    You just need the eTA (if you are going US to CAN or PHL to CAN) and that is it.   It is that easy.

    If you have been flagged for the sputum test (I was too, came back negative) go ahead and proceed with it as you have already paid for it. If negative that's good. If this was the cause of the misunderstanding and break down of the relationship, it might still be saved. Most of those who undergo the sputum test turn out to be negative. 
     
    If the result is positive, then proceed with the treatment. If you are sick you will need treatment. Your priority at this point is your health and well being. If your fiance cannot even stick with you through this trying period (and tb is nothing compared to say cancer), then consider it bullet dodged. There's a reason marital vows include through sickness and in health.

    I just want to highlight that I did not open this topic to discuss about my insurance or financial status. I think many of you don't know how European laws work nowadays, so let me be the one being concerned whether is legal to benefit the maternity leave while being a resident of another country- which btw it is, with the condition of not getting another job in the meanwhile. There are a lot of health insurance, and I do not mean the travel ones here, that cover all kind of services outside the country where they were signed, with some restrictions of course, but still better than nothing.
     
    Once again thank you all for your replies, it pretty much helped us to make a decision. Hope it will turn out well and in time .

    TO said that the insurance is her least concern, why do people keep telling her it's not? There are some private European insurances that cover healthcare in the US, they are costly but still cheaper then US insurances.
    I know this is a different case but I wasn't even aloud to terminate my Dutch health insurance while I was on an F-1 visa.  And if I was pregnant they would have covered 100% of the cost, I only had to pay an extra $ 5 a month for world coverage.
    Bottom line is we don't have the information the TO has, to tell her whether her insurance is going to cover or not. That's something she has to figure out with her insurance company.
     
    As for maternity leave, I don't know about the rest of Europe but even if you migrate to another country you still can claim certain social security benefits. That's not based on whether you are immigrating or not, it's based on your previous work history. And yes this is perfectly legal.
     
    TO, I have no advice about which route to take, but hopefully you can find a way to this legally and in a short period of time. Being separated from the one you love sucks. I don't know which one would be faster the K-1 or the CR-1 but it seems those are the best options.

    Ya it was fast. No letter with the NVC/Invoice ID (I called today with the WAC number and was able to get the NVC via telephone) but did get a hard copy in the mail about the NO2 approval.

    After much yelling, calling, emailing, and with absolutely no assistance from our district congressman (that I'm aware of at least), we are finally approved. I received an email this morning saying an approval notice was mailed June 1. The tracker is still showing received. Unfortunately, it comes too late to keep up from having to change all of our wedding plans, but that's an issue we're willing to work with, just knowing we're done with the process.
     
    Here's hoping and praying everyone else still waiting from early December will see the end of this in the next week or two. Thank you to everyone who ran scans, posted updates, and offered advice!

    Money transfers don't show evidence of a relationship. People trying to commit immigration fraud can do it just as easily as those in a legitimate relationship. Financial commingling does (being on joint accounts, having bills together, etc.), but one-way money transfers don't.
     
    The affidavit is for the public charge concern, not anything to do with fraud. I think you're looking at this only in the positive case - of course a real fiance/spouse would want to help out financially (and that's fine). But there's also the negative test that the COs will look for - a scammer using a USC. Try looking at it from both angles as the COs are there not only to issue the visa, but to protect the petitioner. One-way payments don't prove a relationship.
     
    But yeah, just providing some support isn't an issue. But, for instance, sending 3x the average local salary every month may raise some concerns that it's not actually for just the purposes stated in the interview (I'm assuming the payments were mentioned in the interview because requesting receipts is not the norm). It's all about the details and context. If things check out, it should be fine.

    Got my approval! PPHHEEEWWWW! Biggest relief of my life! Received the letter on 20th, but was approved on the 12th. My USCIS tracker never changed!! You just have to wait for hard copy in mail, or call and ask for tier 2 officer to possibly get any real information.
    I have met the most sincere people on this site, and heard the most profound stories of Love. All the people on this site are deserving of quicker atention, but it comes eventually, and beelive me the feeling is amazing, I got my first god nights sleep in ages!! Thank you DBMATHIS, GEO, AKES and everyone that has helped make this process easier, and Good Luck to all that are still waiting, it will happen!!

    You know that the nbi gets a hit alot because of the purpose of travel abroad. Usually they want to double check people who are leaving the country. 
     
    You could have easily gotten it earlier, but just wanted to prepare you. I know my fiance had to wait like 3 weeks for her NBI and she definitely has no record.

    Please guys, remember that Immigration is not a game and partners that you help come to the U.S are not acquisitions you can return when things don't work out. 
     I understand if your ex ''used you'' to come to the U.S and you have proof you would want to do something about it,  and you can contact USCIS and report him. which I believe might be tricky since he fooled you and the process and it seemed bona fide to you and to them. What evidence do you have to support this claim?  I also get that you're hurt and angry, but besides that, moving on is your best course of action. Good luck!

    OMG you guys!!!!!  without any notifications or case updates... we received our NOA2 today in the mail! Dated that May 5th we got approved! 
    we got approveeeed!!!!!!!!! after a long 140 Days of waiting.. finally..  to the next step now and hope it won't be long,,

    If you keep things moving you can complete the visa interview in under 2 weeks (if you can get an interview date that quick).  Actual issuing of the visa will take longer, some times a couple weeks, sometimes less, and sometimes more.  No one can predict your situation.

    This is somewhat incorrect. First off they already have the case number. Second, they might already have the NBI and cenomar and everything.
    Third, you don't need packet 3! You just look it up online! You bring all those certificates in you don't mail them anywhere. Once you have that case number just schedule your interview and do the medical. (which you already have) 
     
    Assuming it all goes well, the visa could be issued in a couple weeks. I would definitely advise against buying a ticket until you have that visa in hand though. 
     
    You CANNOT do the medical during the time of the month. It's on Saint lukes page.

    I can see red flags or big possibility of fraud marriage in this case if I'm the USCIS. 
     
    And good Lord... As an LPR who just got her conditional GC after 7 months of good faith marriage, it is extremely hard to stay neutral and not judging in this case..

    I am late seeing this thread and I must say I have never given out so many reputation points in one thread in my VJ existence. 
     
    OP, to put it in simple terms.... It looks bad. Even if your marriage was sincere, what you are asking/planning to do just looks bad. This is the biggest hurdle you will have to overcome, proving to an immigration officer that you didn't use the USC for a greencard so that you can bring over your lover. This is why immigration has put in safe guards like the 5 year rule after you immediately divorce a USC.
     
    If you truly love your girlfriend back home, you can always divorce your husband and continue your relationship with her back in your home country. Otherwise, it will be a long time before she is here.
