    Hi!
my wife (she is the us citizen) and I used only assets to sponsor my spousal visa.

my wife didn’t have any us income at all, and for spouses the requirement is only 3x the difference between income and poverty guideline.
so it sounds like you have enough assets

however, it all depends on the consular officer accepting the I-864 and I’ve read on here that some embassies are stricter than others. I don’t know about the Philippines, I am from Germany and our I-864 was not even questioned during my interview in Frankfurt.
Only our household size was confirmed and it was confirmed that we are using only assets to sponsor, that was it.
it was accepted without any problems, no RFEs, no delays.

Expect to have a case note on ceac saying the sponsor doesn’t meet the income requirement and a decision will be made by the consular officer.
But it does not keep you from getting DQ.

you can always take multiple I-864 to the interview - first try with your assets only, if the consular officer doesn’t accept, give him a different I-864 with a co sponsor. 😊

I doubt @ROK2USA did that and she was successful.

People achieve DQ with warnings about insufficient incinerator all the time.  I see it at least once a week.

    Take a look at I-864 instructions https://www.uscis.gov/sites/default/files/document/forms/i-864instr.pdf

    Page 12, sections:
    - What if I Cannot Meet the Income Requirements?
    - How Can My Relatives and Dependents Help Me Meet the Income Requirements?
    - Can the Intending Immigrant Help Me Meet the Income Requirements?

There's also Part 7 (use of assets to supplement income) section of I-864 that you can take advantage of.

    Hope that helps.

    Hello,
Just got an approval on February 15, 2023.

    Here's my timeline.

    Applied 1/29/2022
    NOA 2/9/2022
    Approved 2/15/2023
    NVC notification 2/19/2023
Paid fees for both AOS and IV 2/20/2023 (status for both were in process after payment but when I logged back in, AOS is showing PAY NOW..... Should I just check back after few days? hopefully it will process)

I'm currently gathering documents and was wondering for those of you who already submitted the AOS documents and evidences, did you include 2022 documents?
I'm worried because I'm currently not working since November 2021 because I have to care for my newborn. I was planning to go back to work once my mom arrives here in the US. My husband will be a joint sponsor for the AOS. He is currently an active military personnel. I was wondering which category are we going to be under in this poverty guideline:

I don't think our household income is enough if we are under the 125% (if it's based on 2022 income).

What could be our other option?

Thank you for your advice and good luck to everyone.

Thank you. I can definitely apply for her passport now.
To make things more complicated though...
...I had my daughter out of wedlock. Now I'm married, and would like my daughter to use my husband's name. She is still using my maiden name. Is it possible for her to use my married name when we apply for passport or would that be a different process. Just checking our options.

    1.    Accompanying persons
Attorneys are not permitted to accompany clients into the waiting room or to their interview. The following persons may accompany a visa applicant to their interview:
Applicants may bring ONE interpreter if they do not speak English or Filipino well enough for an interview. Applicants may bring ONE person to help if they are elderly, disabled, or a minor child. 2.       I think that for a minor with a complete and approved documentation questions might be very simple. Names, DOB, School attended. Perhaps the last time you have seen your parents. Interview should be than 15 minutes or less.
    3.       Pre interview checklist: You can find all the steps and documentation needed related to your case.
    U.S. Embassy Manila, Philippines - MNL (state.gov)
    4.       FOR MEDICAL:
St. Luke's Medical Center Extension Clinic Ermita, Manila (slec.ph).
    5.       She can be the guardian.

    1.  No
    2.  Answered by other poster
    3.  Age appropriate
    4.  Originals of her documents not the petitioner
    5.  Depends on how busy.  Typically 3 to 4 hours and 1 to 2 on day 2 (recent reports indicate that SLEC is getting everything done in a single day).
    6.  Should be

The green card will be issued in the name on her visa, which must match the name on her passport.
If she wants to have a green card in your surname, she needs to change it in PI first (and get a new passport under that name).

most likely, your daughter is already a US citizen. You can apply for a US passport for her.
Doesn't matter where you change the name.

I got the biometrics not required letter on the 12 of this month too. Does anyone have an idea of when we can expect some progress on the 10-year card itself at CSC?

    Hi all!!!

I finally received the bio letter. ss# box was blank and it only had my A#.
No bio appt required they will reuse my biometrics and the fee won't be refunded.

    Letter dated 5/5/18
    received on 5/14/18

Prayers for all of us in this journey. Everything is in God's hands. Amen!

I didn’t call them at all, not once, and still got the letter. The only thing I did was do 1 online inquiry back in March to which they responded. I’ve just been waiting in silence since then. I’m not too antsy though since citizenship is our ultimate goal and will move forward to the next process next year whether this one is done or not.

I dont think its a way way to shut us up necessarily, I think they are trying to get the ball moving even if it means reusing biometrics for some of us.

Got our biometrics letter. No appointment for Luis. It says:
"USCIS has received your form and is currently processing your application. This notice informs you that USCIS is able to reuse your previously captured fingerprints and biometrics. USCIS will run the same security checks and use your biometrics data as in the past, , it is NOT necessary for you to appear at a USCIS ASC for a biometrics appointment. The biometrics fee will NOT be refunded."

So technically we received our Bio Appointment letter to be told we don't have to have an appointment.
Please update our information in the spreadsheet.
    Thanks!

I too received a Biometrics letter on 05/11, saying they were using my prints from last time so I don't need an appointment. Kind of annoying that they just take that money, but I guess at least I don't have to drive a five hour round trip anymore!
