    Please don't waste time going down this path -- there is absolutely no (legal) pathway to a CRBA for a child born in 2021 if you did not naturalized until 2022.  If theses dates are correct (child born in 2021, you natuarlize in 2022), i am 100% sure there is no way the child qualifies for a CRBA.  It is dangerous compare your case to someone else's and do what they did, assuming that everything in both cases is exactly the same as it most likely are not. 
     
    Inform the Consulate immediately that you naturalized right after the visa interview, not realizing what that meant for your the visa categories.  Ask them to please approve you filing the I-130s for each child at the Consulate.
     
    The good news in the situation is that once your children enter the US with their immigrant visas to live with you, under the Child Citizenship Act they automatically become US citizens.

    I have read it.   Care to explain why you continue to insist that a child born a year prior to OP’s naturalization would be eligible for CRBA?   I would genuinely like to know.

    Now that makes sense.  Technically, the income qualifies but you have some very big other issues working against you in terms of actually obtaining a visa.  Your wife is 38 years older than you, and you are a native of Ghana, probably the second highest level of US immigration fraud in the world.  (Second to Nigeria)
     
    The combination of much older, female, low income petitioner, and a male from Ghana fits a very common fraud scenario.  A joint sponsor is not going to overcome that.  The only thing that really can, is evidence of lots of time spent together in person.
     
    How much time have you been together with your wife in person, total?  How many visits?  How long have you been married?

    A green card is not a tourist visa. 

    Visiting family in the US twice a year is NOT enough to keep your green card for a couple of years.   You would be violating the purpose of your green card and it could be revoked.  

    A green card is for living in the US.  Once you get a green card, you will need to report your WORLDWIDE income to the US and it will be taxed.  You have to LIVE IN THE US WITH A GREEN CARD.  THAT'S HOW IT WORKS.  
     
    If you are not ready to MOVE TO THE US, then keep your case at the NVC.  Update once a year to keep the case active.  

    Google maintaining legal permanent residency.  You will see the requirements.

    Tell him to pay that "big shot lawyer" to file a WoM and come back and tell us what happened. I can GUARANTEE it won't be what he wants and I can also guarantee this "big shot lawyer" has no idea ####### he/she is doing is is charging your "friend" an obscene amount of money because he/she is greedy and not a "big shot".

    Married is married is married is married. NO ONE qualifies for a k-1 visa when they are married in any way, shape or form!! 

    Another day another member who comes here seeking advice yet goes on to ignore said advice because it isn't what he wants to hear.

    Because he said he filed for a fiancee visa and not a spousal visa.
     
    He is charging more than twice the going rate, but I would expect a big shot lawyer to know the difference between a K1 and a CR1

    After waiting for nine months since we filed for ROC we received a generic RFE. Responded with more evidence a few days later and response was received. 
     
    A week later status changed to "Case was transferred to schedule an interview". Today, the physical letter arrived confirming the status though the office it was transferred to was NBC and not our local office. 
     
    Were we selected randomly? Was our evidence lost? Or was it that in the reviewing agent eyes we did not send enough? Impossible to know at this moment. What we are sure about is that happy, we're not. 
     
    The case is not even in our local office and who knows when will NBC transfer it, when will the local office receive it and when will the interview be scheduled. We can't even get a reference on processing times as ROC interview waiting time is not a thing. 
     
    Did we need this in our not so uneventful immigration path? No, we didn't. 
     
    And before someone asks if we have any red flags, we do, if being gorgeous and fabulous is considered a red flag.

    This is a critical point so please clarify -- where were you when your wife tried to enter with her IR1 visa?  If you were in Canada at the time, the CBP officer may have been right in refusing your wife entry as IR1.

    Two of my kids had to come to the interview (K2's) a bit different from and IR2. They were 14 and 16 at the time. They were asked directly a few age appropriate questions. Like what they thought about moving to Arkansas. My snappy 12yr old boy answered right away. He says it's not like we have anything else to do. I almost died and the IO just moved along.

    OP, if you want a good answer, just look at what birth certificate your father used for your immigration process. Even for citizenship, they should have asked for your birth certificate before they granted you the citizenship. Check that birth certificate and see who is listed as your mother. All discussion about whether you it was n400 or n600 that was filed is pointless. You are a USC, case closed. If the birth certificate has your bio mother as your mother, petitioning your mother is easy. If it lists your step mother as your mother (lets say someone created the birth certificate with fake mother's name), you will need a very good attorney.

    You're the one that is mistaken.  You thought wrong.  It is not legal for people to work from everywhere - that's not how immigration and work authorization works around the world.  They have to be authorized to work.
     
    It is illegal for her to work remotely from the US.  PERIOD.  She is NOT ALLOWED TO WORK WHILE IN THE US WITHOUT AUTHORIZATION.  A B2 visa does not allow her to work while in the US.

    Go to the interview and be prepared to file for ROC.  Maybe you will get lucky and get a 10 years card.

    Do you really want to pull any funny business with USCIS by trying for an RFE or postponing til whenever to get a new interview appointment.

    Take what you have in your hands and be grateful.  Why take stupid risks just to avoid ROC?  Not worth it.

    This is a common threat being used against foreign spouses when marriage doesn't work/isn't working out; the threat of deportation. Don't fall for it; they are just scare tactics. It's not up to him to deport you; there's absolutely nothing he can do. You are a legal US resident at this point and you can naturalize as US Citizen after 5 years of green card status, and won't need him for that either.
    Others have solid advice already.

    You do not need to pay the fee as the child is a citizen upon landing on US soil. As said, get the US passport ASAP to prove citizenship. There is no need to do the N600 as the passport proves citizenship. We did this for my stepdaughter December 2020 and now doing for my stepson. Best wishes!

    ABSOLUTELY NOTHING! You may want to move out, convince him he need to change or will lead him, and start living a separate life from him. Maybe once he realizes his power tripping has no legs to stand on, he will come back to his senses.
     
    What you both need is marriage and relationship counseling to determine if the marriage is viable, nothing to do with immigration. I hope whatever the issue is, you both get it resolved and reach a happy place in your marriage.
     
    Once again there is ABSOLUTELY NOTHING he can do to “kick you out”. You’re neither a football 🏈 nor soccer ⚽️ ball to be kicked anywhere.

    Can they “penalize” you and send you to secondary?  Sure.  That’s always possible.  Will they?  Nobody can tell you for certain.  
    That being said and taking your past patterns into consideration, it would be wise to stay put for 8-9 months.  Furthermore, your next trip should probably not be a multiple months long one either if you want to avoid being questioned at the border.  A week or two would be a good next pattern. 
    It’s always a good idea to see the situation from the respective officer’s perspective: a green card is for actually living in the United States, not for visiting.  An officer suspecting you of doing this might or will bring this up.  While CBP can’t take away your LPR status or your physical GC unless you sign the respective document, it is at their discretion to admit you as being admitted to the U.S. is a right reserved for citizens. 
    I understand how hard it is to be away from your spouse (most of us do, and I’m sure most of us feel for you).  However, if you want a future for you guys together over here in the U.S., it looks like it’s necessary to make some sacrifices now.

    Well each stay was under 180 days, however if you look at the full aggregate duration, you spent more time outside the US than inside the US.  The CBP officer is better at math than your lawyer.  I would stay put for at least 6 months.  Fully understand the desire to be with your wife, but plenty of folks on here are in the same boat of being stuck apart during this COVID backlog.  Do you really want to spend a bunch of money arguing your case if there is a negative impact the next time you travelled.... I wouldn't, especially if CBP put a mark in your passport.

    You are about to enter a US immigration process, I would increase the stockpile from 1 Ton to 2 Tons minimum. The never ending fees alone of the process will take care of 1 Ton pretty easily.
