not so much because they felt is was "wrong" but more a procedural problem.

Ditto, but u got reviewed fast and I didn't. Luck vs unlucky.

Doesn't make since that they are supposed to be reviewed in order of receipt and that is not what is happening.

That's what one would think.  Our AOS took a long time, and when I seen people who was behind us already having their Appointments, I sent an email, and we got an appointment date in a weeks time.  It was not in Vegas though, we had to go to the Phoenix office but got it done.  Best of luck!!!

thank you for input. i filed back in 2019. i'm so angry that this happened. uscis says i missed an interview but i never recieved it.

i am curious if i should refile it or file a motion to reopen. problem is motion to reopen is another 700 dollars and i dont know how long it takes.

and what if they dont accept their mistake? i'm worried that uscis can just say "we sent it" and i can't prove it.

If you have not done so, you should go to USPS.com and create an account, so you get a email every day that you have mail coming, a scan of all the 1st class mail.  It freaks me out when I see something "out for delivery" and it is not included in my mail. Perhaps they mailed it, and was never delivered.  I get neighbors mail on occasion,  and some times they get my mail.

Help anyone?? Is there somewhere I can go to file for his check?

If your husband has a SS#,  and you included that SS# on your 2019 taxes filed this year,  you could go to www.irs.gov and click on the upper right link, "where's my money" or something like that.  you will need your 2019 AGI,  his SS#,  his Birthdate, and his street address (no city, state), and lastly the zip code.  It will say if he is qualified for the stimulus check. if he is, and you have direct deposit, you can enter the routing and checking acct #.  It is updated only once a day, and currently for a few days, they are doing maintenance between 10pm - 1am eastern time.

Anybody have any other news or opinions on this? Do you think it would even happen or if it would have an effect on K1 fiance or spouse visas?

In light of the attack from the Invisible Enemy, as well as the need to protect the jobs of our GREAT American Citizens, I will be signing an Executive Order to temporarily suspend immigration into the United States!

I'm 67 years old, and I have never seen anything quite like this.  It sucks, but it is what it is.   All any of us can really do is to stay safe, help others when we can, and stay busy.  This WILL pass in the coming months, and things will return to "normal"......

67 too, 68 in a couple weeks.   However, I pretty much doubt it will return to "normal" early April.  I think, by the end of April, Early May, it will be either really great, or really bad.    The Covid-19 is just a smokescreen for things to come in to fruition and that's all I will say, but two things.. over 50K die in the US from the flu.  Vegas has NEVER shut down ever until today.  Trump was the very first ever non Chinese to ever enter the Forbidden City..  All for a reason....

Sorry to hear you have an inept post office.  I've had things that were sent back as "undelivered, addressee unknown.?  It's BS because I've lived in he same house for 11 years now.  They know me,.  Just lazy I guess.  Just wanted to say you are not alone.

Hi Everyone! My husband had interview on 1st August 2019, Embassy kept passport, asked for few documents. We upload on Ceac. It was going through Administrative processing for 7 months. Today Status changed from Administrative processing to Refused. Please tell me what does it means? What I do now?  No emails from Embassy. ( I’m Green Card Holder )

I take is that the "application" was refused, but not the Visa, as it was refused for some error or missing documentation, etc.  If it were "denied" that would most likely mean the end of the journey.  Just my opinion.

If you incurred significant cost and forgone opportunity in moving to the USA (e.g. job resignation etc),

I wonder if the OP paid for medical, embassy, travel costs, hotels, etc  to manila (if needed to travel twice),  plus airfare to the US, or if the husband footed the bill...  If she paid,  I guess she could ask for a refund of sorts and the plane ticket home.

I wouldn't be too worried...it's very isolated cases with specific midwives (and one that I can think of it was the widwife's spouse doing it). It's not like they're suspicious of midwives in general....just the ones where they have been found to have been committing fraud.

Midwifes are fine... however,  if there is any complications, the midwife calls up a doctor or hospital that she has affiliations with, and then calls for transportation, or a doctor has to visit the house.  Either way, things could go wrong.  Rare, but it happens.  Best of luck to the OP!

    Hi all!

So I recently entered the states and I got a job now. Getting there is not super easy by bus though so I am considering getting a used car. Any ideas/experiences on the best way to do this?

I have a bank account here and a debit card but no credit card. Of couse I don't have a credit score. I went to the bank and talked to them about a loan but the employee told me that they are probably gonna deny it. He suggested to go to a car dealer and get a loan with them. He said that they are probably going to give me a high interest one but I should take it anyway to build credit score. Any other idea?

    Thanks!

Sounds like you are start starting out from scratch.  A dealer who will finance anyone comes with a high rate, and probable double what the vehicle is worth.  Take the deal and get the very cheapest dented up vehicle you can get as long as it gets you from point A to point B.  Worry about class and impressions later when you can afford a better ride,  save as much as you can for a better vehicle.

    Hello everybody this is Rich

6 years almost with no eligibility to work , slowly watching my wife’s life ruined , all crumbling around us with our two perfect children in the center of it , what are we supposed to do?

I have no solid advice, but you seem like a caring person, and an honest one.  Your mistake I guess is your age and inexperience with immigration laws at that time.  We all were at one point in time.    One thing in advice,   Never say "I can't".. but "What can I do to make this work for us".. You will come up with the answer when you change your mindset  from the "poor me" syndrome.    I listen to radio on my headset when I work (I work at home, so I am a cool boss),  anyways, I was listening to the Mike Gallagher show, and he was advertising for "My Pillow". (Yes, I have them),, and he said that Mike Lindell, the inventor of My Pillow , at one time was a crack addict.  Turned his life around and now a multi multi millionaire.  We all struggle at times.  Be thankful for what you DO have in your life at the time, and think of how to make it better.  You can do it.

Hello, Since i Filled Paper on Dec 30 (instead of Dec 31st) I got rejection notice on January 14th with returned package to my attorney's office and he Filled again on January 16th via FedEx and then I got NOA, they returned everything with cashiers check at once.

I would assume you are lucky! The IO, for the AOS stated do NOT file even a day early, they will deny your package and keep the money with a thank you.   At any rate, when she applies for her ROC,  we can wait 24 or 48 hours, as since it takes a year to get anything done, a day or two won't much matter.

You stated that you are paying her money on a monthly basis, and she has a job, you mentioned office.  Perhaps, to protect yourself, open another checking account in your own name, and put your savings or whatever in to it, and get a bit of a nest egg saved, so if and when you and her split,  you have some back up money for support yourself for awhile.  I assume this is not a "rich" situation, so if the two of you split,  it would mostly be on "irreconcilable " basis, some call it "no fault", and she will not be hiring expensive lawyers to do an asset investigation to see if you have secret bank accounts with a few hundred bucks in it.

Hi all. I have about 6 weeks left in the U.K. before I move to the US on a K-1 visa. I’m looking forward to living life with my fiancé who I love and making new friends but lately I find myself with a lot of concerns.

I am in my thirties and I’m giving up a good job to move over, one it took me a while to get. I am leaving behind family members who disagree with my decision and think I am burning my bridges and want me to live with him for 6 months first, to see if it works out. As you know, you cannot do this on a K-1. I’ve made 6 trips to the US and he’s visited U.K. 4 times. That’s the best we can do.

I haven’t heard of any stories of k1s not working out, other than horror stories with people from less developed countries, but I’m sure there are many. If my fiancé were to marry me but then want to divorce, I’d be left with no life to return to in the U.K. and only a two year greencard, or at best a 10 year one, so I would have to leave, right? My fiancé just reasons that US laws mean I’d get a good alimony but I’d like a prenup with some kind of agreement for how he might support me if I had to return to the U.K. and start over from scratch but I’m not sure if this is how it’d work at all. I’m just so nervous. I know it sounds very unromantic but my ex husband screwed me over financially, so I’m extra cautious.

Has anyone had a similar experience? Any advice appreciated!

So, My Opinion is this:  Given your age, you are concerned about your well being financially, and that is a plus.  When my fiancee got here on her K1,  I was unaware but after a few months of marriage, she gave me $500 cash.  she had it "just in case" to help with air fare if it all fell apart.  In two weeks we will be enjoying our 2nd Anniversary!  10 visits between you two look great for immigration, however that was just "vacations" and fun for you and your Fiance. Living together "permanently" is a different deal.  Yes, you will get on each others nerves, yes you will argue, etc.  But that is a part of life as you well know.  A K1 can be brutal  for the immigrant spouse,  like 6 months with nothing to do. THAT is when things can heat up, get tense.  All people, old and young,  immigrant or citizen, needs space at times, just to breathe.   You are a bit more mature, not like some 20 year olds who "fall in love" over an on line video game.  I sympathize with your apprehensions,  and I wish you nothing but the best in your endeavors and your new life here in the US!  And once you get your EAD and AP,  you can go back and hug your old friends and family, then come back to your spouse!

If YOU earn more money, YOU may be the one who has to pay alimony! This happened to my sister. And a person can indeed be "left with nothing" after divorce, if there were no shared assets and monies were strictly kept separate. Then you would only be entitled to what you own separately.

If you really want protection, get a prenup, always file taxes as "Married filing separately."

Perfect case of "She got the gold mine and I got the shaft".. except the other way around!

I am curious because I feel like this could get confusing.

My husband is a GC holder, I am a US citizen. We both do very well for ourselves with our careers and don’t qualify for any financial need benefits.

However. This past year we had our son. He was born over 3 months premature. He spent 3 months in then NICU. My son qualified for Medicaid based off of birth weight (2 pound 9 Oz) so he has it as a secondary insurance (it’s secondary because I have good insurance through my work).

He qualifies for a year based on medical qualifications (again not financial qualifications). My husband and I do not have Medicaid just our son. Although my son only will receive this benefit for a year many other diagnoses for children are greater than a year and not financially need based. Will this count against their parents? That would seem incredibly terrible to deny a child of resources because one of their parents is a GC holder.

    Just curious?

As far as I can see, your son is not an immigrant, therefor he is not subject to public charge laws.    And I have to say I am sorry for what your son had to endure, and hope all will be well.

Hello everyone. I didn’t know what forum to put this in but wondering if anyone can help. I just got my ead and hopefully soon I’ll have my SSN .. wondering if anyone from New Jersey can give me their DMV experiences?!

i called and the girl on the phone said I might not have to sit the road test but it’ll depend on my license. What does this mean? Why wouldn’t I have to sit the road test... do you have to have your foreign license for a certain amount of time and this is how they decide if you have to sit a road test or not?

How comfortable are you to drive on the right, sitting in the left hand seat?  I would think for me, it would be weird for awhile driving in the UK or other places.

That is why we considered that route but we really just want to be together for good as soon as possible. We're not getting any younger, he'll be 56 in August, me 44 in May.

I'd reconsider the Spousal Visa.  Sure, takes 2 or 3 months longer, he can start work as soon as he finds work, (and get insured), and you avoid that wait again, for the AOS, with more anxiety waiting and a lot of dollars.

You were in an accident, and your daughter had a rare illness,  what if he were in an accident, or caught a rare illness while waiting for a CG?
