Khallaf got a reaction from Crazy Cat in Proof of bonifide marriage
I am sure they do, but I was simply making a point that people have made mistakes when filing taxes and they have 3 years to amend the return here in VJ we have seen a number of people be told they can file single because there is no way to add their spouse, when we all know that isn't the case.
I was not advocating for it but explaining that it can and has happened, and how they fix it.
not to mention LilyJohansen jumped down my throat telling me that it isn't in anyway proof or evidence when doing a spouse visa.

Khallaf reacted to Roel in After entering US
I wonder how many more times we will see people post this question. Just like.. no one research K1 or AOS before applying for it.
You can only travel with AP or green card. AP can take anywhere up to 6 months to be approved. Cant leave a country without that in hand.

I would also get him updated on your work profile as emergency contact, updated your life insurance beneficiary if you have one from your job.
I would also recommend having a living will drawn up, the more evidence you provide either at USCIS, or the NVC stage is good.
99.9% of all cases are decided before the interview, and they will review all evidence submitted.

I have been on my mother's lease despite not being financially responsible solely for the fact of telling the landlord who is living there, so it is not always a display of being financially responsible. It is also TAX FRAUD and a punishable crime which can lead to a $250,000 fine and 3 years in prison to file as single if you are legally married, even if your spouse is foreign, so no it is not proof of a relationship, it is proof that you aren't committing tax fraud.

Khallaf got a reaction from kris&me in Proof of bonifide marriage
I had my husband name added to all utilities, and the apartment lease, he signed the lease from his country, this can be used in evidence to show ongoing marriage, it doesn't make it smell fishy.
I was not talking about send in the tax information for the purpose of USCIS step but for NVC.
also filing joint married on taxes does hold weight and is considered evidence of marriage, granted isn't needed till NVC and for review at embassy.

did your joint sponsor meet the income needed for the household size?
I know that they are now requiring transcripts to be turned in with ever CR1/IR1 case.
I would recommend either yourself or the petitioner send out an email to the embassy asking them specifically what they need or resubmit the joint sponsor information again with transcripts if that wasn't done before.

Khallaf got a reaction from geowrian in Processing Times
if you are looking at the estimated time on VJ this happens, if someone in June got approved, it throws the time forward, if someone back from may finally got approved it will throw the time back.
just be patient I am sure your approval is coming.

Khallaf reacted to Jho369 in Vietnamese Wife wants to Visit US
My source is my Mom’s friend in VN. She failed the 2nd interview because they stayed longer than said. They didn’t break the rules, they just didn’t leave and stayed until their visa expired. They couldn’t interview again for another 4 years. But this was 5 years ago. And if you dontknow the special treatment, let’s just not talk about it

From what I heard, once you fail the the tourist visa, it’ll be another 4 years before you can be interviewed again, without special treatments. Your best bet, in my opinion is to just file for marriage. Just that you have to spend 7 months in the US instead? Or you can apply for tourist visa and go on vacation to nearby countries, just to show that you intend to come back. My aunt, she has to go to the philipines, now canada, and hopefully US next. She just couldn’t get a tourist visa to US first try. Hope this help

Khallaf got a reaction from Roel in K1 visa military expedite
if he gets orders to go back to USA, there is no expedite there either, unless onces back in the USA, he gets another military orders to deploy again then he might be able to get an expedite if it hasn't finished by then.

Khallaf got a reaction from SmittleQuestions in ESTA to CR1 Quick Question.
as long as the CR1 visa is in her passport she will be using that to enter not ESTA, so she can travel anytime before the visa expires.

Sounds like you may have gotten the generic message whenever there's a computer glitch on that website.
I would call and request to speak to a L2 immigration officer who can see the actual details of your case and ask them about your case status (don't just speak to the regular customer service person who answers the phone---ask to be transferred to a L2).

Khallaf got a reaction from Mayi & MiMi in Receiving maternity salary after moving to the US on K1
you can't work on a K1 visa in USA until after you get authorization to work, I am sure your job will not be too thrilled knowing that you moved to USA and want to still take benefit from them when you have no intention to continue working for them.
I do not believe even if they are also based in the USA, since you have no right to work in USA till after you get your employment based card.
they do not have to keep your position for you if you leave the country on a perm basis.
it goes with the old phrase you want the cake and eat it to.
its unfortunate but I don't think your government law allows you to immigrant to another country keep your job just because your having a baby, and remain employed as you have no intentions to return to such job.
furthermore, I would see this becoming a moral issue. if not fraud. but then again I don't know the laws of your country either.
I know here in the USA if this was given a year off paid because your having a baby, sure but the expectations are that you will return to the job, not willing know you wont but also dont give resignation so you can get the benefit.
-
Khallaf got a reaction from Lemonslice in Receiving maternity salary after moving to the US on K1
I would have to agree with other post, if you are leaving to move to another country you are thus leaving your job, so you would not be able to get those benefits as you will no longer be employed by them

Khallaf got a reaction from Nikatnite92 in Fiancé just did interview for k-1 in London. Got a blue paper. Help?
if they kept the passport it is a good sign they need the medical only to process the visa, just need to be patient.
