Non-issue........As long as she has a valid advance parole document, there is no reason to worry.

if you have not had income the entire year and nothing to report, you need to submit a letter to the reason you have not filed an income tax return.

if you have your green card in hand you can go in and updated the SS number so that you get a card that does not say for work only on it.

good luck on that, you will likely lose your deposit on anything you paid and your guests will be going with no party to attend. If you do go, and your don't have to AP/EAD and your wife leaves she will need to stay there AOS will be abandoned and you will have to pay a whole other set of fees and wait 12-14 months to get her back to USA.

should never plan anything until you have done ALL the research.

it would not reflect negativity at all they just need to provide proof that they were on a non immigrant visa for the entire duration of time that is open and required to sign up.

I am sorry the state senator can do nothing now, all you can do is turn in the paper that was asked for and wait, it takes about 60-90 days after new forms are asked for after that time you can send an email to the embassy an inquire about the status.

    Thank you all greatly!

Really happy to hear, that I do not need to go to the states and leave my family in order for them to be able to obtain a Visa. I have a few months until I finish school. I will go ahead and move on with the CR1 as it makes the most sense to be honest.

    Thank you all very much!

you do not need to be in the USA to file for CR1, many have done it from overseas as long as you can prove the domicile requirement or the intention to re-establish.

you will have to show proof of domicile as part of the NVC process, many have used parents, address, started a bank account using that address or have a voters registration for that address, maybe a car loan or lease, anything that proves you have mail going to that address is proof of domicile.

these days the K1 is taking almost as long as the CR1 and the CR1 is a less expensive route, you can mail it from overseas and finish school while its in process.
