That maybe the rule but he cheated and that is a normal part albeit crummy part of marriage. The USCIS will not budge on this. Believe me. So they are going to deny ROC because some guy or girl cheats. That rule you mention is an add on rule/provision that is used when another scenario occurs and they want to add more fuel to the fire. Think about it, how many guys or girls, email or call the USCIS daily sayingj this exact thing, "Hey I met this guy and we got married, AOSd and then he got his 2 yr gc and cheated on me? This is an abomination and I want him/her denied ROC and they must go home" Believe me they get A TON! They will do nothing im sure!

ALSO OP is from a no fault state so the part about the USCIS finding out about adultery is irrelevant. I can cheat on my wife or husband with 10 people and then we can claim irreconcilable differences.

I love how people think getting a letter notarized makes it legal. All a notarization does is provide proof that "A" person signed said document. LOL

Not really sure why the I-864 is of concern to the OP. He works and doesn't appear to have a penchant for seeking out handouts. If you were to tell us that he laid on the couch, watching tv all day, then I'd be concerned.

This is NOT true! You just need the certified marriage certificate which shows the name change at the bottom. Well that's at least where it is in California marriage certificates. I had an immigration consultant look over my AOS package and I was told this was acceptable and normal. No other proof was necessary or required.

I hope my AOS or at the very least EAD gets approved soon.

I front loaded everything, checked everything 10 times and had an immigration consultant review my AOS package prior to me submitting it , so I'm fairly confident I will avoid an RFE

    My time line is:
Applied for AOS, EAD and AP

    Filed - 6/22/17
    NOA - 6/30/17
    Bio Metrics - 7/18/17

Based off what I see on this thread I should be close, say within 3 to 5 weeks to at least adjudication of my wifes EAD however it seems at least one person has gotten their GC or will shortly.

I have read that its actually in your favor to get an interview as it expedites or pushes your AOS farther and faster versus no interview at all. So maybe we will get an interview soon.... Lets hope!

jakartausa got a reaction from mallafri76 in is it legal to ask for Alien registration number in job application?
Regarding your second part- The rules may say that however given that you (they) were just offered a job I would suggest handing over any documents you have to establish your identity and employ ability. If its a credible employer no harm will come from revealing your GC (A#), SSN and drivers license etc. I would not suggest under any circumstances giving your new employer any resistance or showing any avoidance in handing over these documents. Just a word to the wise.

Actually it is a very specific answer. I was only referring to the OP. And I concede I should have added the caveat that it is useless in the eyes of employers. It isn't useless to get into grad school or qualify for taking some license exams.

The OP is from Indonesia, as is my wife. Ask any Indonesian here in the US if their Indonesian degree helped them get a job, and the vast majority will probably laugh before saying no.

I can see where both of you had a completely different vision about how it will be once she was here; you about the relationship and she about a life in America.
Hopefully the ESL  and business classes will help her feel less isolated and adjust to her new life.
Some people, including me, use exercise ( gym, running etc) to feel mentally better.
It doesn't work that way for everyone, but you know her and it might be something that helps her fight lethargy and depression.

No she hasn't. Most Tourist visas for Indonesians are denied. The only way to get a tourist visa is to be rich. Aside from that an Indonesian can get a student visa, and of course K1 and Spousal visa far far easier than tourist.

I think my wife's biggest mistake was assuming that we as Americans are more free. I use the word free to describe being free from regulations and the law. I think the point where my wife became disenchanted with being here was when she quickly found out that her home country was more free from imposing regulations and legal involvement then the USA is. The USA is super litigious, far more than likely any other country on the planet, plus being in California (a state with probably the most complex laws on the books) doesn't help either.

In Indonesia for example, travel restrictions are the most noticeable restrictions that are placed on citizens, however aside from that an Indonesian citizen is free to do many things that we as Americans find far more difficult. For example starting a business selling food. Here in the USA, sure you can sell food maybe on a small scale and not get caught by the health dept but exceed beyond that and you will be fined and shut down by the health dept/police etc. In Indonesia if you want to start a business takes no regulation/'permit at all if you want to sell out of your home etc. (I realize im omitting some regulation here so do not butcher me. Im just making a point vs writing out a huge text on Indo vs US business practices)

Finally someone who understands my point. Again for the 3rd time in this thread, IM NOT SENDING HER HOME and I know it takes more than 2 months to adjust to being here. I was just looking for advice given what I'm experiencing. My wife and I get along however she assumed it would be easy to live here given what she had pictured in her mind and saw in movies or tv. We USCs and those newly arrived here know too well that it is NOT unicorns and rainbows here in the USA! I think this subject has been debated to death here. Mod if you will could you please close this thread. Thanks

Please note however that the I864 is rarely enforced and if enforced is only done so if the person has no means of supporting themselves. If you both are working, are self sufficient and either of you want a divorce the I864 isnt a way to squeeze even more money out of you. The only legal squeezing will be via the divorce settlement NOT via the I864.

even if they file after the i94 expires they do not need the i130 if they were at least married before it expired. the only times it is needed if they entered on a k1 was if they did not get married in 90 days.

In our case we received the packet 3 email on the same day of the email confirming the beneficiary's current contact details.
Based on our experience the immigration unit at the US Embassy Jakarta never take more than 24 hours to respond your email. Often they respond your email within the hour if you email them between Mon - Fri.
    Good luck.
