My spouse is a US citizen. My mother in law is here on a visit visa. My wife is filing a petition for her. She wants to go back and do consular processing overseas. Does her visa end when she goes back or can she come back for visit even while her petition is being processed.

We had received an RFE which was actually to bring original marriage certificate and 3 yrs tax returns to the interview. They didnt even look at that during the interview. However on thing they did ask for and which was not listed in the documents was my wife's birth certificate. Good thing she had it on her. So do take your birth certificate even though they dont ask for it

My wife just got her letter for the oath ceremony. The journey that began in July 05 with I130 finally coming to an end with the oath cermony on 10/09/09. We are done. Thank you everyone on this wonderful forum

According to the USCIS, Houston was processing N-400's for November 2008.. (yes a little out of date but a reference)

My wife is applying for her citizenship based on our marriage. She has been in the US for 3 yrs. The N400 form has a section which asks to list total number of days outside the US. Should we put down only the number of days she has been outside the US after coming her or add the two yrs prior her coming to the US.
Any help is appreciated.

People often go by on hearsay and pay lawyers big sums while the information is out there on the USCIS website
It is simple, sibiling are F4 10-15 yrs
Parents are immediate relatives 1 yr
Unmarried children F1 7-8 yrs
Married children F3 6-7 yrs
Spouse F2 7+ yrs
Does not matter when the petition is approved for family immigration. What matters is visa numbers
What matters for immediate relatives is petition date
For immediate relatives - Unlimited visa numbers
For family immigration F category, around 55000 visas for all categories.
Consider the fact. In US, once child turns 18, they go to college (typically) to different states
Often times at 21 they graduate from college and move to different parts of the country. So the USCIS doesnt care who will take care of a 20 yr old child.

Hello - not sure where to post this question. I'm Canadian and I'm in a relationship with a wonderful man from the US. We are seriously considering a future together. I am currently disabled due to a chronic illness (Fibromyalgia and CFS.) My guy wants me to marry him and move to the US. Do I have any chance of being accepted into the US as a disabled person? Here in Canada I am on social assistance but I do work part-time (very part-time) from my home.
What are our options? Thank-you for any comments.
Disability does not disqualify you. You may not get social assitance and your health insurance costs will be high. But other than no issue. I dont know enough about your illness but you can check on USCIS website about the vaccinations and exclusions.

Sad to hear your case. I think all parents should stay with family.
But law is law and you should have abided by it. Getting a lawyer in 2000 would have made it so much easier. Consult a good lawyer

May be the OP can marry the mother of his child. Still long waits with waivers etc.
Other than that no other way to file a petition. Waiting 20 yrs for child and then file seems like an unsually long time to live in the shadows. There are still some western countries with less strict immigration policies.

Leah, I really appreciate you taking the time to write all of this out. I actually had to read it three or four times to grasp what it laid out.
I still have some questions, if you don't mind.
These are the options you have:-Unmarried
- you file I-129F petition with the USCIS service center, Vermont or California, depends on where's your residence in US.
- The I-129F petition results in a K1 visa for your fiancee to enter US with the intention to marry you within 3 months.
-She then has to adjust status to get work authorization and green card.
So, for instance, if my parents' house is my permanent residence in the US, I can just mail all my stuff to Vermont, and they'll send all the resulting documents to my parents? Do you have any idea how long the above would take.
I should note here, that I talked to my parents today, and, contrary to what I mentioned before, they said that if we have to get married here first, then that's fine. They just want us to get back to the US as easily and quickly as possible.
Married- you can file I-130 petition with the ATI (if you qualify) which is DCF. That will get your wife a CR1 to enter US. She will receive the green card in the mail a few weeks after the visa being activated. She can apply SSN, driver license and can work immediately.
You mention "a few weeks after the visa is activated." How long does it take for the visa to be activated?
-if you do not qualify for DCF, you file I-130 with USCIS service center.-you have a choice of filing I-129F after you receive the notice of action for I-130.
- Filing I-130 alone gets her on a CR1 path.
- Filing I-130 and I-129F gets her on a K3 path.
- K3 was started as a non immigrant visa for spouse who has a pending immigrant visa to shorten the separation period, but for many countries, K3 and CR1 do not vary much in time.
- With CR1, she gets green card, can work and SSN within a few weeks.
- With K3, need to file for work authorization and adjustment of status (AOS), she will get green card when AOS completed, which can take months. Choose K3 path carefully, it cost more, involve more paperwork and your spouse won't be able to start work immediately.
You do not need to be in the US to file any of this, but you need to maintain US domicile.
It's advisable to have a US address and a reliable person to receive correspondences from USCIS, so you can avoid delay and uncertainties of International mailing system.

I'm really looking for the fast way to get back and settled in the US, even if it costs a little more or if it means that my fiance can't work right away. If it costs an arm and a leg, though, we'll have to settle for a slower method.
Your case is very simple. File for I130 with Vermont and then apply for K3. In my opinion it will be March before your spouse can come here. Time flies. Its already coming close to the end of the yr.
Even though with DCF you can apply in Nov, there is approval time, interview date time, affidavit of support etc. You may not gain a lot of time but what if you found out in Nov that you were ineligible.
If you are interested in marrying you GF, why even consider the fiance visa. Your with your fiance right now and K1 will not save you a lot of time.

I know people like the DCF. If you simply get married today, fill out the I29 F and the g235 forms and mail those in, your looking at your spouse coming in on K3 visa by next march. If you DCF in november, your wife coming on CR1, your looking at may time frame
The difference btw K3 and CR1 will be that your spouse has to still adjust status in US with K3 but with CR1 she is already done with the process.
You dont really have to be in the US to file. You can file and then go back to Taiwan.

You still have till October to open new bank account and plus the wait at the Vermont center is long. At worst they will send an RFE and hopefully by that time you can demonstrate significant proof of relationship.
The worst thing to do is not do anything. Even with the 10 yr green card the requirement is to maintain PR here. A quick trip to the border can allow that to happen.

This doesn't sound like an immigration issue. It sounds like a moral issue to me.1. I was looking at your recent posts. What a curious group of unhappy immigrant friends you have. Is it just a coincidence that you have run across such a group of people in such dire straights? Your questions seem always be about protecting benifits after divorce.
2. Your friends husband would not qualify for unemployment compensation if he was fired for cause.
3. If you are really a friend you should suggest to your friend that she get her advice from Alanon. They are more qualified to help with problems involving alcoholism and drug dependency. There is a lot of help available for this guy if he truly has a problem and he desires a better way of life. If she really loved or (loves) this guy she should try to help him instead of just leaving him with his problem.
4. It sounds to me like it is likely that his job loss, legal problems, and marriage problems are all a consequence of his drug/ alcohol problem. If she can help him fix that then she has a good marriage again. You should steer them to Alanon and Alcoholics Anonomous. Your advice, however well intentioned, may be exacerbating their marital problems. I doubt that you are qualified to help with decisions that involve such serious consequences. I don't think you want this on your conscience.

Yes, she can divorce, the only thing is when she asks for citizenship it could come up why she divorced so soon after the green card, in which case she would have to bring wiht her to the interview things that support that her marriage was bona fide or why she divorced. But this is the only thing that could remotely turn into an issue, otherwise she is free to go at any time.... I would probably wait at least three - six months before making the divorce final though, if she can stand that much....
Looks like a marriage for getting the green card. Oh well. Pretty soon they will start giving out 5 yr GC. Looks like most of the posts on this forum are from people who immediately fell out of love or had bad spouses after their 2 yr GC arrives.
Well, I do not share your opinion... of course not only because she is a close friend of mine but also because I have seen her suffering for the last 9 to 10 months or so.... I certainly hope nobody has to go through was she is going through... Hopefully you never have to deal with a spouse that all he/she does is drugs, alcohol and watch TV. That collects unemployment for over 5 months already and has no intentions of looking for one. That the only person that brings bread to your table is you.... I certainly do not wish this for anyone… to have to deal with an alcoholic everyday who has had already 5 to 6 court citations in the last year regarding alcohol and drug issues and his wife had to take him out of jail once already.... I just hope you never had to go through this and if you do let me know cause I would say just the same you posted in this forum: “you just married this person for the green card" let just see how that fells! Let’s do not judge people here... let just get advice.
I am not being judgemental. You urself said in your post that she is sticking it out for the GC. Out of curiousity your friend did not know the person prior to marriage?
Why are all these people making life for the rest of us difficult. Meaning the people who take their time to get married to the right person. As opposed to the people who just jump into marriage. This forum is filled with people who are constantly writing about one thing. They had all the the love but as soon as they came here, they find the spouse is a drunkard or whatever. This forum is also filled with people (check K1) section who are so in love and they have only met each other once.
You can call me whatever. The fact remains that there is a growing number of marriages that are breaking up prior to the removal conditions. With the anti immigration environment prevailing the country, very soon people will start complaining and USCIS will tighten their rules.

It seems that so many marriages are falling apart regardless of who is at fault. People usually have good intentions to begin with but uscis may start analyzing this and consider them fraudulent marriages slowing the process down for everyone.

This is a tough one. Very hard to show the sincerity of marriage. Consult a good attorney. It may be simply easier for the fiancee to go abroad and apply for CR1 visa rather than go through this process which could become long and very expensive.
The people in this forum may understand the intention of marriage but but if your fiancee hasnt been able to convince the judge yet because of a lack of evidence, it may be easier to start to voluntary depart, go back to home country and start with a clean slate.

Thank you all for the advice, I think it will be easier to just wait it out. In the event they do ask for additional evidence, we will just send in the birth certificate of our child.

We just had our first child on July 4th. We have already sent in the I751 form and my wife has had her biometrics done. Do we have to send in any other forms. What should we do.
