  1. Yea I see what you mean, but that’s not an option for us. We don’t wanna pursue this option.
  2. Yes they never abused it. Everytime they visit stay max 45 days. I just don’t immigration to “void” their process cuz they are visiting before they get a case approval.

  4. Yup. They will go back to Brazil in 2 weeks. We will go via consular route. What worries me the most is my second question, since my wife is pregnant and her parents will want to comeback to the us once our child is born. We want to make sure if they don’t have their green card until then, they can continue to visit on their tourist visa without impacting anything with the green card process.
  5. Hello everyone! I hope this message finds everyone well. Little background info: My wife and I (both US citizens) are looking to file for green card for her parents. They currently have tourist visas and are here in the US visiting us for a month and their current tourist visas are good for another 3 plus years. Our question is: 1) Should i wait for them to return to Brasil then file the form I-130? 2) Once i file for their Green card, Can tell travel back and forth to the USA with their tourist visa without impaction our petition for their green card? I seen somewhere that if one is currently waiting for one's petition to be approved, they cant leave their country before they have a decision on their case because it would be considered "abandoning the case"...... (this is the main/most important question for us) 3) Do i file a form i-130 for each of her parents or can i do them all together? Or which is better/safer? Thank you for your time! Jonathas & Laila
