My wife had her biometrics appointment today. It was a very smooth and fast process. We arrived about twenty minutes early and proceeded through the airport-like security. The letter said not to bring cell phones or electronics, which we didn't, but I don't think it would have been an issue otherwise. We were directed to a room where we showed my wife's passport and the biometrics letter. The latter got stamped and then my wife filled out a short form. That form was turned back in and she was given a wait number. After she was called, the immigration official reviewed her form, took her picture, her fingerprints and that was that. It took maybe twenty minutes tops.
So from our experience, all you need to bring is your passport and the biometrics letter itself and it's nothing to worry about. Now the real wait begins....
As a total aside, I have to mention that there was a bit of an odd experience for my wife. The form asks that you indicate your race. My wife is from Colombia and there, she is considered "morena" or brown and proudly so. However, there is no "brown" option, but rather the two closest options were "white/hispanic" or "black". She circled hispanic without circling white since she is obviously not white. However, when the official who was taking her finger prints looked at that, she told her, "no you're white." My wife was a bit taken a back and said that she wasn't, but given the lack of another option, she acquiesced. I know this affects absolutely nothing in terms of her immigration, but I'm curious if others here will have or have had similar experiences.
Best of wishes to all!

Lucky you! I'm still waiting to hear from them ? When did your checks get cashed ?
Checks were cashed on the 9th, the day after the text notifications.
I remember seeing in the Janauary 2017 thread that some also had that happen where there checks got cashed and then they got there notification later. Did you fill out the G-1145 and put it after the checks?

Got the I-797 in the mail yesterday. Sadly it was a bit wet due to all the rain, but it's still legible. Now waiting for the Biometrics date.
Poubon, I got four emails and five texts (one was repeated) over the course of half an hour. And in the mail, there were four i-797C for each form you mentioned. I've heard of other people getting the other texts later. I wouldn't worry. Make sure everything shows up in the mail first.
Glad to here that everyone else is coming along too.

Congrats, thats good news!
Well we sent our Feb 2 and got there last Feb 6 just this Monday. We haven't got any txt or email notification yet.
Hopefully we get something today or tomorrow. Btw, how did you know ur cheqyue was en cashed?
I knew the checks got cashed once that $1760 that had been so hard worked for and saved up was gone out of the bank.
No worries, everything will come through in it's due time. I typically worry like crazy over these things, but I figured that the best thing to do is simply trust that everything was filled out, checked, and re-checked three more times and now that it's in, just let it run it's course.

Checks just got cashed. (2/9/17).

Sent AOS packet in the mail on 1/30/17.
Arrived 2/1/17
Last night got 5 (?) text messages from USCIS confirming receipt and four emails confirming the same.
Checks have not been cashed. Probably some time today.
Best of luck to all! The wait begins.

I can't find any January 2017 Filers thread on this forum (AOS from Work, Student and Tourist Visas), but if there is, my apologies and please merge.
Application sent 1/30/2017 for AOS for wife for B1/B2 tourist visa. Should arrive on 2/1/17.

Here's yet another ACA/Obamacare tax penalty question:
My wife, two kids and myself came to the states in September to visit my parents. However, after a month we realized we needed to stay to help them out in many different ways. My wife entered on a B1/B2 and next week we're sending in her AOS packet. We all lived outside of the country from January till September so I know we qualify for exemption C. My kids did get on Medicaid/CHIP in December so they are covered. I started working in November and won't have coverage till February of this year so I know that I will face a penalty (either 1 month or 3 months). However, my big question is if my wife would face a penalty since she was here under a tourist visa and has not yet applied for AOS? If she is exempt, what exemption would she qualify for? She has an ITIN and we have jointly filed for the past three years and have always used exemption C for being out of country. But I'm not so sure this time. Anybody had experience with this before?

Hey all,
I've included my three cover letters (General, for I-130 and for I-485). I've explained that we'll be performing our medical exam at a later date (we need to travel pretty far to get that done and I don't know when I can get some time off of work and I'm ready to get this thing in the mail) but I didn't give any details. Is that a problem? We have no lease since we're living with my folks at the time being, but I'm hoping this initial evidence will be sufficient. We've been married for over five years now. Also, I included our Venezuelan marriage certificate (copy) and the Colombian marriage certificate since our marriage was registered in Colombia just to be thorough.
Let me know what you think!

Where did you find the USCIS tips?
-
I just read the instructions of the I-130 from the USCIS website and it says
Quote1. A spouse, submit the following documentation
A. A copy of the marriage certificate
So I take that as meaning just a copy of the certified copy should be sufficient. Has anyone had any experience sending just a copy?
-
My wife and I were married in Venezuela in 2011. We are currently filling for our AOS from her B2 visitor visa. We have one (1) certified copy of our marriage certificate from Venezuela and we can't go back there anytime soon nor is there anyway to get one sent to us. I know on the instructions here it says to send a certified copy with the I-130 packet and and one certified copy with the I-485. Since we have only one certified copy which I'm very protective of, would it be possible to send copies of the certified copy with those packages and bring the certified copy to the interview? Would I need to explain this in the packages in order to avoid an RFE?

After sending in the I-130 and I-485 packet, does USCIS give you any sort of receipt or proof of payment document? I'm wondering because I possibly might be able to have some of the cost reimbursed, but I would need some sort of receipt/invoice or something of the sort showing the amount, the date and what it was for.
-
I wish I could but I won't have enough saved up for the fees by then, nor will we have the medical done. Still, thanks for the recommendation.
-
thank you!
forgot to mention this is aos from b2, and my children and myself are USC, but I don't think this affects anything here.
-
We are a family of four. I just started a job on the 10th of November were I earn $32.240 annually which is just a bit more than the 125% poverty threshold ($30,375) for our family size.
My income on my tax returns for the past three years have been significantly less (like half) of my current income since I was working overseas. Do they only consider current income, or are they going to look at past income as well? Would a sponsor be necessary in this case? I'm going to include all pay stubs and a letter from the employer, but I'm concerned that I haven't been working at this place long enough to show a decent work history to USCIS. (I'll be submitting the application in mid to late January)
What do you think?
-
Great, thank you!
What about on the i 693 where it asks about the interpreter. my wife doesn't speak english so but I speakboth english and spanish. Would I put my info down as the interpreter?
-
thanks. I'll just leave it with N/A.
-
I realize I probably put a lousy title on this question, but does anyone have an answer? Is a preparer only a lawer or is it the petetioner filling out forms for the immigrant?
-
I (USC) am filling out the forms for my wife (B2 visitor now starting AOS process) using the examples and advice on this site with a lawyer. Does that make me the preparer? Do I need to fill out that little section at the end of most of the forms or is that only used by a lawyer?
For example, on the I-765, it seems like I could be the preparer with no issues, but on the I-131, it talks about submitting a form G-28.
Also on the I-693, I filled out the part as the interpreter since my wife doesn't speak english.
What have you done on your forms and how did it go?

Just got an RFE in the mail. They want our 2016 tax return...sigh. Also said my income wasn't enough for the 125% poverty level and that I need to demonstrate the difference via assets or with a sponsor. My income is more however, and I documented that with pay stubs and a letter from my employer even though my past three year's incomes were below the poverty level....sigh. Interestingly enough the rfe was not in reference to the medical even though I haven't sent it in yet. Now I'm not sure what to do....aside from doing my 2016 taxes.
