I actually called this morning about this. The lady I spoke with said that I could send 6 moths of pay stubs and I should be fine, BUT they could send a request for a co-sponsor if they deem it necessary. So I don't know exactly what to do. But that's what I was told. When I asked about a co-sponsor she said not to worry and wait untill the request one. Go figure! Good luck! Let me know what you find out.

I know I asked this on my other post, but thought it might get answered this way better!
I am filing for 2004 taxes, I heard about a letter I can send to show that I am in the process of this. Can anyone help me with this or direct me in the right direction so I can get the right letter and mail all my stuff out?!

I Was told that I should change my name with SS before I apply. I know I did that right after we married so I wouldn't have any problem. But I don't know what your exact situation is. But it might be a lot easier to change it now then later. Good luck!

I read that as long as I can show that my current income is 125% above the 2006 poverty line, then all I have to do is send in 6 months of pay stubs. I have that, and I can get a letter from my employer. Will this be ok or do I still need a co-sponser?

My husband came here on a student visa not K-3 sorry. I forgot to fix that.

I was wondering if we have to submit the I-130 with the I-485? The problem is that I won't have the affidavit of support finished until maybe the end or middle of the month due to back taxes for 2004. So I can't send the I-485. Is there a way around this?
I know I can get a letter saying that I am in the process of filing. When I talked to the IRS about the letter, they didn't have a clue. So what kind of a letter would be accepted for me filing and sending it in?
Also I understand that they only need a copy of last years income tax. But it also asks that I filed for the past three years and that's what I am working on now.
One more question. Last year I made way under the poverty line. But now I am making over it and I've had this job for almost a year. Will they look at my income now as being sufficient or last year?

Sorry didn't mean he was in C9, meant he'll be filing as C9 on the I-485.

We Had an appointment yesterday with immigration. The officer told us that he doesn't have to go back because he is now in C9 status because he in in the US already and he should not go back. So now we just have to finish all the paper work and I don't have to worry about the I-129f at all! Thank goodness! Thanks for all the help and advice!

Well I have it all figured out! I am going to be okay! I talked to a really nice lady from the IRS and she is sending me my W-@ info from 2004 and the transcript from 2003. So hopefully we'll get it all done soon! Thanks for all the replies and directions.

I found out that I need to file. I do have 2005 return, so that's not a problem, but they still require 2004 to at least be filed. I am going to be filing and I can get a letter stating that I am filing, so that wont be a problem. Now I am not good with the whole income/gross thing. Is my annual income before taxes or after?

My husband and I are in the middle of filing for his AOS and came upon a problem that I don't have all the past three years tax info or W-2's. I make enough so I can support him, but we don't know how long it will take for me to get the right tax documents. Can my father be his sole supporter even though I am the petitioner on the I-130? If so, what do I need to do?

My husband is here on a student visa. He just finished his OPT almost two months ago so he's going to be out of status next week. We got married June 17th, and haven't been able to get all the info we need to submit the I-130 and I-485. Since he's going back to Morocco I know I can file the I-130 and then the I-129f for him to return. Can I submit everything at once?

I just found out that my husband has to go back to Morocco this up coming week. I read that you can file the K-1 in conjunction with the K-3 so that he can come back. What else do I need in order to do this? How long will it take? I can't stand to be away from him for more than 3 days now, I don't know how I will be able to go weeks upon weeks! Is there a way to get this all expedited?

Does anyone know about the Moroccan Immigration? I was just wondering if it would be any easier there. My husband and I are planning on moving there in the next 5 years or so, but we're not 100% sure yet. We are still working on the I-130 for now, and have a meeting with the USCIS this Thursday to discuss the fact that he might go out of status in a week or so and also to get a little more help with filing. We want to make sure we get everything right or close to it so we don't have to wait months on end. So hopefully everything will be go ok this Thursday and I wont have to take him to the airport next week. I just hope that when and if we go to Morocco it isn't as hard to get the answers we're looking for. Have a good day!

I'm new to this site and was hoping someone could help me out a little. My husband is from Morocco and is here on a student visa. We were married last month just after his OPT expired. He was told that he only has 60 days after the expiration date to figure out what he is going to do. We have just begun to fill out the I-130 and get all of our stuff together. If he goes out of status will he be able to stay here since we are already legally married? I was under the assumption that after he is married his visa is no longer good as a student visa and he needs to apply for adjustment in status, which we are about to do. I'm wondering if his is in a limbo stage and if he will be able to stay here in the USA while everything is getting processed. I don't think I can do everything if he has to go back. Can someone answer my questions or direct me somewhere it might say what happens? Please help!

I was living with my father all of last year til I got back on my feet after college. Not to mention I was in Germany for the first three months. I was working a part time job for 6 months then was hired full-time at my current job. I have pay stubs for this whole past year, so that's not a problem. I make enough and I don't have to worry about the money situation. But it's how they will see it that I am worried about. I'm just gonna send everything and wait to see what they decide.
