desert_fox got a reaction from Ilovemyfamily17 in is meeting for only 5 or 6 days an issue for K1?
At the initial petition level, the adjudicators at the USCIS service centers are not able to judge the quality of a relationship. Their only concern for petition approval is that you have met, and it is documented that you have met to their satisfaction; and that you have met the other points of the law, such as the petitioner being a US Citizen, etc. Phones calls, chat, etc. will do nothing to satisfy the requirements of the law in this initial process.
Now when the approved petition gets into the hands of the State Dept and sent to the US Consuate, these people are in a better postition the judge the quality of a relationship, and the fact that you havent spent much time toggether may or may not be an issue for them. Depends on the country, cultural differences, language differences, etc. They can judge better thru the interview, etc.
So for the inital petition, it will not be an issue.

Why not put some moves on the mother??? This would give you more time to evaluate your options.

desert_fox got a reaction from Nagishkaw in How To Get Divorce in The USA When Both Parties Lives Abroad
You cannot file for divorce in the US as the court will not accept your filing. You have to actually live within the jurisdiction of the court which varies from state to state, but probably like six months.,
You can file where you live now, if the court will accept jurisdiction, which should not be a problem (only is it worth 10,000 dollars??), or you can move back to the US, establish residency in any jurisdiction, and file there. The court needs to contact him officially thru service of process. It would be easier for hime to agree and accept the supenoa thru the mail, sign it and return it to the court. If he is not agreeable, then you would have to find some other manner to serve him, (usually thru publication in the local newspaper at his loast known US address,

I'm tired of being told that Islam is a "Religion of Peace," when every day I can read dozens of stories of Muslim men killing their sisters, wives and daughters for their family "honor"; of Muslims rioting over some slight offense; of Muslims murdering Christian and Jews because they aren't "believers"; of Muslims burning schools for girls; of Muslims stoning teenage rape victims to death for "adultery"; of Muslims mutilating the genitals of little girls; all in the name of Allah, because the Qur'an and Shari'a law tells them to.

    Hi all
I never use this forums becuause Im not in the visa process anymore, but after reading this, I just shake my head in disbelief.
I have no idea whos this arrogant, rude person gets her visa information from, but I hope it's not from some 1-800 line at the USCIS that are answered by contractors who have no legal expertise, and just read canned responses from boile plater after looking up in some index.
She seems to be in denial, and think she knows it all. She would be better off spending a 100 bucks and talk for an hour to an IMMIGRATION attorney whos knows this stuff and maybe reality will sink in.
She also needs to check with the laws of her own state to see if Proxy marriages are even legal where she lives, and the USCIS will know.
The requirement for getting a I-130 petiton approved is minimal, by furnishing minimal information that any normal married couple would have. But an approval of an I-130 will only get the beneficiary an invitation to apply for a visa as he/she meets the minimum legal requirement to apply for a visa and have an interview to convince some couselor officer that indeed that this is a valid relationship, that is verified with photos and evidence that you have spent enough time together to convince the CO that a visa should be issued. But in this case, the person who filed this I-130 apparently without even reading the instrucftions and submitting an unapproveable petition because she knows more than all of the collective experience by members of these forums. She is not even eligible for a hardship waiver of not meeting in person (I think only for a K-1)unless she is tied to a dialysis machine. This petition will not even make it out of the USCIS because, by law, it is clearly not approveable.
But, let her spend, appeal, waiver until she either runs out of funds or begins to get the message.
You guys should stop trying to be reasonable to her or trying to explain the reality of it all to her, as she obviously knows more that all of collective knowledge and expeience that we have together.
