  1. Our I-130 is approved. If I get K3 and go to the United States, will I have to go back to my country for an interview for a green card?? Or I can still file Adjustment of Status when I arrive in the United States? I thought I could file Adjustment of Status "before" I-130 was approved, so now it is approved and I feel like I should stay and wait in my country. Can someone advise me please??

  2. Every time when we call USCIS, they give us BS... Most of the time they are rude, and what they say is what we can see online. I feel like the government is paying for the reps for doing nothing. Are they really needed?? I really envy them. They do nothing (giving false information) and get paid. Before IMBRA, I want them to do something about how the reps are.

  3. I don't know if it helps you feel better, but in Japan you can get a green card in a month by DCF (if you were a Japanese citizen). I don't know about Belize. I guess the speed of the process depend on countries, but it is possible that he can get a green card quick like Japan. Ask your hubby if he can find any information about it (I found it out on the international marriage forum in Japanese). If it takes only a few months, it is worth to do DCF. You are going to the country anyway :D Either you two are going to live in the U.S. or not, I think it is better for you to finish the process. Isn't it tough if he gets troubles entering the U.S. when you have to go back to the U.S. for some reasons??

    I am sad everyday, but I cannot do anything. I always cry to my hubby "when can I go back?" He always cheers me up "soon you will!" I just try to think positive, where to go when I go back there, what to buy when we get a house, wanna lose more weight and be attractive by the time when I see him again, and such. Waiting and thinking positive are all we can do now... Now we are having rough time, but happiness is waiting for us. Good luck (F)

  4. Thank you guys!! I am very happy :D I just showed the officer a doctor's paper, a marriage certificate (to prove the person on a doctor's paper is my husband), and a round ticket. He read the doctor's paper and understood the situation so he let me go. He still kept on telling me about the immigration visa though :o

  5. Hello. I am in Oklahoma now. My husband is getting better. His face is injured badly, but everyone is surprised at how quickly he has been recovering. I am very happy!! Thank you very much, everyone for your advice and kind words. I am very touched :crying:

    I didn't have much problem at the immigration at the airport. The officer spoke a little bit of Japanese so he was very friendly to me. After he scanned my passport, he asked me about my student visa, such as when I finished school and if I am here for school. I was here for about 5 years with a student visa. The student visa expired a year ago. When he asked me my purpose of visit, I said to see my husband. It was not much problem, but he asked me if he was Japanese, and when I said he was a U.S. citizen, his face turned so serious. I showed him my tickets to Japan, the doctor's paper, and the marriage license. He told me I need to apply for an immigrant visa to live in the U.S. and I told him that I understand and I am going back to Japan after I see my husband. He said that several times to me and I just said I understand :unsure: and he let me go.

    It sounded like he doesn't know that we are applying for a K3 visa. It is not on the record yet probably?? He mainly asked me about my student visa. I was a little bit scared when he turned so serious, but I am happy he let me go :D I am going back to Japan next week. I really don't wanna leave. I just feel blue when I think of work, where mean people are at :( but I am just hoping that my K3 will be approved soon and will come back here soon.

I just got done talking to the embassy and the rep on the charged call was really nice :D She said that I should be able to enter the U.S. without any problems with VWP even though I have filed for a K3. She said that having a round ticket from the U.S. to Japan is considered as you have a will to go back to your country and it's even better if I have a doctor statement, so currently his sister is getting it for me.

    "Due to security considerations, there is no longer an information window for walk-in visitors."

    That is what the embassy website states :(

    Anyway, I am hoping that I will have no problems to enter. I think you are right. If I act too worried, they might think I am suspicious. I am not doing anything bad, so I will just act normal :D Now I need to contact my work. I hope they are understandable. There is another problem since some workers are unnice ;)

  7. Ravichan, as someone who travels constantly between the US and Japan, I do not think you will have any difficulty entering the US. Do you know how many people entered here on the VWP for holiday during Golden Week? I think that if you came here for a 1 week holiday with a return ticket you would have absolutely no problem at POE. You would not even have to mention your husband's situation (which would probably not work in your favor). Please understand that I am not an expert but I see this as a simple way to handle your situation. If I were in the same situation I would surely gamble the price of an airline ticket for the chance to be with my spouse at such a time. Good Luck!

    Jim, what you mean by people is the people who are not applying for an immigrant visa right? I understand that normally Japanese people can visit the U.S. for vacation without any visas, but we have filed for a K3... I heard that when officers scan our passports, they can know if we are applying for any immigrant visas. Is it true?? In that case, it is possible that they will deny my entry right?

    Also, on a Japanese forum, I saw a few people weren't allowed to enter the U.S. while they are applying for a green card. One of them even had an employment letter... That is why I am really worried. This is not just a visiting for fun, so I really wanna prepare as much as possible if I leave for the U.S.

    I wish I could go to the embassy, but I doubt that they will let me in without an appointment... Also, I live far from Tokyo and I will need to go there by airplane ;) I don't know about other countries, but in Japan you will have to pay to ask the embassy questions regarding visas. $15 for 15 mins I think, so they should give me good services :angry: but by how the person answered last night, I am not expecting too much :(

  8. I called them again, and they gave me a different phone number and I called 7 other places after all. Most of them were unnice and all the reps gave me different answers, and the last person I talked to clearly said that there is no way I can visit the U.S. until I get a K3 visa even my husband is in hospital! I didn't think it was right so I kept on asking and she just said have a nice day and hung up on me :angry: I knew they BS a lot but I am really mad this time...

    Tomorrow morning I will call the embassy again. Hope someone nice will answer next time. I live far from Tokyo so if I can just fax them, that would be great.

    Many of us here live very far from someone we love. It's really tough, isn't it?

  9. Since the embassy was not helpful, I called U.S. Department of State in Washington. A nice lady answered me and said I will have to apply for a medical emergency visa, which I need a letter invitation from his family and a doctor statement. After I receive them, I will have to go to the embassy in Tokyo for an interview. She said it won't take too long since it's an emergency, but just receiving letters from them will take up to a week...

    Also, it seems like she doesn't really know what a K3 visa is and she told me to file I-130. I explained that I have already filed it for a K3, and she said I might have to file for change of status... I think she is a receptionist and I will have to call them back at 8:30am so she can transfer me to a Visa officer for better advice, but she understood my situation and tried to advice me as much as she could. I really appreciate that.

    It is really pain that I cannot even see my husband even in this situation... My husband and I talked about it before, that if we get an accident, it will be hard to see each other. It was just a small talk we didn't mean. I have never thought it could really happen...

    Is it that hard to enter the U.S. even in those situations?? All I need are a proof that he is in hospital and I have a will that I will go back to my country after making sure he is okay right?

  10. Thank you for your reply. I just contacted the U.S. embassy and they are useless. Currently it is 7:30pm in Japan and soon after they answered the phone, they told me to call them back tomorrow. Why do they answer the phone then? I told them it's an emergency and they listened to me, and after they did, they told me to call them back. so stupid. It's so cruel if they don't let me in. He is in an accident...

  11. Thank you for your reply. How come I have to apply for EAD separately? Some state you can apply for EAD with the petition for Adjustment of Status and some don't. What is the difference? I don't see the reason. I am confused :huh:

    And about the medical exam, I was curious if I needed another one since the instruction states only about K1... I am glad I don't need another one. It can save a lot of money. Do I have to prove or state that I have taken a medical exam for K3 when I send the petition for Adjustment of Status?? One question was solved. Thank you :D

  12. I don't know if this is a right place to post :huh: But after entering the U.S. with K3, what we have to file are I-485 Adjustment of Status and I-765 Application for Employment Authorization?? Is there anything else?

    I have been reading the official website and papers recently, so I will not miss paper work I need to obtain in my country, but more I read, more confused I am :wacko: so complicated... Can someone give me some advice??

  13. yes, the NOA2 means that the petition for the K3 (I-129F) has been approved. NVC has very little to do with K visa petitions, they send them directly on to the appropriate consulate. Then the consulate will send you Package 3, with the application forms for the K3 visa, and once they recieve those back from you, will send you a letter to notify you of your interview date.

    Thank you so much Reba! :thumbs: I had misunderstood. I thought when people say they got approved, they received an approval letter. I was waiting for it. I feel so stupid... :whistle:
