OMAHA, Nebraska — A 13-year-old illegal immigrant who fled to his native Mexico amid a sex scandal with his schoolteacher could be eligible to return to the United States under a new visa the U.S. government started granting the week before he disappeared.

The visa helps illegal immigrants who are victims of sex crimes. If the boy, who spent most of his life in Nebraska, qualifies, he could stay legally in the United States for four years and eventually apply for permanent residency. It also would extend temporary residency to his parents and his unmarried siblings under 18, if they applied for it.

"It's a win-win," U.S. Citizenship and Immigration Services spokeswoman Marilu Cabrera said of the so-called "U" visa. "It helps us and law enforcement be able to solve a crime, and it certainly helps the individual who is a victim of a crime."

The boy and middle school teacher Kelsey Peterson were found in a mall parking lot in the border town of Mexicali, Mexico, 1,500 miles from where they disappeared on Oct. 26.

Peterson, 25, remains in federal custody. A judge denied bail for her Wednesday, and she was expected to be sent back to Nebraska to face federal charges of crossing state lines to have sex with a minor, which is punishable by 10 years to life in prison and a $250,000 fine.

The Associated Press had previously named the boy but later removed his name from stories because the most recent charges allege he was the victim of a sex crime.

The boy told the AP earlier this week he would be willing to return to the United States to testify against Peterson.

"That's something that we would have to consider as circumstances came up," said Joe Stecher, the U.S. attorney for Nebraska.

Dawson County Attorney Elizabeth Waterman did not immediately return a phone call seeking comment.

Cabrera said a conviction would not be necessary for the boy to qualify for the visa.

"It doesn't matter what the outcome of the case is as long as they cooperate," she said.

A law enforcement agency, prosecutor or judge in the Peterson case would have to vouch for the boy and say he helped in investigating or prosecuting Peterson in order for the boy to qualify.

The Victims of Trafficking and Violence Protection Act of 2000 established "U" visas to encourage illegal immigrants to report crimes against them. Cabrera said reviews of the rules by the Department of Homeland Security and the Department of Justice delayed issuing the visas until this year.

There are some that are doing their time and not re-enlisting. They are taking jobs with PMCs because they can make more money. Should we raise their pay, give more incentive to enlist, ect.? That will only raise the amount of money spent on Defense, which a few people here think the US spends too much on.

I tried wearing earplugs, still can hear her, I tried to listen to Ipod, didn't help...This is beyond control. Other two people complained also, and nothing has been done. I am not sure if formal letter to HR would do any good....

Write a formal letter and have the other two people write a formal letter too. If nothing get done, move up the ladder.

Wow, Lisa! The damage looks extensive! I wouldn't settle with the insurance company until you get a clean bill of health from your doctor and make sure they pay for all your medical expenses. I'd even consider getting a lawyer if the insurance company drags its feet.

Don't sign off on with the insurance until everything is clean. Problems may not occur until a year later. I got hit last year and it was a month or two before I started to feel anything. I ended up going to a Chiropractor for adjustments and treatments. Insurance paid for all of it.

Some local group is now complaining that schools shouldn't have to ask voter for money. Schools should just be able to raise property taxes if they need it. Also there is no accountability in the system at all.

The biggest political issues in Florida are proprety taxes and insurance. Both have increased far faster than anything else here. Much of this is related to the real estate bubble - as it collapses, taxes and insurance will come down as well.

Higher education in Florida is the cheapest in the US, not much to complain about there.

Property taxes are another animal. With the save our homes (3% tax increase cap) and homestead exemptions, the goal is to stick as much of the bill to those who own vacation homes as possible. There is also a big penalty for moving from a house you have lived in for a long time.

Higher Ed here in MN is nuts too. The State keeps giving money to Higher Ed and the tuition never goes down, it seems to keep rising. They are building a new stadium for the U of M also.

The State just gave Public Ed a 1 billion raise too.

How many times have you heard complaining about property taxes? I hear people whine about them all the time. Last it was predicted that MN will have a 2 billion dollar surplus over 3 years. The #1 thing asked for was a buy down in property taxes. On Tuesday 99 school districts asked for levys or referendums. The average per pupil spending in MN $10,000+. The same poeple that vote to raise their property taxes will be the first ones whining that the states should buy down property taxes because they are too high. Is MN the only one?

I don't count on SS when I retire. I have friends that are in their 50's that don't count on SS. The Boomers are going to eat up SS before I even get a wiff of it. I sure as he!! don't want to pay more FICA so some one else can retire. Gov't been siphoning off SS or so long it going to come around bite us.

sanita feeds tons of animals and birds..her hobby...since we live near a park ..we get allot of birds...and hawks after them....i jsut bought sanita a new winchester..1000 ffs pellet rifle for her anniversary....(i know i am too nice too)..yes, we fight them daily...

If you had to live next to a POS neighbor that I have living next to you. You would want to shoot them too. I was out of town for a few weeks and they were casing my house. So my other neighbor walked over with his pistol and acted like I was home. He said something like, "Hey Kev do you want to see my new pistol." They ran back inside.

A friend of mine worked for a lady that had a small dog that was on it death bed. She would carry it outside so the circling hawks wouldn't get it.

Tuyen & I got married on May 9 and there were problems getting the certificate. I went back in July to get the certificate. We used july on our forms, even though we were married a couple months before that.
