Shadaryia got a reaction from London Rain in AOS completed and sent off!
Thursday evening we met with our immigration attorney and finally after 7 years filed/applied for my husband to get his green card.  AOS package was mailed to USCIS Friday 10/22/2021.   We had to move 2550 cross country for me to make enough yearly to sponsor him and then saved up the money for the lawyer and immigration fees.  Now we wait and pray USCIS approves us after the green card interview that should take place 10 or 11 months from now or so…. I’m nervous to say the least.

My husbands AOS papers were mailed Friday and I got the text today saying USCIS received his package and gave us his receipt #.
I immediately put that number in the case tracker app I downloaded on my cell phone and now will be watching it like a hawk!
I don’t want us to miss anything, like his biometrics appointment.

Thank you for your kind words!  I often regret posting on VisaJourney because I often feel attacked.  You have brightened my day! You are very appreciated!    I am truly doing my best.  Yes, I have made a lot of mistakes over the last 7 years but I am truly trying to fix it all.  Money is a huge factor unfortunately.     Thanks again and have a wonderful day  ❤️

I don’t think you need to add fear of the IRS coming after you. You have enough stress on your plate trying to finally do the right thing about immigration and save up your money to pay for it. The IRS won’t “come after” poor people when they could spend the same resources to go after wealthy tax evaders. You can get straight with the IRS later.

I agree with others, you can’t be Head of Household. You’re not a single mom (an example of someone qualified for HOH filing.). Your earned income credit is a consideration which you can’t claim on a joint return if your spouse has an ITIN. You also can’t get it if you file Married Filing Separately. So basically who ever prepared your taxes did it fraudulently OR you failed to tell them you were married and lived with your husband. Amending to joint after he gets his SSN is the only way you can keep your credit.

Nobody knows how long it’s going to take. Things are so pandemically backed up. You are applying for EAD so that does allow a SSN when approved. I think you just need to drop the panic over tax returns as proof of your marriage. When he gets a SSN (after EAD), then get straight with the IRS. If it works out that you get to amend and take joint tax returns to the greencard interview, then it’s a bonus. Just go with what you can to prove bonafide marriage. They probably are not going to be as hard on you as you anticipate. He’s legally married to a US Citizen.

I am new to all of this but for me I would bring what I already submitted when filing to the interview as well as any new income like the last month's pay statement you mentioned.  I printed my paystubs for the last 8 months so far just because I am anxious.   I wish you the best!

Shadaryia reacted to HRQX in Is I-693 Deficiency Notice different from RFEs?
That is only temporary. I.e. for when the I-485 decision is on or before September 30, 2021. https://www.uscis.gov/policy-manual/volume-8-part-b-chapter-4
Effective August 12, 2021, USCIS is temporarily extending the validity period of an otherwise valid Form I-693 in cases where:

    The civil surgeon’s signature on Form I-693 is dated no more than 60 days before the applicant files Form I-485;
No more than 4 years have passed since the date of the civil surgeon’s signature; and
The decision on Form I-485 is issued on or before September 30, 2021.

So it'll be valid for 2 years if the I-485 decision is after that date.

The letter clearly says: "DO NOT MAIL DOCUMENTS AT THIS TIME"

Do what the letter says.  If it says trail it in do that. If it says bring it to the interview do that. It's not hard.

    Hello!
I have been going through married based AOS from F-1. We filed in March, 2021 and already had biometrics in July.
After the biometrics, Status(fingerprints were taken) has been the same for over a month now, and Today I received an Pink letter from USCIS for the I-693 Medical Exam Deficiency Notice. I know there is nothing we need to do at this point until the interview appointment,
But Is this letter different from RFEs?

The date they sent out this was August 19th, and My case status has not changed ever since biometrics in July. I am just curious if I will receive another RFEs, or If they completed the review and possibly change the status to Interview is Ready to be scheduled, other than sending me another RFEs.

I know it’s a confusing question, but I am curious if those who got this letter didn’t receive any other RFEs.

Thank you, and Good luck to you all!

take the medical exam and submit it
some on here have been approved without an interview
may or may not be the same with your case
but anytime USCIS asks for a document ,  do it

Sent in the I-485/ I-864 last December. I'm retired military and don't get a W-2 and didn't have tax transcripts so I sent in the annual 1099-R statements and my  own copies of tax filings. The 1099-Rs show plenty of income. We received no RFE for further documentation. We have our interview in a month and the appointment letter is a form letter so requesting the same as anyone else gets.  So, I 'm assuming they're happy with what I sent. Am I fine with just bringing the same stuff although with one additional 1099-R for last year and maybe this last month's pay statement showing the year's pay so far?

I don't see a fishing license on the "B" list.  How do they verify that factual information is on a fishing license?  It seems to me that getting a state ID would be easier after getting a green card.

Residents who can provide the identification documents they require.  OP's husband has been "hiding" in the US for 7 years -- no DL from the UK or anywhere else, no bank account, no lease agreement.

We signed the marriage application.  Our marriage license doesn't show our signatures.   The WA state DMV wants to see my husband's signature as proof of identity.

Hi Shadaryia! I see that your field office is in Portland, OR which is also our field office! We have our AOS interview in September and we've been married for over 2 years. If you can afford doing the medical now; then by all means I would recommend that. We didn't do the medical form when we filed, honestly didn't make sense because of our insurance at the time and our financial situation which has since improved because I've been working with my EAD. I'm now finishing the Medical form and tomorrow I have my last appointment with the civil surgeon. We'll keep you updated on how our interview goes since yours will probably be in the same office! We're also wishing you the best in this process!

A Power of Attorney. You can do that for each other and it will be great evidence for the AOS even if it doesn't work for getting an ID. Same goes for living wills. Also probably has more weight than an ID for address purposes.
