Ok, we received the NOA with the following statements "conditional resident status is extended for one year" and "this extension and authorization for employment and travel does not apply to you if your conditional resident status has been terminated"... is it normal to have the conditional resident status extended instead of lifted?

    There was also a note stating we would receive an additional notice for the biometrics which I understand.

    Does this mean they extended the conditional status until the biometrics and interview is complete? I hope this does not mean we have to file again in a year.

  2. If possible, visit your local USCIS office and ask to speak to a supervisor. Be prepared for the run around but insist on them sending the regional office an email explaining your situation and for them to contact you with the response. This is the only way I got them to fix my wife's expedited travel documents which they did not expedite after I paid the extra fees for the expedite. I talked to the local congressman and all he got was the same generic answer I did about the no refund policy. It took 9 months of writing and visiting the office but i eventually got the fees refunded. Basically be the squeaky wheel and do not give up. The Government employees and offices forget they work for the tax paying citizens and we do not work for them.

    We are just a few weeks away from our 90 day window for filing for the removal of conditions. Hope we do not have issues because the closest office is in Dallas, 4 hours away.

If anyone of you read my old post about AOS got all messed up,here's the update,this morning i went to the local office here in hawaii to ask them why they took my AP if i'm not approved,the lady said so that i don't leave the country while i'm on a process of the back ground checking.My AP is valid until 8 May 08 but i have no plan to leave the country,i was just asking.and then i showed them the email from USCIS that my card production has been ordered,so it was very confusing that after they told me i was not approved.She said that i need to do another biometric finger print to speed up the background check because i don't remeber but they said i put a wrong birth year which is 1982 instead of 1984?so now they said that even if i got this notice from USCIS i will be on hold,then i checked on the USCIS online again and this is what they said.

    Current Status: Notice mailed welcoming the new permanent resident.

    On March 28, 2008, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later.     is this the welcome notice?are they gonna put my GC on hold untill i do my biometric again?it's really confusing,the lady at the local office said that my case on the system is all correct but how it can be corrected if they said that my birth year was wrong?

    Was the ladies name Rorie? They required us to do biometrics 3 times in Honolulu before they got our AOS correct!

    Ya i think so...she only made me do the biometric once...there's a ;ady there that we really really hate her name is Miranda...she's a ####### LOL as in no help:( anywAYS congratz to US!!!

    I am so glad that it didn't take that long!we are trying to get the refund from the AP but they said we can cancel but we can not get a refund...oh well atleast my GC is on the way!!!

Hi everybody,as some of you know my greencard has been on hold for a background check,i got my AP last year so i could visit the philippines and i've been using it for 2 times and it's gonna expired on 8 May 08,can we apply another one before the expiration of my old AP or should we wait untill it expires?Ty

    PS the reason why i asked this its because the officer at the local office said we can't apply for anoda AP untill my old AP expires?but we didn't see any rule for AP that we have to wait untill the old ap expires?

  7. for the update again....i got a letter today from USCIS which is the hard copy of my case being reopened,it was sent on 1 april 08 after they sent me the welcome notice,i was wondering if i didn't show them the email about my card being ordered are they still gonna hold my case???i really do think that this officer who interview me made a mistake from submitting my case to the main office instead of cancelling it after she told me she cant approve me.

    I made another infopass for tomorrow together with my husband's letter for them,we corrected the DOB last year for my AP so why they didn't do that on my i485?and why they waited 1 year untill they do this background bullshit,we are all here on a legal process of paper work yet they let this illegal aliens live here in the states illegaly without going through all of this bullshit which is so ###### unfair.... :crying:

Hello again everyone!for the update,as ya'll know my case has been bouncing around like no where to go!today i got a MAIL from USCIS and its a welcome notice,looks like they sent it the day i recieved an email from them which is a welcome notice too.now i am all confused again.anyway this is what the welcome notice said

    This is to notify you that your application for permanent residence has been approved.it is a great pleasure that we welcome you to permanent resident status in the United States.

    My question is there a difference between the welcome notice i recieved via email on March 31 and welcome notice on mail that has been sent the same day i got the email?i'm making another infopass again for monday so hopefuly i will get the answer from all of this.

  9. kinda sorta. My case was under review for about 4 weeks before I got approved. I know it was a different situation, but I think it won't take too long for them to come to a decision, specially if it is only about a typo of the DOB...

    Thank for the reply Nane,i hope your right that it will not take that long...i went to do my biometrics again this morning because the lady at the local office asked me to do it again then they will pass it to FBI wonder how long is it gonna take,i'm totally depressed right now hopefuly everything will be alright!

    We reopened this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS on March 31, 2008, and are now reviewing our earlier decision. We also mailed you a notice describing the next steps in the process. Please follow any instructions on this notice. Our review should be completed within 30 days. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service.

    Does it mean im on hold now????

  12. It means the background checks are complete and you will be receiving the green card soon!

    Neonred,i got this email the the same day after i had my AOS interview.im all confused now because the lady said that she cannot approve me because they need to do the background check because my birthdate said 1982 instead of 1984.so im wondering if its normal to recieved this after she told me she cant approve me?

I just had my AOS interview this morning,i almost made it because she told me i was approved and they will send my GC within a week or so,then she was typing something on the computer while interviewing me,she then look at my files again and saw a mistake on my i485,it was my birth date where is said 1982 instead of 1984.so after telling me i was approved and that i can work as sson as i get my GC she then told me that she cannot approve me because my birth date was wrong and they need to do a back ground check.i was on a break down when she said that!so she went back to her computer and was trying to cancel something then she told me how sorry she is about it,.so i went home and talk to my husband about it,now we are very confused because last year when we apply for advance parole they also made a mistake of my birth date,they put 1982 instead of 1984 this is after we apply for my AOS!,then we checked on the USCIS website and this is what we saw.

    Do any of you received this type of email after your interview?now we are wondering if she made a mistake of sending it instead of canceling it,or she reversed her desicion?we are all very confused right now.i will go back there on monday to see what happen.

  15. But even if I applied for a new AP now, it wouldn't get here until June. And how do I get back into the US in 2-3 years if I can't apply for another AP in 2010 from Germany?

    This all is just BS! I should have my greencard for a while now. :o

    Right now I am just hoping and praying for a miracle and that my application is still in California and they approve me without an interview before June.

    I can still hope, right?

    Nane, my wife and I have been through this already. Apply for the expedited interview appointment first or apply for the expedited interview and AP extension at the same time. There are exceptions for the Military due to the frequent moves required. Ken

  16. ...if my greencard isn't approved by the time I move back to Germany? For the ones who didn't read my otherpost about this: My husband (USC) is in the military and will get stationed in Germany in June.

    So what happens, if I don't have my greencard until then? I was told by an IO that it is pending at CSC eventhough I have an online update that it got forwarded to a local office. So right now I am not even sure, who has my application and wherever it is, I am wayyy out of any processing times.

    I have AP right now but it expires in August. Can I just apply for a new one? Can I do that from Germany?

    Would it make sense to abandon my I-485 and do direct consular filing before we move back to the US in two years?

    Can they invite me for an interview if I am already in Germany? And last but not least...can I have letters from USCIS send to an APO adress????

    Geez, I feel like I will be so screwed with this all....

    Thanks in advance for all advice, input and thoughts. I really need some good ideas and advice, with the move, trying to sell our house in a short time, being pregnant on top of all, really stresses me out a lot and this is just something that shouldn't even be an issue anymore by now. So frusterating....

    Nane, I assume you already had your biometrics appointment and just waiting on the initial interview? As a military member, you husband can apply for an expedited appointement using the Military move as the justification. I recommend you make an appointment at the local USCIS office via the InfoPass appointments and go talk to an Immigrations officer. Granted they do not always know the right answers either, but they can tell you where your case is "in the system".

    Your husband will need to provide a copy of his assignment RIP and a written statement from his commanding officer to send with the expedite request. If you appointmen has already been applied for, your interview should be way before June anway. Good luck, Ken & Maria
