    Guys, a quick update.  I went to the Embassy in Bangkok for my interview this morning.  My appointment date from NVC was 11 October but after I have completed collecting my document and medical check up, I sent an email to my local Embassy asking if they could move the interview appointment forward in case they have space and I received the reply within the same day to change my appointment to 28th September (this morning).
     
    My appointment was at 8am and I arrived around 7.20am.  I went to a window for IV applicants. The lady there asked for the following:
    1) original police certificate
    2) any documents/photos to show relationship between me and my husband
    3) original birth certificate
    4) original certificate
    5) any tax document of my husband
    6)all my passports, current and old ones
     
    After the documents were reviewed, I was asked briefly about my relationship with my husband.
    1) how we met
    2) how long we talked before meeting in person (we have mutual friends on facebook so we chat for a couple weeks before I decided to meet him in person)
    3) how long have we known each other before getting married
    4) how long have we been married
    5) if I have lived anywhere outside my country more than 1 year
    6) if we have any children
     
    Then I was asked to wait for the interview with the consular. I got to meet him at around 8.45am. He said hello and returned original documents I submitted back to me and asked me to raise my right hand and swear that everything in my application is all true. Then he asked me to scan finger print and told me that my visa is approved and I should get my passport back in about 2 weeks.
     
    My CC was 23 August.

    Just called NVC and got embassy date, November 16, 2017.  SD July 25, 2017.  CC September 15, 2017. All the best to everyone.

    You should get it really soon! It's the end of the fiscal year for the USG so I know they are pushing them through as quickly as possible! I will keep my fingers crossed for you!

    Hi all!
     
    My husband just got out of his interview an hour ago. He was approved after about a 3 minute interview. He showed up 45 minutes early, waited around a bit, and then they called him up and asked him 3 questions: 
     
    1. Have you ever been arrested in the US? 
    2. When did you meet your wife?
    3. How did you meet your wife? 
     
    They said it would take about a week to print his visa so now we are back to checking the CEAC status constantly! Crossing our fingers for a speedy printing! Best of luck to everyone out there. Stay strong and patient.  You are doing great so far and are closer to the finish line than you ever have been!

    I/we did it on our own. You'll find people here will advise you that unless you have extraordinary circumstances, you're better of saving the thousands of dollars in legal fees, since most ppl here did it themselves. It's not hard, just takes research. If you hire a lawyer it's basically hiring someone to fill out your forms, since you'll still need to gather all the documents (and that's what takes time) and further many lawyers make costly mistakes. Personally I could take a mistake if I had done it myself, but I'd be thoroughly PO'ed if someone I paid did it.

    Really? Link? evidence of the same?
     
    You and others might not like the way it has panned out for her but if she did not enter with the intent of AOS , then as Boiler points out, this is an "option" as laid out by current immigration laws. None of us should therefore predujice the OP based on our own circumstances. If she broke the law then I'm sure the USCIS will deal with it...public flayings went out of fashion around 16 hundred and something but I don't have a link nor do I have evidence of the same.
     
    i think the OP got what they "needed" or as some might say "deserved"  from this thread. Maybe smart to close it off...nothing personal.

    I'm Extremely Happy how things turned out for me and my wife and how quick the process went, it only took 9 months to get her visa approved and i'm shocked that it took less time then attended. i heard the average case for CR-1 takes 12-14 Months, But we also got the Vermont  Potomac service center so it went quickly there.

    Honestly, I don't know if you would have many issues re-entering...you've already shown that you have no intention of overstaying/staying illegally/taking advantage of GC benefits by previously relinquishing your green card.  And you have proof of doing so.
     
    If you are asked "who are you visiting", be honest.  If you are asked, in a long shot case, "weren't you married before/filed before/whatever?", be honest.  
    Marriages do fall apart, people do get separated and move on with their lives.
    I'm certain people at the POE have heard it all, by now.

    From my experience (and what I know from many of my friends in similar situations) they tend to give people from central Europe the benefit of the doubt (especially Germany, Austria & Switzerland). She has substantial proof of ties. I personally even think that chances are the CBP officer isn't going to ask her so many questions to the point that they will not even find out how odd the story is (still married to US citizen but visiting US boyfriend etc.).

    Thats precisely the reasoning i used when talking to my husband this morning, the johannesburg consulate interviews very few people only on tuesdays & thursdays - it blows me away that they can't issue within a day or 2. Oh well... i guess it is, what it is.

    Wow! Your visa was issued next day - thats an efficient consulate!!  I had to go redo left hand finger prints this morning because they made a mistake... Unfortunately, the johannesburg office works half days on fridays and they are closed on monday. So, i hope to get my visa by thursday as i have my flight booked for next saturday.

    Had my interview yesterday morning. Today the status of my visa issued! 😍😍
    So happy it's finally over.

    Won't she be more upset to hear that once you apply for the spouse visa, she will have to wait about 12 - 14 months for the approval?
     
    I don't understand why not just stick with the K1 visa, especially since it sounds like you've done most of the waiting already .. (5 months, might be another 3 to 4 months and you'll be done)

    Marriage is hard. Divorce is hard.
    My husband and I rushed into things to begin with and we've been trying for the majority of our marriage to keep it together.
    Relationships aren't black and white, there are all kinds of connections and we have both decided we are better off as friends and that works for us.
    We are exhausted, we've tried everything and it's time to move on.
    Thanks for your concern though but trust me, this isn't a rash decision.  This has been coming on for years.  I'm way beyond deciding whether or not to keep things going so please don't debate me back and forth. 

    I'm happy we will remain friends and I want what is truly best for him.  I hope someone can come into his life who will love him the way he deserves and vice versa.
    I'm very thankful and excited for this next chapter in my life.

    And as a previous poster mentioned, this is a policy change not a change of law so nothing is likely to come of this. The fact of the matter is that if you're a true married couple you have nothing to worry about

    This is purely to do with adjusting status while in the country on either a vistor or student visa
