    Yes, I am the USC and my wife the Filipino Citizen, she has her 10 yr card, and already filed the N-400.  She arrived in Jan 2018 and we have been in the US all this time.  Just looking in to retiring in the Philippines in a simple rural area. 

     

  2. Hi Everyone! Been awhile!

    My filipina wife and I are approaching our 5th anniversary. We had applied for her US Citizenship.  We are talking about retiring in the Philippines, on some farm land in a year or two.  I've been researching

    all the paperwork needed for spousal immigrant Visa because I want to be ahead of the curve before (and when) with filing on time.  She says because I am a spouse I can have my name as co owner of the property.  Doesn't matter to me one way or the other.  My question is.. What is the situation if my wife passes before me?   Do I need to leave at the end of the immigrant visa?  Is there actually an expiration date for the immigrant visa?  Just want to get my ducks in a row.    Thanks for reading!

     

  3. 1/2 an hour to mail 751, just now noticed one should not highlight anything on the form,,  Now, is this JUST the I-751 form or ANYTHING

    SUBMITTED as evidence!  I made a lot of copies of things, and highlighted things to make it "easier" for USCIS.  Do I need to re do all the paperwork without highlights?

    I didn't highlight anything on the I-751

    Most, if not all,  have a hard time adjusting to things.  My wife was a K1, and the wait (both for the visa and again for her work card) were long and trying.  But we managed and just passed our 3rd anniversary!   If you want, check out meetup.com , your area should have dozens of interesting activities, gatherings, etc that you would be interested in.  My wife made a LOT of jewelry!  Now she is on to the plants and our house is full of them!  Happy wife, happy life..   As long as you both love each other you can get through anything.  This only makes you stronger!

  5. Well, time snuck up and time to file ROC.  Actually Nothing hardly changed.  Same work, same address,  same vehicles, same LLC, same banks, etc.

    We saved in folders all the stuff we submitted (and took to interview,), so pretty much just make fresh copies.  Wife's Passport expired, but she has an appointment in LA for renewal.  I guess send a copy of the expired one, and her new one will be here a year before our appointment. 😆  About the only thing we can add is pictures of us with my family and hers, and her birthday  cards from my sister to her.  Yeah, some people still mail cards.. Nice.   About all I need to do is fill out the forms, and write a check, bundle and ship.

    I don't get on here often, as we have a busy life, but I do pop in on occasion just to read the hot topics!

    So,  my wife actually did get an appointment in LA consulate!  She did get a "check your email for confirmation" but never got one.  I emailed then, and a few days later they asked for her name, BD, her email, and her appointment.  Then we didn't here anything,  A few days later they sent me a link, 78 pages of appointments for March and April.  IF you were trying to get an appointment, and got to the end, check here in this link if your name appears!  She did get an email a few hours later from their post what she needs to do.  Follow the link.

    I think SF is your closest place. It could be very difficult to get an appointment.  I am in AZ, and wife and I spent 2 days hitting refresh on their crashed system for appointments..  The consulate in LA is for SoCal, Az and SoNv.  about 1.3 million Filipinos, and the consulate only handles 1,500 passports a month.    Maybe it won't be so bad there, but SF has about 30 percent Filipinos living there.

    Hi,  I'll keep that in mind.  I think her bank is HSBC,  or something like that.  I don't concern myself with her info in the PH if I don't need to.  We also found out about having to file a notice with taxes if she has any accumulated amounts of $10,000 USD in the PH.'s   It's all have to do with things like money laundering or hiding money to avoid taxes on it, but her money has been sitting there for years as savings.

    Interest is very small.  But why does she need to submit a W-9 to her PH bank and not the IRS?  Normally a W-9 is issued FROM an Employer to someone who did work for them.  Since she did not work for the bank in the PH, I wonder why she has to submit a W-9 to the bank in PH.. I understand adding interest in our 1040. 

  11. Hi all!  Just a question.

     

    My  K1 wife of nearly 3 years got an email from one of her banks in the Philippines, and they said to comply with international laws,

    she needs to submit a W-9 or a W-8BEN  form by the end of the month.  I assume it's a check for people in the US hiding money in foreign banks.

    Her PH banks, one in PHP and one in Dollars.  She had these for a long time, long before we met.  Anyways, all of her income derived in US is from work, including payroll deductions, and a W-2.  We file jointly. 

     

    Any ideas of what needs to be done?

    my wife got her GC in March 2020 and we’re not sure if we should apply for stimulus check for her. 

    If you and her filed a joint  Federal tax forms, even without the GC, she would be elegible with her SS# .  You would have to had filed for the year 2019 jointly.  I don't know of any way to apply for it.  For us, it was automatically.

    Our green card interview has been ready to be scheduled since March of 2020 and we are just getting a bit worried.

    I'm not Michigan, but ours was a 15 month wait, and that was pre-covid!  "Ready to Schedule" is just that.  There is no date, it's just that they will proceed when they proceed.  Be it 6 months or 18 months.  All you can do is enjoy life and check off and on for changes in status.  We had Text and Emails turned on, didn't want to miss an update!

    I agree with the others on pro or con for a K1 lawyer.  I don't read any, who said their lawyer was the greatest,  but there are quite a number of lawyer horror stories.  Keep in mind also, it's normally not the lawyer who does the work, his staff puts it all together from the info and forms YOU provide.  Lost papers, missed filings, wrong date on a form.  Suddenly everyone is an Immigration expert.  We did our own.  And if you were to get married first and file spouse, the money saved over the K1 might pay a big chunk of the legal fees charged to you.

    I don't know if it will help, but keep a copy of the mailing, that it was indeed mailed to the gov, and receipt that it was at least delivered.  If you get in trouble that you are out of status, at least you have something to show you are trying.  I think if you are not stopped for anything, or questioned, you will get by until they send you your receipt.
