  1. Hello,

So after a month long week after I sent my AOS package, I got my application back in the mail with rejection notice reason of "declined credit card".  Now will I have to send my whole AOS application again ? Or just send the authorization form of fees?

I don't know what was wrong with the credit Visa card. It's still valid and working with me.

Is it better to send debit card information on the form that is linked with my checking account or is it better to send a Money order with the application instead?

My checks were cashed two days after they texted me to confirm receipt of the package, so that's 13 days after I mailed it. Did you track delivery of your package?

Mine is nothing so far. It's been 3 weeks.  No notices no email or cell phone notification.  My credit card account doesn't show any transaction from uscis.

Idk what to do? Is there a way to email or call them?  Or should I just resend my package again?

  3. I sent my AOS application like 2 weeks ago, and I didn't hear anything from USCIS. It seems like they didn't make any transaction for the $1250 fees yet from my credit card.

How long does it usually take?  I am afraid if they haven't received my package? Or my credit card transaction got declined?   Not sure what's going on and how to confirm the status of my package. Thanks

The biometrics will be scheduled at a specific office that is linked to the address you use when you file.  Most of the forms ask for both a physical address and mailing address (which for most people would be the same).  In our case, my wife was invited for biometrics at our mailing address.

If you are in Michigan most of the time, if your mother's I-130 was already approved, I can't see any advantage to staying with the Washington address.  Your new forms will be a new process and I don't see how changing the address will make any difference.

That makes sense. I'll keep it Michigan then and if she happens to be in Washington when we receive the biometrics notice. I'll have her travel to Michigan for her biometrics. Hopefully they give enough notice for biometrics appt. so we can arrange traveling etc.

As previously, location of medical exam doesn't matter.  Is there any advantage to staying with Washington?  Do you intend to return there?

As Old User said, she will need to appear for biometrics, and if there is no one to receive your mail you will have problems sticking with Washington.

In my wife's case, USCIS sent everything to our "mailing address", while we were actually at a different "physical address".  I decided not to change it to avoid any delays.

I believe address can be changed online.

Great to know. She is living between both Washington and Michigan. Can biometric be done anywhere? Or has it to be same uscis office we filed at ?   I hope it's convenient to attend at any office for biometric.

For the interview depends on where she is, it's okay if she traveled to it once.

@Dantrolene also remember to include fee free forms in your packet: I-131, I-765. You may think you may not need them now, but you never know. Plus they're free.

Will do. So my mom's I-130 got approved while she was overseas and I was at old address in Washington. Now we are In Michigan and want to about to apply for AOS in few days.  We still have family home in Washington.  So, Is it better to stick with Washington address or request to move the case to Michigan ?  We got the medical examination done in Washington.  Processing time is faster in Michigan.  My understanding is that I need to fill a form to request address change if I'd like to, so can I send that form via mail too with AOS package or that form can be filed online ?

1 - check. Just make sure you have enough funds in the account and it's written clearly.

2 - anywhere if I am correct. But it needs to be from a provider USCIS recommends

    3 - include everything together

quick question here for you if u know answer to,  will I need to submit AFFIDAVIT OF SUPPORT form again with my mother's AOS package ? Or the one I sent with her I-130 form before is enough ? FYI her I-130 form is already approved while she was overseas. Now she is in the US and seeking AOS process. And I see in the AOS checklist is to submit affidavit of support form, so just check if I need to resend it..

  8. Quick question here

It's been approved. The processing is a bit weird. The decision upon I-130 rests with USCIS no matter what, they approved it and the form remains theirs. They just forwarded the part of issuing the visa to the Department of State. The thing is that you can at any time take the case and have USCIS process an adjustment application regardless of whatever DOS is doing.

What you are referring to is what's known as the "90 day rule", which is a weird thing that DOS abides by and USCIS doesn't. USCIS will let her adjust just fine, but if she were to abandon the application and later try to seek an immigrant visa then DOS will do a lot of hand-wriggling and basically accusing her of immigration fraud. So yeah in this case, if she files for AOS she needs to stay in US at least until USCIS approved her I-131.

Yes, I-765 and I-131 for EAD and Advance Parole. They're free if filed with I-485 or while one is pending.

No, the approved I-130 doesn't have to have anything done with it. The correct thing to do would be to write to NVC that your mother will instead apply for AOS and to close the case they have going on over there, but this is more of a courtesy you'd give to the government so they won't waste an interview slot, it's not a hard requirement.

quick question here,  will I need to submit AFFIDAVIT OF SUPPORT form again with my mother's AOS package ? Or the one I sent with her I-130 form before is enough ? 9. Ready to send my AOS package, and wondering about these:

1- Better to pay the fees with debit card or credit card?  I am afraid if credit card denies the USCIS transaction for any reason..

2- can I do my medical examination in any state ?  I am filing from Michigan to Chicago office. so can I do my examination in Seattle ?

3- Is it better to wait until I get the medical examination form ready to submit it with AOS package ? Or is it okay to send it separately 2-3 weeks later  ?

I-485 processing time depends on the USCIS local field office that has jurisdiction over your area.  Estimates are posted here -- https://egov.uscis.gov/processing-times/

As for the EAD work permit, some have gotten it within a few months, while some had to wait over a year.  There's no guaranteed timeframe.  So that's another factor that you and your mom might want to consider.

It says Seattle ( original address)  takes about 23 months.

If we decide to move to Cleveland it takes only 13 months. Can we easily change address on the applications and move to Cleveland for quick process ??  I am flexible on moving since my job is flexible.

What matters is the I-130 approval notice from USCIS.  The notices from NVC don't matter anymore if you and your mom are set on the AOS route.  Whether it's the right thing to do, depends on your circumstances.  Like I said, if your mom is fine with being stuck here for many months and possibly not leave even for family emergency, she can go ahead and file for AOS.

Thanks a lot. I'll do as directed.  One last question, how long does it usually take processing time until she gets her GC?   There is no rush for her to travel, but work permit is needed.

No need to wait.  Just be aware that once she files for AOS, she could be stuck here for many months, if she doesn't want to abandon the process.  It's currently taking 8 months or so for USCIS to process I-131 for AP travel permit.

Yes.  Request that the approved I-130 be sent to USCIS for adjustment of status.  Send the request to NVC only after you get the I-485 receipt notice.

I was little mistaken about something, now her I-130 has been submitted and NVC has given her notice receipt and case number and it's been processing for about 4 months now. They recently sent me a msg on the CEAC portal asking for my W-2 forms, I submitted that already about a week ago. No updates yet.  Does this mean her I-139 has been approved but incomplete or not approved yet ?  Despite this fact, do you think resuming with AOS right now is the right thing to do at this moment ?

*** Moved from Bringing Family of USC forum to AOS from Work/Student/Tourist Visas forum -- topic is about AOS of parent already in the US ***

What you want is Adjustment of Status (AOS using form I-485), not Change of Status (COS using form I-539).

Have your mom file forms I-485, I-765, I-131.  Of course, you may file them on her behalf, but she must be the signatory.  Include a copy of the I-130 approval notice in the package.  Also, she will need an updated I-864 and financial documents from you, even if you already submitted them to NVC.

    Thank you.

So she has been only here for 1 month now. I heard some say wait for 3 months then have her adjust the status? Is that true? I just would like sooner than later for quick process, if filing before 3 months won't hurt her case.

I am assuming forms I-765, I-131 for employment and travel permit correct ?

Also her approved I-130 doesn't have to be reinstated, right? Shall I inform NVC about adjusting the status so they don't send her application to the consular embassy at home county ?

  15. Hi. I filed 1-130 for my mother while she was overseas back home. Her case got approved at the NVC center and waiting for the interview to be done at consular home country. No scheduled yet.

My mother visited me here on tourist visa like a month ago and I'd like her to stay and continue her case here.   What to do? How to move the case from her homecountry to have the interview here?  Does she have to start a new application here, or change of status application is enough?

I appreciate informative factual thoutghs.  Thanks

Your online account should continue to work. This is your account for many other things too (for example, filing to replace your Certificate of Naturalization).

You can register to vote online at https://www.sos.wa.gov/elections/register.aspx. Note that today (March 2) is the last day to register for the Primaries election on March 10.

Great to know thanks!! Will I be able to vote ONLINE for all primary and presidential election or it's got to be mailed at some point ?

  17. Hi Y'all, now I am a USA citizen. I tried to log into uscis account but keep saying invalid entry despite my certainty of username and password. Is it because I am done with this journey they closed my online account ? I would like to have access to my online documents I uploaded.

Second question, I would like to register to vote, but I am wondering if I can do the whole voting thing Via Email only?  I don't like to get anything in the mail since I am moving and traveling frequently.  Please let me know if I can register online and vote also in November online as well!?
