  1. Hello, everyone. Today I rec'd notice that our Petition for Visa has been approved, and they're mailing me a letter specifying what's next.

    So-- what's next? My fiancée Emma is in the Philippines, and I'm assuming the next thing is for her to fly to Manila for the interview. She is quite nervous about this (I think in part because of her English, although I think her English proficiency is around the 70th percentile).

    What kinds of things will they ask? How should I help to prep her?

    Also, what will they look for during the medical exam? And do those take place at the same time, the same visit?

    She is in Mindanao, and so it will be good to do it all in just one trip.

    Regarding the medical exam, I think they encourage you to do it a week or 3 days before the actual interview. If she's ok and has no issues on her medical, then she can go ahead with the interview. If she has medical issues, St. Luke's will call the US embassy to reschedule it and have the medical issues resolved first.

    For the questions, there's a bunch of examples you can find here. In my experience, I was asked about our pictures, why we're in a group, about my work abroad. She can always ask to repeat the question if she can't understand it the first time. Good luck with your fiance's interview.

Is your cousin a K1or cr1? coz do u know some cases ois it true that where your wedding was made like if in the philippines the interview will be there? like me im working outside philippines but my wedding was in the philippines. i heard that my interview will be in the philippines. since that were not yet starting to file our case I want to know everything before so no regrets at the end or no hazzle.

    From my experience, I can request wherever country I want for the interview. I was in Riyadh while my K-1 visa was processed and I chose to be interviewed in PI since it's way more comfortable for me since I have the support I needed from my family. You can choose any embassy in the country that you're in though, you can request or call them about it.

  3. hi vj,i've been working in saudi arabia for 3 and half years,i just came home (philippines) last june 2 2011.

    im now out/exit from said country.do i realy need police clearance from saudi arabia for k1 visa?is there any other option to present that i dont have any criminal records from said countyr?aside from police clearance.can i present employment certificate instead? pleas help,,,

    I think you can ask the Saudi Embassy in PI for that. I wasn't able to present a Saudi police certificate for my Dad but I stated in the packet that it's not possible to have it since you have to be physically present and have a working visa for you to acquire a police clearance in Saudi. My dad went home 2 years before I applied for IR-5 visa.

    I was able to get it during my I-129 application but I was still working there that's why I was able to get it.

    You can go ahead and inquire at Saudi Embassy so you have something to show at the USEM during your interview. God bless !

    My moms name in my passport and in my birth certificate is a little different. only first name is written in my birth certificate.

    will this be a issue if i go and file for her.

    Any affadavit can help us? if so then from where we have to get it?

    I have a related case where my Dad's last name on birth certificate is different from the passport. I asked them to prepare an affidavit for that. It took a while for NVC to finalize the papers. What I did was to follow up with them every week. I got different answers, but one of them told me that they'll follow the one that's on the passport. I got some inconsistensies on my birth certificate regarding my parent's names, but thank God they approved it and did not ask a court order for my Dad's last name.

    I guess it depends on the person reviewing your case. Stay positive that you will get it. Prepare an affidavit stating the discrepancies so they won't need to ask for it. Good luck :)

  5. Adjustment of status is for someone who entered the United States as a non-immigrant, and wants to adjust their status to that of immigrant. Someone who enters the US with an immigrant visa becomes an immigrant automatically, and gets a green card automatically.

    An approved I-130 makes an immigrant visa number available. That visa number is used when the alien either enters the US with an immigrant visa, or enters with a non-immigrant visa and adjusts status. An alien would become an immigrant either by entering the US with an immigrant visa or adjusting status, but they never need to do both.

  6. what that statement means is that just because your I-130 is approved does not mean you should buy a plane ticket to the U.S.. You still need to submit other documents, go through medical clearance and go for the Visa interview and once they are successful, their passports will be stamped with a six-moths cisa. They must travel before the end of the six months and once they get here their green cards will arrive in the mail between 2-4weeks depending on the state. take them to a social security administration office in the state after that to apply for SS card. They do not need to adjust status since they were outside the U.S for their interview.

    I'm not gonna buy a ticket yet since they still have medical issues and their interview has to be rescheduled. What I'm asking is are they gonna get a permanent greencard OR are they gonna adjust their status ONCE THEY GET HERE IN THE US. I've adjusted my status so I'm just wondering if they're gonna do the same thing.

    I've read somewhere in the USCIS site that they still need to adjust the status once they get here. It stated there that an I-130 does only give you an immigrant visa (after the approved medical and interview of course) and not grant you a permanent greencard. Can someone clarify me on this especially for those citizens that petitioned their parents. And there's a part in the USCIS site again that says they can receive their greencard a few weeks after they arrive in the US.

    I hope I could get insights especially for those who filed a petition their parents.

    My parent's I-130 is approved. They already have an interview appt. but it still has to be rescheduled due to medical issues. My question is if they get approved and they get here, do I still need to apply to adjust the status for them to have a permanent greencard?

    They still want to work and from what I've searched on, the I-130 approval does not give a permanent greencard. If so, how long will the process gonna be to get the greencard?

    I hope I could get replies here especially from US citizens who already petitioned their parents.

    Thanks Tahoma. That's good to know that they don't base it from the time I paid the visa. The medical exam in Manila is such a pain and I do get their point why they're so strict. I've asked my parents to do a medical exam before the actual petition began so I'd know if they have any medical issues, but I guess it's different from St. Luke's result.

    it's 130 that was approved. anyway, no need to reapply and pay again. before the expiration (say 3 months) request for extension citing your parents' extended required medical

  10. She doesn't even have her visa yet so its not going to be expired. A visa has to be issued to have an expiration date. I think you are talking about the petition expiration! Generally the USEM extends the petition automatically.

    I got confused with the expiration date. I guess it's the petition expiration. Thanks for replying. Have a good one :)

    I'd like to ask a question about expiration of visa. I applied for I-130 for both my parents. I remember when I paid the visa last July that it's stated there that it's only valid for a year (when i paid online through travelvisas.gov.).

    When they had medical last November, they find a scar on my mom's chest x-ray and was advised to have a sputum culture test and it will take 2 months for the result and if it's POSITIVE, it will take her 6 months treatment for tuberculosis. My dad, on the other hand, is advised to do a skin test and SLEC said that they will call the US Embassy to reschedule the interview.

    From the timeline that I have, if she's positive, will it expire her visa and do I need to go back to square one for this OR the Embassy or National Visa Center extends the visa that I paid?

    I'm positive that she will have a negative result, but I'm still wondering what if she got a positive result. I hope I could get response from this. Thank you!

  13. My wife has her GC and we would like to take a trip to Canada for a week. Do we need to file for any special visa, or just need to show GC and passport when crossing?

    Hi there! No need for any visa, just bring the wife's passport and greencard. They're just going to ask your wife about her status when you guys go through the stamping at the Canadian Airport. I had no problems, we traveled to Vancouver last June. Happy trip!

  14. We're approved! yehey! To all the members of VisaJourney, my big THANKS for being so supportive and for giving us so much infos....from our journey from I-129F application to AOS......For all the suggestions and tips and for answering my posts.....MARAMING SALAMAT SA INYONG LAHAT (THANK YOU VERY MUCH!).

    My interview went so quick...our immigration officer is also a Filipino......he even joked that he looked like an actor in the Philippines (Piolo Pascual), maybe 50-year old version though (LOL! :))....

    Some tips: Bring some photocopies of your original documents....In my case, he took all the proof of joint assets and liabilities (insurance, phone bills, electric bills, joint account infos) and 3 wedding pictures.

    - he also took my work permit and stamped my passport instead so I can apply while waiting for my greencard.....

    He asked me the following questions:

    - Did I work abroad? What was my work?

    - Did I get married within the 90-day probationary period?

    - He did type our new address and ask me if I filed online (weird they did not receive it)

    - The Yes and No questions:

    - Where and how did we meet?

    - My husband's work, my hubby's bday...

    He also checked my passport and took out the I-94 form and my hubby's CA ID.....

    He ask me to sign this approval form and he explained about the removal of condition (he put the dates when to file).

    I can now breathe and rest from this USCIS stuff for more than a year.....Whew!!!!! God is good!

    Cheer up! You are not alone in this situation, there are lots of people experiencing the same way. Always focus on positive things. You have a wonderful and supportive husband who loves you so much and decided to be with you and this is one of the greatest blessings you have now. The adjustments are really overwhelming but it's only temporary. :)

  16. I had my fingerprints taken for biometrics - no problem. But I've just received a new appointment, stating that:

    "The FBI was unable to process your fingerprint card. ... it will be necessary to have your fingerprints re-taken. This will be completed at no additional expense to you."

    #######? There was nothing wrong when my prints were taken, but the FBI's computer doesn't like them, so I have to fork out more money to get to Hartford CT again, to have another fingerprint card taken.

    And with every likelihood that the FBI won't be able to process the new card either.

    Has anybody else had this happen to them? I'd really like to hear about other people's experiences with this.

    When my biometrics was taken, the officer did tell me that I might have the fingerprints done again because my fingerprints are hard to detect, have sweaty fingers.....but didn't receive anything after the biometrics and I passed the interview

    ...I hope your biometrics would turn out fine......
