    USCIS' automatic case check isn't really all that reliable in the first place. I wouldn't be surprised if they haven't updated it to recognize IOE cases. If your case is still within what USCIS' website says then that'll be the standard reply you'll get from them every time you call until the case is approved unfortunately. Though sometimes they can tell you if it's been interacted with or not

    Yes, we are in Texas. PD April 29. You would think we should be approved by now, but unfortunately it is not the case...

    If you have preconceived intent to marry and complete AOS when you enter on a B1/2 visa that is considered immigration fraud. There is a loophole though where a person could come to the USA without preconceived intent and make a decision to get married and AOS and it is on USCIS to prove otherwise, if my mind serves me correctly.
     
    Here is my story:
     
    When my now wife and I were convinced that we were going to move further in our relationship and it was going to become more serious we looked at both her immigrating to Canada and me immigrating to the United States we looked at our options. We decided that the K-1 would be the most moral as if either of us entered the others country there would be a chance we did not get admitted due to getting married. We felt that the K-1 was the best option for us and pursued it. 5.5 years later I am now a United States Citizen and helping others on this wonderful forum.

    I disagree with this. Unless you have some evidence other than your hunch on this matter.
     
    Thinking about this from an organization's point of view - people have been receiving and scanning and adjudicating paper applications. Now, the new e-filing has to adjudicated differently on a new system. Ideally, some select employees would receive training and be moved over to the e-filing processing, with more and more employees being trained and transferred over time depending upon the volume of e-filings.
     
    Now this could fast-track things for e-filers, since now they can directly be sent to a special "e-filing" line with some folks working on adjudicating e-filings only. Hence, making the process fast.
     
    My theory can be verified by checking if any filers have been sent to Nebraska yet? My guess is it is the slowest center so it has the least people it can spare to go to trainings and be moved over to e-filing.

    Hi November Filers of i130 ! I have sent the i130 to  Texas Lock box on 22nd Nov and it was delivered on 25th Nov. Received NOA1 on December 3rd with priority date 11/22/2019 and routed to Potomac service center.

    I filed online back in September and was sent to CSC. I guess it is still random even with the online filing...

    Hey Darth, I am the USC and we actually both are living in Hong Kong but my spouse has AUS citizenship. 
     
    It is weird indeed but there are lots of things we speculate on during this long process haha. 
     
    Oh and yeah I've seen others who have filed online and gotten Nebraska service center...

    1. my husband and i had initially applied for a k1 and the petition had been approved. we then changed our minds and adjusted from VWP. On the i 130, i did say yes, and on the 'additional information' sections - explain that a K1 had been previously applied for and was iat the interview stage. At our AOS meeting, the officer asked about it, nodded, and went on. not a problem.
     
    2. If you are issued an RFE and they do not like what you sent, odds are, it will be denied - especially if what they asked for was not included in your response. They do not typically issue another RFE for something they already issued one for.

    It appears this is quite common across the board, at least for all paper filed IOE receipt holders.  I can only see most of my 130a form and my passport pics...  I wouldn't worry too much, and I would not upload anything you sent if you don't see it in the tiff file/scan.

    When I logged in for the first time a week ago, I noticed only a small part of my documents were scanned, I’m assuming since it was recently received, it was likely in process and more would be uploaded later. I decided not to freak out right away. I haven’t logged in since so I’ll check this week. I filed paper on Nov 12 and received an IOE receipt number. I have two exact copies of the petition on hand just in case 😝

    Ah well you can't send anything unless the USCIS gives you an RFE and then you answer that as requested.  Until then, try to give up control and stop worrying.  Easier said than done.

    1) The pilot program was around May-June, but the pilot program has ended, and now every filer since around June-August receives an IOE receipt. If you check one of the K3 threads I think there is a thread for IOE I130&I129f filers
    2) As far as I know, I129f is paper only

    I know but it’s crazy I seen someone who was at the Nebraska center get a proved in three months and received her case number in one month. So what’s really the deal. I know she sent her 129f but she didn’t have an IOE so is it really over.

    1) Right now so far, it has not worked for IOE/online petitions. There are some who have tried, but no response I’ve seen so far. But who knows, no harm in trying
    2) Imo, best to wait until after you’ve gotten the I130 NOA1. No point in sending an I129f if you get Texas or Potomac

    Yes the I129f is the reason for quick I130 approval for many with LIN numbers (with other reasons being emergency expedites). Unfortunately so far there’s been no movement on IOE cases with I129f. But there’s always a chance and there’s no harm in trying as I129f is free with a pending I130

    Even if you file by paper, the petition will still be an IOE being processed electronically as all I130 petitions are now IOE petitions, so it would be the same as an online. As of yet neither online nor paper petitions with IOE numbers have had I129f work. But like I said, no harm in trying

    I have no idea of the number of chances you get, but seeing as there are very few options that Montreal will accept, it wouldn't be long before the only option remaining is for the USC to move to the US. Also, bear in mind that the medical is only valid for 6 months. So continuously responding to RFEs will make it more likely that a new medical will be required.

    My guess is that would have more to do with the overall financial situation of the couple involved.
     
    The point was though, that no job does not mean no visa. That should be clarified for people reading this thread in the future.
