SalishSea got a reaction from KateriandKurt1 in K1 visa second time
Not sure where you’re getting the timeline info, but relying 8 year old timelines is not smart. There is no measurable difference in 2024 between CR-1 and K-1 timelines.
Hopefully you also realize that the petition approval is only one step of the process?

SalishSea got a reaction from OldUser in Before Getting to the US: Any Preparations in Advance to Help with AOS?
I think the recent huge increase in fees is what is preventing people from filing within 90 days more than anything else.
There is not much else you can do ahead of time, since you will be waiting to apply for a marriage license and then later for the certified copy of the marriage certificate before you can proceed.

SalishSea reacted to Crazy Cat in What's the Expiry Date on your K1 Visa?
That one answer you got previously was very specific...and accurate. Good luck on the rest of your journey.

This will likely add more time to the process for the background checks regardless of K-1 or CR-1. Both take 1-2 years, but in your case, it may be longer.

SalishSea reacted to Redro in RFE AOS I-130 and AP
You need to add updated evidence ANY evidence you haven’t already submitted. include an explanation on why you haven’t been living together. (Add evidence). And your plans to reunite.
Additionally, weigh up the options
1. is GC more important than taking care of your mother
2. If the case is denied while you are out of the country are you okay consular processing
3. if called for an interview can you return in time
You must reply to the RFE though… otherwise your case will be denied.

AP is not intended for spending large amounts of time outside of the U.S. also- what will you do if your AOS is denied while you’re gone? You do realize you wouldn’t be able to come back, right?

I am not sure you have read the replies, they do not need anything.

USCIS will eventually tell you that the case has expired.
NVC?
Just ask your Fiancee.

Who is your stepson? Did you marry your partner already? And why was your brother there? Where were you at the time?

SalishSea reacted to AmericanGirltoBe in What's the Expiry Date on your K1 Visa?
TDLR: Can you share the expiry date on your K1 Visa and how it relates to your timeline?
Hello. I've seen conflicting information on this from multiple supposedly-reputable sources, and while my fiancé and I have spend a lot of time trying to read, research, call, etc., we cannot seem to get a firm answer on this. So, I thought I'd go to the folks who've already gotten their K1 Visas and ask.
Please let me know:
A. My K1 expiry date is 180 days from the date my I-129F was approved
B. My K1 expiry date is 180 days from the date I passed my interview
C. My K1 expiry date is something else (What?)
This will be so, so helpful for our wedding planning. Thank you!

You can check the fees here. It would seem you need to do more research on what it's going to take to actually come to the US. Fiancé visas require the initial filing, the adjustment of status and then the removal of conditions. A marriage visa will require the initial filing and then the removal of conditions if you enter the US before your 2nd wedding anniversary.

Immigration is never cheap, easy or fast. Keep that in mind. Another factor potentially is what country you're originally from.

This case will get all kinds of scrutiny for marriage fraud. I predict it will take several years. You should have the US citizen make an account on Visa Journey.
There is nothing "fast" about immigration, especially when you are from a very high fraud country.

I was told by a colleague of mine who applied for the same visa and she had moved to his country lived with her now husband had to prove their marriage was valid such as bank accounts etc etc

I would stop listening to that person for immigration advice. You are NOT required to live together to apply for a spousal visa. I just don't know where some of this misinformation comes from.
Whatever route you choose is YOUR decision. Just be aware that I have seen many K-1 couples regret that decision later. I have seen exactly zero spousal visa couples who say they should have chosen a K-1 instead. Good luck on your journey. It is quite a ride.
US immigration requires a great deal of knowledge, planning, time, patience, and a significant amount of money. Failing in any of those areas can cause problems.

SalishSea reacted to Crazy Cat in Which visa is faster spousal visa or fiance visa? K1 or C1?
The cost for a K-1 petition, adjustment of status, Work authorization, and advance parole is at least $3,490 now. To that, you must add medical exam, travel expenses, etc.

SalishSea got a reaction from Crazy Cat in Which visa is faster spousal visa or fiance visa? K1 or C1?
It takes up to two years total. You should familiarize yourself with the forms and current fees. Everything is available on USCIS.gov. If you’re looking at K-1, you also need to learn about adjustment of status and the fees for that. Be proactive.
