    With all due respect Ma'am/Sir, I don't think you understand the tax laws with regards to immigration fees/immigration lawyers. Claiming tax deductions for these are not allowed. Now go ahead and delete this comment for speaking the Gospel Truth.

    The IRS does not allow you to deduct USCIS fees from your income for tax purposes. Nor can you deduct the cost of legal representation for an immigration matter, as this expense does not meet the IRS guideline: a deductible expense must be directly related to the production of income. Transportation to your immigration office, biometrics fees, postage, phone calls, copying charges and all the other expenses of getting a visa are all non-deductible.

    I think it's asking for trouble as you have filed for a K-1 already - it might be more difficult to prove that she didn't have immigrant intent.
    Is it worth the risk?

    I don't think you understand the process. You can get the 10 year GC if you came in on the IR-1 visa and were married for more than 2 years at the POE.
    You came in on a K-1 visa and were only entitled to a 2 year GC. The sooner you get that GC the better. Apply now and stop trying to "cheat the system" by waiting.

    I could not care whether the law lets them adjust or not. If they want to use the system like that then good on them. This is my opinion. I followed the system and waited like everyone else. Other countries do not have the luxury of the VWP, so people like me are extremely thankful to have the VWP and do not abuse such a privilege. People who abuse the VWP to utilize it for something for which it was NEVER intended gives the impression that it's a way to circumvent the requirements, and promoting additional abuse!

    To be fair, if you don't have anything more helpful to add, you can hit the little x at the top right of your browser and go to something more constructive. It's highly unlikely, with the speed at which CSC operates, and how the last transfer was handled, that it would actually EXTEND the process. Saying that only proves you're a daft person who thinks he knows it all.

    As someone else who has come from Australia I think if you have a current pending K1 application, I believe it would be taking advantage of the luxuries offered to us by the US to use the VWP as a means to bypass the application process and speed up the adjust process.
    By all means you can do this and it would be ok, but don't expect people to be happy or OK with your choice.

    Taya, you are a little confused. First, you have no legal status in the US as you never got a (conditional) green card. Therefore you cannot remove conditions. Removal of conditions (permanent green card) can be applied for 90 days prior to the date you became a LPR, as listed on the conditional green card, not based on the date of marriage.
    If you apply now for a green card you will receive a 2 year conditional card and will not apply for permanent card for 2 years. You can wait until after 2015/11/25 and you will likely get a 10 year green card.

    It's not set up for anyone who is poor, young or old. It is what it is. The fact remains if your husband had intent to adjust status while entering on the VWP, it's fraud plain and simple.Whether or not you admit it, your original post leads us all to believe that was the intent.
