    I applied twice last year for a student visa and I had just recently got back from a 2yrbstay in the states. The interviewer was concerned if I would work during my studies (I was gonna live with previous host family) I was denied to lack of ties to my home country. Me and my bf then decided to apply and start the k1 just about a month after my last student denial and we recently were approved our k1 visa.
    I was however asked about my denials and I told them straight up that I just got back and didn't have enough ties to home country, that's it. Didn't mention anything about anything else. Then I was asked WHY I didn't tell the interviewer about my boyfriend, I simply said that was not a question during that interview. And that was it
    Really don't think you should worry BUT be honest when they ask. A lawyer will not do your job at the interview, so I would suggest not to hire anyone.

    It would be a bad idea using a k1 visa, you would take up a place that someone else who really wants to marry and since the process already is long for people it's just really unfair using up a spot that someone else could have better use of...

    Have you ever visited the USA? How did you like it at that time?
    What are your plans for when you do make the move? Job? Friends? Etc.
    I have lived in the states for first 2 yrs and those were the best, I had the time of my life (as an au pair and with a very low income) and now I just moved here and got married, circumstances this time is really different from my first experience.
    Think about it, I left my family, job, friends and everything I knew to be with my love.
    Is it worth sacrificing ALL this for NYC?
    USA isn't everything and as long as your happy (as it sounds like) then why give that all up.

    I've seen my fiancé twice the last year and when I move over in August it's been 7months since last time.
    Patience and understanding, and talking is the "key" to this process. This isn't an easy process.....

    You and the lawyers are required to send in the same papers, having an attorney won't fasten the process either.
    We did fine without any help and was approved (interview this week)
    I also have been denied a student visa and I'm scared it will have any impact on my visa but others have said it shouldn't be an issue.
    Suggest you save yourself the money and do the paperwork yourself, follow the guides on this site and you will be fine.

    You will need to correct the question about the visa denial and also that question about immediate family, it clearly state in the "explanation text" that a fiancé is considered immediate family. The ds160 says in the end - did you answered everything truthfully and Blabla...
    I had to re-do a ds160 once, all you need to do is make a new one but also change the code at your account at ustraveldocs (update info about you) that box needs to be updated with the new ds160 code.

    When you get the checklist from the embassy you need to collect your documents and then schedule the interview online yourself.

    Get yourself a hobby!! During my almost 7 month wait I spent hours at the gym, out walking or at work. Find things to do and I promise it will feel like it was done in a day to get your noa2.
    All those times I sat down and just wanted my noa2 so we could move on I just got myself stressed out and in a negative mood!

    I met my fiancé during my time as an au pair too and the plan was for me to go home when I was done with the program, apply for a student visa and come back. I was denied the student visa so we decided to go for the k1 visa, we have waited for 6,5 months and got approved today at the tsc center, but we still have another 2/4months before the whole visa will be over and done and hopefully approved. So yes, it is a really really long and painful wait so I agree with the other girls, do AOS now and don't let her leave the country before that is done!
    And know that since you already are married you cannot do the k1 visa. Need to do cr1 which I believe is a even longer wait.. Difference is that she will have gc and work permit from day 1 in the states

    I was just gonn check uscis website and to my surprise it said our case was approved on April 13th!! I'm beyond happy right now!! 198 long days at tsc!! ??
    Now question is, what is our next step? Do we wait for nvc so send us anything or do we HAVE to call them in a week or two to get our case number?

    I was just gonn check uscis website and to my surprise it said our case was approved on April 13th!! I'm beyond happy right now!! 198 long days at tsc!! ??
    Now question is, what is our next step? Do we wait for nvc so send us anything or do we HAVE to call them in a week or two to get our case number?

    It's more important with evidence where the two of you are together. Chatelogs etc is just secondary evidence.
    Everything that proofs you two together at the same place is much better

    I had my f1 visa denied, twice. I came back from my time as an au pair and then wanted to go back 2 months later for school. Even tho the second time I came in with more evidence and some totally diffrent papers I was denied. You need to really show them something new and good of your intensions. I never planned on doing anything else than what was in my papers but since I recently got back they just thought my ties to the states was stronger and therefore they wouldn't believe me.
    I havnt tried use the VWP and I'm trying to wait as long as possible before applying for it, most likely will be denied (they say give it at least 6months)
    I am now in the process of a k1 and I'm really scared that my f1 denials will affect my k1 visa.
