KandW reacted to ELOE in VAWA - AOS- Notice of Intent to Deny. Success!
Hi Everyone, I am posting a summary of my journey, specifically of why I received "Notice of Intent to Deny"  Even tho I was a VAWA applicant.
1- My entry status: F1 Visa, Married to us citizen, it was his idea to bring me here first as an international student and switch the status.
2- During the 2 years of marriage I was abused by my EX and he was threatening me to cancel the green card application all the time.
3- My initial I-485 based on marriage was denied because I was accused of "Willful Misrepresentation" as I didn't attend the school, My Ex didn't let me go to school.
4- I left my Ex and filed a divorce and learned about VAWA. I had strong evidence including police reports.
5- I received RFE because of the same reason ( Misrepresentation)  my lawyer sent more evidence and explained the circumstances of why I didn't attend school.
6- Within 1.5 years my VAWA was approved. Got my EAD and my lawyer filled I-485.
7- Withing 1 year I received a notice for an interview.  I attended the interview with my attorney, they couldn't find the jurisdiction letter in order to make a decision, the officer said they will try to find it.
    8- My lawyer filled FOIA.
9- After 9 Months, we received a favorable FOIA report and my lawyer submitted it to the officer.
10- After 6 month, Jan 2019 I received "NOID" because of the same reason "Fraud-  Willful Misrepresentation"  at this point, I was certain that the application will get denied and they will ask me to refile again with a waiver.
11-  Feb 28, My attorney responded the letter and explained the circumstances again, we submitted evidence that I had good intention to attend school but it wasn't up to me, my ex was controlling everything. We also submitted evidence that I attended a different school and other evidence to show I am in the process of attending grad school,  I tried to submit everything that could possibly prove that I had good intention to attend school here int he U.S.
    12- March 23, My I-485  was approved.
13- March 29, My Green Card arrived in the mail!!

My wife and step-daughter had their AOS interviews today in Baltimore.  Our appointment was at 7:30, we arrived at 7:00, and completed security and check-in by 7:30.  We waited about 20 minutes before being called.  The interview lasted just over an hour as the officer reviewed the AOS application line by line.  He asked how we met, if I met her parents, and what initially drew me to my wife.  He asked my wife questions about my children, sister, my birthday, and where we go grocery shopping (based on our checking account statement). I provided pay stubs, joint bank statements and utility bills, insurance policies, photos, and notarized letters from my father, sister, son, and daughter.

He asked my step-daughter questions - who am I / what does she call me, how old is she, what is her name, and what time do I leave for work.  Her mother was allowed to translate when needed and she responded to all the questions in English.

The officer said he "did not see any reason not to approve us," but still needed to complete one more review before making a final decision.  He then talked about the next steps . . . when the green card would arrive, when to remove conditions, apply for citizenship, etc.  He gave us two form letters (one each for my wife and step-daughter) that stated that further review was needed before making a final decision within the next 120 days.  I am assuming (hoping) he wouldn't go through the trouble of explaining what happens after receiving the green card if he wasn't going to approve the applications.

Right now (3 1/2 hours since we left the USCIS office), the status on the old website says the interview was conducted but the case requires further review.  On the new website, it still says "Interview Scheduled."  I am hoping to see "in production" soon, as the officer said they would receive their green cards in the mail within 1 week from that status change.  For me, the last 6 hours have been the most stressful of the entire K-1/AOS process!  We are so close but still have no idea how much longer we must wait.

Hey everyone, My I-485 interview was October 22 2018, went in at 1.30 pm, interviewer took my husband and I oath and than had us sit down, asked us about our names and date of birth, how we met and went over I-485 question and that was all, he said he approved my son and i green card and that we will get it in mail in 2 weeks. In all it was smooth and the interviewer was very nice and it all took 10 minutes, and he explained how to apply for 10 year green card and other formalities. Thank God for this day, and thank you all for the support. Good luck to everyone else. We filed on July 2018 and did biometrics on August 2018, got interview letter on September 2018, interview October 2018. still no AP or EAD!!

28th Sept - Letter was sent from uscis requesting further info
5th Oct - Recieved letter requesting proof
8th Oct - Sent fax to uscis
15th Oct - EAD Online status changed to ‘Name was updated’
15th Oct - EAD Online status changed to ‘Card is being produced’
15th Oct - I-131 Online status changed to ‘Name was updated’
16th Oct - EAD online status changed to ‘case was approved’
16th Oct - I-131 online status changed to ‘case was approved’
16t Oct - AOS online status changed to ‘Case is ready to be scheduled for an interview’

Not sure exactly how long I’ll have to wait for my EAD card, but read that it can vary from 3x working days to up to about 10 before it’s in hand.

I know that I’ll have a relatively long wait for my interview, but given that I also recieved an RFE for my AOS, it’s nice to know everything is OK so far.

Also contact your congressman. I had to go into the office, as the person who dealt with immigration matters had my email sitting in his inbox.
When I went to the office, he had me sign a privacy release form and sent my offer letter. I am unsure if this also helped, but many others have also done this.

I requested an expedite on the 26th September, and yesterday my file changed to card being produced. My start date is Monday coming so have left it up to my potential employer as of what they wish to do.

    Good luck.

Hello all! I'm happy to say that my husband and I went to his AOS interview yesterday, 10/11/2018 and we were APPROVED. The interview was very laid back. The officer was very courteous. The interview started with small talk about the weather. He then asked us how we met, how we knew when we wanted to get married, and when and where we first met in person. Then he asked for evidence that we lived together. We provided joint bank account docs with our names on it, a copy of our lease, doc showing he was the beneficiary of my life insurance, work doc showing that he was on my med and dental insurance, as well as copies of his med insurance and rx cards. We also provided flight receipts and hotel reservations for our honeymoon next month, which he accepted.

He said there would be a 90% chance he would approve our case that day, and that he would just have double check the docs we gave. We were kind of confused when we left because we weren't sure if approval was a sure thing, like he'd either do it that day or the next day, or if he wouldn't do it all. About 2 hours after our interview, we got an email from USCIS saying a new card is being produced for his I-485.

I'm happy to being done with part of the journey. I will enjoy our break from USCIS, then we will apply for ROC.

We were approved for conditional Green card before we received EAD or AP.  which took 4 months for us, but each location is different, we were lucky to live in a state that processes quickly.  Looking at VJ it looks like EAD is taking about 145 days currently.    AOS for nation is averaging 310 Days and for Florida it depends on your local office and the last Hurricane may slow down processes fro some locations.  https://www.visajourney.com/timeline/aosstats.php

I just got an update today that my card is in production!!

Took exactly a month (put in the request on Sept 10th). Asking the Congressman did not help, as they told me that my application for expedite was rejected. Nevertheless, super excited that my card is here. I can start work at my new company!

WOAH!! Our Case Status just updated to "Card in Production"!!! We didn't receive any other updates since they sent the e-mail requesting evidence. We faxed on 6/27, and got the update today (14 days)!! It's like magic! Thank you for all the help on this thread! We seriously couldn't have made it without you all

After I called USCIS to expedite, it took 5 days to show up on my case status saying they sent me a letter. I received the letter about 5 days after that saying I needed to fax documents. I did the same day and from that day it took 3.5 weeks to get a decision.

So from the day I called to request to the day my new card is being produced was 1 month & 2 days! Now I have to wait about 10 business days until I receive my card in the mail.
