    Naturalization would have been the perfect time as that is a court proceeding.
    Now you will have to file in your local court house to change your legal name.

    I'd call USCIS first, but I'd be inclined to go.
    Better to go a second time and find it unnecessary, than to not go and risk having your application considered abandoned. Even if that's a mistake, it will take forever to unravel the mistake, I think.
    Call them though - see what's up. That's where I would start.

    So, this wasn't just a big fight that she's overreacting to? You believe the relationship is definitely over?
    Someone will correct me if I'm wrong, but I think you won't need to do anything with your greencard until it's time to remove conditions. Then you'll go to the interview alone, with your evidence that it was a real marriage, and explain that you got divorced.
    It's up to you whether or not you go after her for the blackmail. That's a tough one. I don't have much sympathy for her, but then I'm not the one who was married to her.

    Your problem is how this looks to the IO. i'm going to tell you how it LOOKS (obviously you feel it's different)
    1. You got your GC based on marriage to your USC
    2. Your attended your 10 year GC interview claiming all happy happy
    3. Conveniently after the interview for the 10 year card you claim abuse of USC spouse
    4. Your ex-husband files for divorce the SAME month you interview for your GC (this makes it look like you lied at the interview, only stayed together for the interview/GC)
    5. One year after your divorce is final, you conveniently find another man to marry in your home country (how did you meet?). You then file for citizenship, and I assume will shortly file for your new husband.
    Unfortunately you've made it look like your marriage to your USC husband was fake. That once your got your 10 year card you left him to marry your REAL husband/bf back in your home country and now you will petition your "real husband". Unfortunately the evidence you presented for a valid relationship could be explained as evidence from your USC husband loving ou and you just going along with it for the GC. This wouldn't normally be questioned but your new husband, from your home country no less, is the one that makes your USC marriage look fake. I don't know your chances for approval honestly.

I don't understand how you put up with her #######. You deserve better. Make sure she is not abusing your child. Tell her to attend some anger management classes ASAP.

    Yes, if you willingly claim USC, register to vote, and vote while still in PR status, then you are in serious trouble.
    Your case is different where the bank made a mistake. So you should be fine.

    If you are big and tough and like to kill people, can join the Marines or Army Rangers. If you posses high technical skills, can join the Air Force or Navy. This country of ours is not too keen on losing a multi-billion dollar bomber, aircraft carrier, or submarine. Kid brother was drafted into the army, received all of his medical training to become a doctor for free, had brains. Was always well protected and well behind enemy lines putting broken soldiers back together again. He was too expensive for the army to put him in harms way. Served well and now getting a big fat retirement paycheck.
    So joining the military is not exactly a life threatening experience, have guys safely in the USA flying drones over Afghanistan.
    Sounds to me like your major problem is with your fiancée, you meet that special person, want to spend the rest of your lives together, but have to discuss where that will take place. One of you will have to leave your family to live together. If you want to live here, have to make a three year residency requirement, meaning besides taking short duration trips to your home country, the vast majority of your time will have to be here. But after you receive your US citizenship, then you are free to live wherever the two of you decide.
    Our economy is sure poor here, some of my kids are working in foreign countries to get decent jobs. Graduating with honors, only job opportunities were like working as a stock boy at Walmart. One son thought he would do well with progression with a good degree, but quickly learned everyone working there also had high degrees.
    Another problem is in the last couple of years, airline rates have more than tripled. Wife is leaving in three weeks to visit her family, first time she is traveling alone, just too damned expensive for me to travel with her.
    If she moves to your home country and you spend all of your time working two jobs, she will quickly get bored. But the same here if you join the military, will be separated for long periods of time.
    These are things you have to work out with your fiancée, if you can't, far better off not getting married.

    The OP was already divorced at the interview but failed to inform the officer. So he cannot check the back of the oath notice that he got divorced after the interview. He needs to correct this before the oath ceremony, that's why I suggested that he should take an infopass appointment ASAP.

    I went with this option:
    I picked:
    Case Services follow-up appointment - If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment.
    and it went very well. Pick the closest one for your case, or maybe it would be the same one I picked. Good luck.

    Had my interview today. Took only 10-15 minutes and I was out of the immigration office. Had to comeback around 2 pm for the oath taking:) Good bye for now USCIS Thank you for bringing us together.

    He needs to let USCIS know about the divorce because the marital status is being printed on the certificate of naturalization.
    In fact, at the back of the oath notice, they ask if you have been married or divorced after your interview. In this case, the OP was already divorced at the interview but failed to inform the officer to update his N-400 form. So he needs to do the update now before the oath so that USCIS has all the correct information and can issue his certificate of naturalization properly.
    Please do not give advice for hiding information from the USCIS.

    Still, you need to let them know about your marital status because that status will be showing up on your certificate of naturalization. Hence, I would still schedule an infopass and correct this before the oath so that you do not run into any problems afterwards, because you had to disclose your new marital status at the interview. This can cause you big headaches afterwards if you do not correct this now.

    As far as I know the based on marriage to USC application is the 3 years rule. I'm not sure but I think for 5 years it doesn't matter.
    Wait for more responses that can help you about the issue of not telling the officer about your divorce.

    Do you guys know if I have to fill out both?
    I'm thinking I sholud fill out the one i got in person (which is the one I got first and it's prettier ) and take the other one in case they need to destroy it.

    Oh that's a relief, at least you know you didn't miss your ceremony.
    So, today I went to my infopass and it was a big success!!!
    After some time waiting, my brother in law and I went to the window I was being called. The lady there was so nice, she greeted us with a smile and I explained to her what happened and she said, "Oh that happens all the time, sometimes people even forget because, you know we have a busy life." I said, "really? Wow I would never forget something like that!"
    Then she said she would see what she could do and would come back soon.
    After some minutes she came back with a big smile, and said, "are you ready? "
    I said Yes! and she handed me my new oath letter!!!! Yaaaaaayyyy!!! :dance:
    I am so happy.!!!!!! :dance:
    My oath ceremony will be on May 31, that is in 2 weeks!!!!! :dance:
    Thank God everything went so very well, thank to that sweet lady who does her work so very well and VJ members who help us to solve our issues.

    Yay! Just checked online:
    On May 2, 2012, we scheduled you for your oath ceremony and sent a notice providing the date, time, and location. If you move prior to the scheduled ceremony, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.
    Naturalization Applicants: you will receive your certificate at your oath ceremony. You can expect to be scheduled for an oath ceremony within 45 days of receiving your recommended approval. Many offices schedule approved applicants for the oath ceremony on the same day as the day of the interview. Please check the local office profile page on our website to determine if the office where you will be interviewed schedules same day oath ceremonies.
