    Why are we all assuming that this happened this morning. The OP said that he left at 5am and that since then she checked if he showed up to work and filed a missing persons report. For all we know, this could have been a week or more ago. She is just stating the circumstances of his disappearance, not a specific day it happened. Lets not be so quick to judge her either.....

    It's good for people who haven't had any issues. Eg, a K-1 visa beneficiary who has complied with the terms of their visa. The thing to keep in mind is that the CBP has ultimate authority over anything the Consulates or USCIS say.

    Yes, you can use it. The Peace Bridge has always been the best for understanding the situation and process so maybe stick with them. Or do you go Whirlpool? Lewiston is coming up to speed if that area is closer to his home, but they are always way too busy for my liking. Rainbow absolutely never ever. lol

    Also, to expand on BunnyGirl's summary, if you choose the K-1 route then you will have to wait for your greencard or Advance Parole (whichever comes first) before you can return to the US if you have to suddenly leave for an emergency back home, for example. If you do leave the US prior to receiving the GC or AP, you will need to start the whole process over with a spousal visa.

    In my opinion, the fiance visa is inferior to the spousal visa in that it will restrict him on being allowed back into the US if he should need to go back to Canada before his Adjustment of Status and/or Advance Parole has been received. It is also the more expensive of the two in more ways than one. Just something for you to consider.
    You will want to post country-specific questions in the Canada Regional forum as each country and Consulate is unique in how they address issues.

    A feathered headdress, worn only by certain tribes and nations, has always been something that you earn. You earn it through successful hunts and other acts. A full warbonnet is similar to a soldier's medals. Every part of it is earned and tells a story, the story of the warrior's valor. If I were to pull out a veteran's medals and parade around wearing them and flashing them around, people would be offended, as I have not gone to war and have not earned the medals.

    A person who is not first nations/Native American or a person of another tribe or nation may be gifted a war bonnet by the tribe and may wear that, but simply creating and putting one on is most akin to an act of forgery and a theft of a cultural artifact that people work very hard to earn.

    CBP patrols the border, and USCIS adjudicates petitions. They are two different agencies under the Department of Homeland Security.

    This does not have green card fraud written all over it. People do not move from the UK, to the states for a better life. Maybe if she came from a third world country you could guess at green card fraud, but not from a place that has free healthcare, better employment prospects, and a decent standard of living. It sounds like a simple case of her not being over her ex. My advice would be move on and forget all about her.

    Normally, when they take your passport, it is a good sign. AP is normal and means they are working on it but it can be in AP for as little as one day or as long as 1+ years.

    Just for sake of clarification, since the acronyms are getting confused:
    Customs & Border Protection (CBP) = United States
    Canada Border Services Agency (CBSA) = Canada

    The person you spoke with at CRA didn't quite get it right. Capital gains do not apply if the property was your principal residence prior to emmigration. Your lawyer will request a Certificate of Compliance from Revenue Canada because you will be deemed a non-resident when you leave the country prior to the closing date. RC will do an audit then either send a letter requesting payment of back taxes or forward the Certificate of Compliance. There will be no taxes paid on the sale of the home if it was your principal residence at time of sale. Therefore, there is no disclosure of the sale required on your taxes and no taxes payable on capital gains.
    So here is what will happen:
    You sign the contract on the sale of the house. You go to your lawyer, explain the situation, he/she will explain the process, then request a Certificate of Compliance from Revenue Canada. Revenue Canada will revue your taxes and either send a letter of compliance or submit a letter of taxes owing. 30% of the purchase price is withheld in escrow until the lawyer receives an all-clear letter from Revenue Canada. Any outstanding amounts payable will be deducted from those funds prior to RC issuing the release document. You go back to your lawyer, sign the closing documents, and give them the keys to the house. You move to the US. The house closes and the lawyer receives the payment. He/she pays off what's outstanding, takes their cut, then sends you the rest. Note: It could be 25%, and not 30%, of the purchase price which is held in escrow. I am fuzzy on the exact percentage at the moment. The Certificate of Compliance process takes about two weeks.

    I came in on a K-1. When I tried to get a FL license they told me I wasn't considered a resident until I received the greencard and that I was fine to drive on my foreign license until then. They did tell me they would accept me as a temporary resident as soon as I had received my AOS receipt. I got that a full 4 months after entry. I took that in and they gave me a one year temporary license and told me they'd give me a full license once USCIS deemed me a permanent resident.

    I see you are going to be in VA. That is where I am now. Here are the document and legal presence requirements for that State. You are best to apply for Adjustment of Status as soon as you can so you do not run into any trouble.

    Like Nich-Nick's husband I drove on my UK license in TX until i got my EAD. Then I went and got my TX license. TX says you're supposed to get a TX license after you've been resident for 3 mths but when USCIS considers you a resident and when TX considers you a resident are two different things. Without an EAD I was technically still only a visitor and thats what I was going to say while producing my UK license were I ever stopped and asked to produce a license. I was never pulled over however.

    You are both correct, all the while you seem to leave out the fact this is still a private forum and in a way, as Kathryn (?) explained in another thread, it is gauged and evaluated by its content. Private forums are not vehicles for free speech, thence the very existence of moderators.
    Danno's opinions were not simply unpopular and outdated, so much as they were full or prejudice for specific groups. In this sense, his opinions were as unpopular and outdated as those found on Mein Kampf. Had he stayed compliant to the TOS which regulate this forum, he would still be here, but IMHO his ship sailed when his every thread was about the same subjects. Anyone unfamiliar with this forum might be forgiven for getting the wrong idea if a internet search revealed an association between this site and countless posts containing objectionable speech - in 2014 America - by one of its members.
    How much room would a fundamentalist christian, in his own home, give to an atheist who took the floor to proselytize about its views on religion?
    How much leeway would you give, in your own home, to sexually charged innuendo, during a children's party?
    How much welcoming would you be to a KKK member testifying endlessly in your church?
    Free speech is certainly nice, but it only really works well when coupled with sense of occasion, and some of the allegedly banned members lacked the latter.

    Not liking gay people was one thing, but basically calling all gay people pedophiles, rapists, or comparing homosexuality to beastiality, that's a bit more than unpopular opinion. He would never say it to your face, he'd just bring up a bunch of charts and stats to think out loud what that looks like and let you connect the dots. If you figured it out, you couldn't say anything because he'd never actually say it, just post a bunch of data and hide behind it.
    As far as black people goes, it went way beyond the inner collapse of black people. Every single post was black people suck. Good things never happen within the black community according to him. That was his stance. Post a positive story, he'd find a loophole to drag it down. Talk about solar panels(I can't let this go) black people are poor. Some black kid gets accepted to all Ivy league schools with a monster SAT score? That's AA for you, he can't be that smart or he's average. That's how he felt about us. Racism didn't exist, unless it was us against them, or it's "justified".
    He might have been banned for the topic he put up last. He was on his I can't stand the way black people act rant when he was asked to stay on topic since the OP had nothing to do with black people. So he went and found a seven year article written by a black man on black culture. He was ready to have a field day. That was the last I saw of him.
