  1. The RFE is a yellow sheet and it says:

    E. X (2) Submit a properly completely and signed Form I-693, Medical Examination of Aliens seeking Adjustment of Status, for the applicant on Form I-485. The medical examination must be conducted by a civil surgeon who has been designated by the USCIS. The medical must be issued less than one year prior to the filing date of Form I-485.....(it goes on about finding a civil surgeon)

    The vaccination form was the "Appendix A SUPPLEMENTAL FORM TO I-693" that was transcribed by a US civil surgeon.

  2. Hello all, my husband arrived March 2007 from Spain on a K-1 fiancee visa. He had his medical in Spain in January 2007. We filed for AOS in April 2007. Today we got an RFE for the full medical - even though it is stated quite clearly on the I-485 that this is not required. We submitted the vaccination record properly. I am just looking for some advice as to what we should do. I guess our options are:

    1. Try to talk with someone at Infopass and get it sorted out (in my area there are no info pass appointments for 1 week).

    2. Get another medical which I'm guessing is a few hundred dollars.

    3. Try to get a copy of the medical sent from Spain and translated.

    Is it possible to send back the RFE with a letter explaining that the medical exam is not necessary for K-1 applicants.

    Please let me know what you guys would do in this situation.

  3. Hey, I was in the same situation as you. My husband was living in Spain on an overstayed visa for abou 2 years. He did not have residency in Spain at the time. Pretty much everyone I spoke to (many immigration lawyers, the USCIS) told us that it would be impossible to get a visa. However, the Spanish Embassy in Madrid understood the situation, allowed us to interview there. They even waived the requirement for him to get a police certificate because the Spanish government does not issue certificates for people who do not have residency. We got our visa fairly quickly. So I guess my point is don't believe anyone until you talk to the people in France who will be issuing the visa. Our biggest concern was the police certificate, but I think that in France you can get the certifiate without having residency.

    Also just wanted to note that my husband was very concerned about going back to Algeria until he had his "papers" in order. He has heard that if you overstay a visa to another country, when you come back to Algeria they will take away your passport for 5 years. That is why we decided to at least give it shot in Spain at first and it worked. I have spoken with many other people who say this is simply not true, and have entered in Algeria with no problem after a visa overstay, just wanted to let you know that is what I've heard.

  4. I had made of copy of everything, so I reprinted the completed I-765 form, had my husband sign it (so it would be an original signature) and resent everything. When I log onto the website with the Receipt number only info about the AOS application comes up. I tried called and they did not know anything other than the fact that the AOS NOA and EAD rejection notices should not have had same receipt number.

  5. Thanks. He has the temp EAD stamp from when he entered as a K1 at JFK.

    I posted in the other forum, but I mailed out the AOS, EAD, and AP packets together. We got the AOS and AP NOA1s on Monday. We also got a notice saying "Application Rejected" with the EAD check attached saying something about the payment being wrong, even though it was in the correct amount. The EAD package was not returned. The receipt number on the rejection notice was the same as the receipt number on the AOS NOA1. Also there was no indication anywhere on the notice which application was rejected, however I am assuming it was the EAD because that it the check that was attached. The whole thing is very strange and I am just curious if they can offer me any explanation. They officer was looking up stuff online and had kind of a confused look until he realized it was my husbands application. Then he literally threw the application back at me and told me to get out.

    Our infopass is like 1.5 hours away only open during the hours my husband works. I'm just so frustrated cause for us every day of work counts.

  6. I understand that it's his application. Its just frustrating that there is no way to get info on his case. Its not like I'm just some random person on the street plus I had proof of his approval to act on his behalf. I know that my hospital will accept these kind of documents for one person to make decisions on behalf of another - I'm kind of surprised that the USCIS will not.

  7. I went to an infopass appointment today regaring my husbands EAD application. He could not go because he was working. I had with me copies of all of our paperwork, passports, and marriage certificate, and I had a letter giving me power of attorney over his affairs. They would not accept any of this and refused to give me any information on the case. Is there any way to get information about my husbands case without him being there? They told me that they would only give information to a lawyer. How do people in the military/in the hospital etc get this kind of stuff done?

    Yes, we will send out another copy of the 765 tomorrow. I got the NOA1 for the 131 today with no problems. I called the USCIS and the women thought it was very strange that the NOAs for the I-485 and the rejection for the 765 had the same receipt number.

    Do you think an infopass would help?

  9. My AOS, AP and EAD documents were recieved in Chicago on April 20, 2007. Today I got a my NOA1 for the AOS and AP but a "Rejection Notice" for the EAD. My check was attached along with the message "Recently you submitted an application for immigration benefits. That form was submitted with an extra remittance that is not required to process your application, or the incorrect fee was submitted. Your check is being returned to you along with this notice...."

    I am looking at the check right now and its for $180 made out to US Deptartment of Homeland Security. I tried to look it up online but the receipt number is the same as our AOS receipt number.

    Any help please! How can I fix this so that we get our EAD :help:

  10. Hey all,

    My husband and I went to the DMV with his passport, I-94, SS card and marriage certificate. They gave us a big problem because the I-94 expires in June, but after talkiing with a supervisor and looking at the marriage certificate, they agreed to give my husband his "Non-Drive State ID." However, when it arrived in the mail it says "Temporary Visitor ID" and expires in 1 year. Has this happened to anyone? We would really like to just get the regular card, is it worth going back? I'm kind of paranoid they will take away the original card after looking into it more. I'm not really sure what the official policy is.

  11. I don't understand either about the letter. I don't get why they can't just call the Offrice and verify. Unfortunetly, my hubby really needs a job and Target is the only place that called us back. He doesn't speak English, but he speaks Spanish. I am kind of dissapointed because I thought he'd at least be able to get some kind of job with the Spanish (at least where I'm from there are a ton of fast food works, restaurants busboys and such that don't speak any English). I guess no english + 1 month in the country + Muslim name = tough time finding a job.

  12. Hey just wanted to update, we did get a report from the Background check agency and the result was "Invalid SSN." So I called them, and they said that we need to go to the SSN office and get a letter confirming that this number belongs to my husband. Then we need to bring this letter and a copy of the SS card to Target (the store where my husband is applying) and they can resend everything and run another check. I'm not sure its going to work but we're willing to try.

    This is so frustrating because we thought once we had the SS# things would be okay. We have not been able to open a bank account or clear these background checks even though the number is fine.

  13. Hi, my husband recently came through JFK. He's Algerian but was living in Spain. They asked him a few simple questions (Where are you going to stay in the US, When are you getting married) then told him to wait in some room. When every one else on the plane had passed though they asked him some more questions (What address he will be staying at), took his envelope, stamped his EAD, and let him go. My husband said they were not the friendliest bunch but the whole process was relatively painless and took only about 1 hour. My husband doesn' speak English very well, but we practiced the answers to the common questions, so he could say his address and stuff like that. One good tip I read on Visa Journey was to tell your fiancee don't be afraid to say "I don't understand the question." Its better than giving a wrong answer.

  14. Thanks a lot for the replies...They were not based on his finger print. He is applying for a job at Target (the store) and all they have so far is his SSN and address. I'm thinking it might have something to do with his SSN because we are also having some trouble opening a bank account (they tell me his SSN doesn't verify, but when I called the SSN office they say everything is fine).

    They wouldn't give me any info over the phone so later on today I'm going to go down to the store to see if I can get more info. This is so frustrating because we really want to squeeze in as much work as possible before the K1 I-94 expires!

  15. Hey my husband was offered his first job in the US pending background checks. We just heard back today that the background check came back "Negative" and that he would not be able to take the job. He obviously had to clear the government background checks to get the K1 Visa. He has been here for 3 weeks and had absolutely no encounters with the law. What could have possibly come up? What do you think we should do? Any advice would be appreciated.

  16. Hi my husband is from Algeria as well but was living in Spain on an expired Visa. He considered visitng Algeria before coming to the US but was concerned that the Algerian government would be angry about his overstay in Spain and possibly take away his passport (visa included). I don't really know too much about how the Algerian goverment works, but I would just say be careful if there is any chance of them taking away his passport.
