Paskaval got a reaction from OldUser in LPR with valid GC returning to the US after styaying abroad three years
Hello everyone,
I'm French, married to a US citizen, got a K1 visa in 2018, got married quicly and got a conditional 2 year GC a few months later, applied for removal condition in 2021 and got my 10 year GC in may 2024 without interview, but nobody knows (I was in France then).
I'm still married but the problem is that we finally couldn't maintain our US residence and moved to France in 2021.
We have to go to the US next week for family reasons but just for a short visit (20 days), absolutely not to move back to the US, we have our return ticket.
I already traveled back and forth from US to France with my first GC, at the arrival the only simple question they asked was "how long have you been outside the US ?", it was 2 weeks, 4 months... then they just stamped my passport and "welcome back" without checking anything more.
When I will be at the CPB desk shall I try to lie if they ask the same question (I`m very very reluctant) ?
Is it easy for them to check my past trips (I don't know what they have on their screen).
Otherwise I`m ready to volonteerly file the i-407 form, no problem, but will they let me in for a limited time signing the i-193 (paying fee) or paroled ?
I worry they can send me back immediately.
Any experience of that ?

Paskaval got a reaction from MakingWaves72 in Yes, you can visit!
Here is my experience : From october 2016 to april 2018 I went 7 times to the US (with ESTA), 4 times since appliance for K1 visa. My longest journey lasted 2 months, and I never had any problem to enter the US, always stayed less than one minute with the CPB officer.
Next trip will be with my K1 visa.

Yes, my 2 months trip was while waiting for NOA2

Paskaval reacted to Michael and Ganna in fraud suspicion ?
One thing interesting I read on this thread is that the government doesn't know you filed for a visa until it gets to the NVC stage....I have first hand information on this. We traveled back and forth while in CR-1 process....At POE we were asked if we filed for a spousal visa and If they could scan our NOA1.....we had no problems and had brought all of our paperwork just incase

I'm French and I married a US girl, depending on what your fiancée does in the US maybe she can move to France to be with you.
My wife's French spouse visa was issued in about 2 weeks. Although we got married in France so the paperwork and processing times must be different for a US marriage.
Just an idea, it may not be the best solution, life in France has its challenges for Americans too.

This is correct. I can be hard for ESTA eligible VWP citizens to obtain a visitors visa, because it shows intent to stay in the US for a long time.
