  1. Hi,

    I'm currently 3 months pregnant and really want to go home (UK) to give birth. Will this create a lot of problems when bringing the baby back to America? I'm currently of Permanent Resident Status and my husband is a US Citizen.

    I understand that with certain airlines you have to have a doctor's note for travel and this can be arranged by my with OB/GYN. I plan on going before 4 weeks of giving birth and stay in the UK for a couple of months after. Does anyone know where I can obtain some information on what I need to do to fulfil this?

  2. Just want to rant!

    I called the premium rate number (US Embassy in London) and got through to an automated phone tree. I selected my option and was left hanging on for 5 minutes waiting whilst being charged £1.20 per minute. In which time, the voice tells me I am being charged £1.20 per minute.

    Do NOT call 30 mins before closing hours, they don't pick up the phone!!

    I waited 5 mins whilst trying to connect to the consular I needed to speak to and nothing.

    This bullshit is so frustrating!

    Call the airline and see if you can reschedule your tickets to a later date and what is the latest you can reschedule. Perhaps there is no penalty to reschedule or just minor penalty. Have all of your options in hand for piece of mind. Good luck.

  4. I have epxlained to the Case Worker that the IV15 Instructions leaflet states the following:

    BIRTH CERTFICATES: A person born in India or Pakistan must present the registration certificate of the birth was registered. If it was not registered, either in the locality, or, if a Christian, in church, sworn affidavits may be submitted. Such an affidavit must be executed by the mother before an official authorized to take oaths (i.e. a migistrate, commissioner of oaths, justice of the peace or the like). If the mother is deceased the father may swear to the affadavit.

    I dont know if this is a factor.. but it is showing one possible difference.. On the Instructions.. It specifies two Countries.. Pakistan and India... you were born in Vietnam... Is there any regulations that is for your country of birth?

    It seems to me you are looking at directions for persons of a different country to provide proof of birth in countries where many times there is not a record of birth.

    I am not meaning to say different countries different rules.. but .. from what I have learned here.. is.. every embassy has different requirements.. and thus .. Apples vs Oranges.. never are the same.. ..

    India and Pakistan were used as examples, I checked this with the Cosulate via email already. They even said, it's fine to get my dad to do the Affidavit.

    Can anyone tell me, that when they request for more info. Would I need to be re-interviewed or do they review the info. then decline or approve the application? How do they inform you of this?

    I attended my K1-Visa interview and was extremely frustrated with the recent request for "Proof of non-existence of birth certifcate".

    As I have mentioned to the Case Worker, I was born at home in Vietname and my mother had never registered my birth. And therefore she had written the Affidavit to confirm this.

    I have epxlained to the Case Worker that the IV15 Instructions leaflet states the following:

    BIRTH CERTFICATES: A person born in India or Pakistan must present the registration certificate of the birth was registered. If it was not registered, either in the locality, or, if a Christian, in church, sworn affidavits may be submitted. Such an affidavit must be executed by the mother before an official authorized to take oaths (i.e. a migistrate, commissioner of oaths, justice of the peace or the like). If the mother is deceased the father may swear to the affadavit. The affidavit should indicate: 1) the applicant's birth was not registered; 2) the full maiden name of the mother of the applicant; 3) the full name of the father of the applicant; 4) the date of the applicant's birth; 5) the place of the applicant's birth. If neither parent is alive, the next closest relative, who was old enough and of such relationship as to have personal knowledge of the birth at the time and place it occurred, may execute the affidavit.

    I have followed your instruction and I do not understand why you are asking me to provide proof that I do not have a birth certificate. If this was crucial then WHY was it not in the Instructions leaflet? WHY does it say in the IV15 Instructions that the Affidavit was good enough? WHY did you not ask for this piece of evidence BEFORE my interview so that I may have collected it before attending the interview.

    I am very upset and frustrated that my fiance and I have applied for this visa since the first week of March 2006 and to date it is still NOT satisfied.

    My flight has been scheduled for 6th January 2007 when fiance will leave England to go back home and I have planned to go with him. My wedding date is set for 10th February 2007 and now this might not happen!!!

    I appreciate and understand the need for thoroughness in your reviews but it is very frustrating and above all very concerning that you are requesting information that you should have informed me of before attending the interview! Not only is this time consuming but also costly as I would have to pay for the translation. I fail to see why you would need this piece of evidence?!

    I implore that you re-look into your decision as I have already asked the Consular (who had requested this piece of evidence) that in the situation where the staff at the Vietnamese Birth Registry Office is unco-operative and refuses to write a statement, what would I do? He simply asked me to "Try my very best!". That is not very comforting and neither is it constructive.

    I fear that if I present this piece of evidence, what other pieces of evidence you require from me? The process has already taken ridiculously long and I am beginning to believe that the system is penalising people who are genuinely walking on the right side of the law.

    Please can you contact me on the outcome of my case. My fiance and I have been apart for over nine months. I don't think anyone should be apart from their love ones for longer than an hour, I hope you would agree.

    I would truly appreciate any assitance you can provide for me.

  7. I started out terribly with forgetting my interview letter, luckily my brother and fiance managed to work together to get the letter scanned and emailed to me.

    Getting to and waiting for the interview was the easy part. There were two stages to the interview, the first was the checking of all documents to ensure that they were all present. This was done by one Consular. She went through all me details and was happy with my paperwork including the Affidavit in place of my Birth Certificate, which I had stated that I was born at home and was never registered.

    Then I waited for the second part of the interview where another Consulor asked questions about my fiance and I. Everything went well and he ticked, clicked and nodded with everything. Until he presented my Affidavit asking why I do not have a birth certificate, to which I explained (as above). He noticed that the Affidavit was notorised in Vietnam which I had told him truthfully that my mother is on holiday there. He then asked me to tell her to contact the birth registry office in Vietnam to get proof that I was not registered!

    I thought to myself, #######?! I said to him, why would you need this? I do not understand. On the IV15 form it says that an affidavit was good enough if I do not have a birth certifiate. He said, he still needs to be sure that I do not have a BC. I asked him what happens if the staff at the Registry office is uncooperative and refuses to do the confirmation letter??

    He simply said, try your best. Then added, I will contact the US Embassy in Vietnam for advise.

    I mean, #######?? Is he a moron??? How can I request something that I do not have/own?

    Do you think I should email the Consular, re-iterating the above and request that they re-look into my case? Or should I just grind it and ask my mother to contact the Registry office for a confirmation letter?

    My fiance is coming over on 24th December and leaves 6th January 07. I was really hoping to go back with him and prepare for our wedding on 10th February.

    I'm so stressed out.

    Can anyone please tell me what the notice period is for the K1 Interview?

    I've had my NOA2 since August 19th and still no interview date. All the paperworks including the Checklist have been sent to the Consulate in Britain in mid September and we've still not heard anything.

    Well, my NOA2 was dated 31st July. My paperwork was sent in mid August and my interview was on the 3rd of October.

    I think you should email the consulate or get your fiance to phone the DOS to find out what is going on. I'm sure there is nothing to worry about but it might put your mind at ease. :)

  9. My mother has been on holiday for over a month now and she won't be back until mid of December. My interview date is due at anytime now and I have asked my mother to go and get the affidavit notorised in Vietnam (where she is currently on holiday).

    I'm worried that this might be a problem being that a Vietnamese notary notorising the affidavit instead of a British. Can i ask if anyone has had any experience with non birth certificates and how the Consulate treat such cases?

    Any help would be grateful.

    I have sent an email to the US Consulate for their opinion in this matter and have also asked if my father (who is currently in the UK) could write an affidavit in my mother's place to confirm my existence.

    Also, is getting the affidavit notorised by a Notary the same or different from having the affidavit sworn in front of an "official authorised to tae oaths"? I hate these semantics. :huh:

  10. Another question that I have, when you send off the forms for Package 3 are you supposed to get a confirmation from the consulate? I sent the forms off 1 month ago and have not heard from them. Should I worry? :unsure:

    I have just emailed them (LondonConsular@state.gov) with my case number. I hope they've received everything.

    Just wondering that once the check list for package 3 has been sent to the consulate that we have collected all the relevant documents such as, police record, birth certificate etc. How long before they contact you for an interview date?

    I am hoping to be interviewed by end of November at the very latest because I'm looking to leave the UK by January 6th 2007 (assuming that all goes well).

  12. If someone can please help or give advice???? I am a U.S citizen and i have been dating this girl whose student visa expired. I was tryin to find out the best way of getting her legalized. I dont want to send her back and she doesnt want to go back. She has family here, but not her parents. If worst comes to worst, i would go back with her to her country but when we get married how will i get her to come back to the states. Would it be better to get married her or overseas??? Any advice is welcomed. Thanx

    If she is currently in the US, marry here and submit I-130 and I-485 to adjust status. She should NOT leave the U.S. until after AOS is complete and she has permanent residence. Her overstay will be forgiven upon a successful AOS, but won't be forgiven even if she has Advance Parole at a POE.

    I would agree with this too! :thumbs:

    You should get married and apply for AOS as long as her initial intent of entering America wasn't for marriage, which it wasn't (because she was on a student visa).

  13. Hi All,

    I'm Beneficiary and have received the following forms: DS-230 part 1, DS-156, DS-156K & DS-157.

    I have filled them out however was wondering whether there are examples of how to fill the forms correctly? I'm worried I might miss out vital information and there are parts where the information requested is really confusing.

    For example, DS-230 Part 1 form question 14 asks for Name of Spouse. Are they asking for my fiance's name or the name of my ex-husband??? The way they asked for information is really out of context.

  14. Apply for a PETS passport before you go! It's not required (our cats only needed a current rabies jab and a certificate of fitness to fly in order to get into the US) but if you ever want to go back to your home with the cats, having the passport makes it a lot easier! Currently our cats are waiting out their quarantine period for the UK and we can't bring them home because we didn't think ahead.

  16. I have no idea what's going on with my case. I have not heard anything since they transfered my case to CSC. NO TOUCH ..NO RFE.

    I did make a call to CSC. They only say not everyone will get RFE. That's all that they can say... Also contacted senator,they said they can not help anythinng,everything itself is in processing.

    Seem like I am only one who has not gotton that RFE. I guess my file went in the bottom of the pile and just waiting for them to pull it out someday that they feel like to.

    My wife is in 6 months pregnant. We want to have to baby born in the USA. But it's impossible now.

    They dont know how they screw up our life.!!!! This is crazy !!!! ...

    My fiance said that you can get your case expediated because of your wife's circumstance. I would get in touch with your congressman etc asap!!
