    This is the part I don't get... Why would you get divorced for this after finally obtaining a K-1, moving to the US and getting married to the person you love? Don't get me wrong, I do understand the situation you're in and it's important to achieve your professional goals... but why would you want that?

  2. We mailed my German birth certificate and police record (in case of no entries) to NVC and it was completely fine. I think NVC just checks the documents for authenticity and key words to see if you sent the right papers. After all, they'll mail the entire IV package to Frankfurt anyway where they can read your German documents without a problem.

    Therefore, save the time and mail your stuff to NVC now.

    Edit: Just for future reference, you can get an "international" form of your birth certificate for 10€ at your Standesamt. It's in German, English and French - no need to hire a translator. You don't need it for NVC or the consulate, but it does come in handy once you're in the US.

  3. I don't know what ROC is, but if you say he won't have to, that sounds great to me. One thing that I am curious about is the whole communication system with NVC. I have sent several emails, and it takes from 39 days to 45 days to get an answer, and when I do get one, this is what it says "WE RECEIVED YOUR ENQUIRY, PLEASE ALLOW US A LEAST 60 DAYS TO REVIEW YOUR DOCUMENTS" that doesn't make sense to me! Does communicating with them via email actually delays my process? Do I reset anything every time I contact them? I am really over my head on this.. IT IS SO CONFUSING ?????

    It does! They actually treat e-mails just like incoming documents for review, so the timer will be set back to another 60 days based on the date of the e-mail. We found that communicating with NVC via e-mail is very ineffective and slow, so we just gave up on it and only called.

  4. You are facing a wait period of 3-6 months for the approval of the K-1 petition. If his contract ends in June, I would personally return to Germany afterwards, live with my parents and have the interview in Frankfurt. He won't get any mail form the consulate (packet 3) until his petition has been approved by USCIS, passed through NVC for a few days and then shipped to Frankfurt. So by the time this happens, his contract will have expired anyway. And as you already said, it would be a whole lot easier for him to have his interview in Frankfurt, so he won't need to have anything translated. Use his parents' address as his mailing/permanent address, the Italian one would just be the present address. In case his parents got any mail for him, they could scan and e-mail it to him, so he'd have a chance to respond in time, but I really, really doubt he would before June/July.

  5. How long is "currently"? If he is a resident and works there (present and mailing address are identical), he can surely have his interview in Italy. He would be able to choose English or Italian as the language of the interview.

    If he's only there for another month or two and returns to Germany afterwards, he should have his interview in Frankfurt and you should write down his German address as a mailing address (present address would be the Italian one at first, but can easily be changed by calling USCIS).

  6. You must call and bring this to the attention of a supervisor over at NVC. Also, have you received your case number beginning with SDO? This will mean your case has already entered the consulate in Santo Dominigo, Dominican Rep, even though the NVC has your documents.

    No. The consulate most likely won't know about her case until they actually (physically) receive the case file from NVC (unless an expedite was approved). Until then, the case # only serves for identifying and processing the file at NVC.

  7. I have called NVC more than I have called my own husband overseas. They just don't care. I have answered many checklists for mistakes made on aos forms. Out of those mistakes, NVC is at fault in two of them because twice they lost documents. I just have to wait, wait, and wait until somebody at NVC feels like dealing with my cases.

    If NVC lost your documents twice, get your congressmen and senator involved. Just go to their websites and fill out an inquiry form, providing all the information concerning your case and allowing them to make an investigation on your behalf. Also try to talk to a supervisor from NVC on the phone and explain the situation to him/her. It really can speed up the process in this case. Good luck!

    I was approved! It really was an easy and smooth experience...

    I had my appointment at 12PM and I arrived at the embassy at 11:30. There were 2 ladies outside "helping" and they requested my P4 letter. After I gave it to them, they went to the security guard and tell him our names. They opened the door, took my phone and made me go through the security scan. Then I was told to go to the waiting room. On the way there you can find a couple of photo booth machines so you can get ID pictures.

    When you arrive to the first room another security guard will tell you to get a number from the machine and continue to the actual waiting room. It's a big room where there are multiple interview desks. There are some vending machines, restrooms and chairs where you can wait till they call your number on a screen. For IV there were only 2 appointments before me so I only had to wait 20 minutes. They called my name and this very nice lady requested my passport, took my fingerprints and went through my file checking that everything was fine. She verify my courier and contact information. I asked her to update my "previous travel information" in the DS-260 and she said to not worry about it because they were minimum changes. She asked for the sealed envelope with the medical information and she added it to the file. I had some AOS updated information so I gave it to her and she gave me the old documents. Everything else was fine and she didn't ask for any other document not even the ID pictures (I could see they had the one I submitted with the I-130 file). Then she told me to wait for them to call me again for the actual interview.

    I had to wait another 20-30 minutes till they called my number again. This time there was a nice man who seemed to be in a rush (friendly though). He checked my fingerprints to verify it was really me and he started asking questions. He didn't even told me to do the sworn thing lol. He asked three questions: "how did we meet", "what does my wife do" and "where are we going to live". He said everything was fine, I was approved and I will get my passport with the visa in a week.

    Time to prepare for the big change!

    I saw you two got married on the same day as us.. so I was really praying for a good outcome for you yesterday ;)

  9. Is the NVC close again today?

    It doesn't say anything on their website yet. Just this concerning yesterday's closure: "Due to this closure, the National Visa Center expects a higher volume of phone calls for the remainder of this week. You may experience longer wait times when calling us. We regret any inconvenience this may be causing."

    Just try and keep calling them!

    my POE was on January 28 at JFK and when i enter my IOE number at the USCIS website it says there is no record with that number. is that normal?

    and also, do i need to update my profile at the ELIS site?

    The USCIS website only shows information on your record when your card is getting produced. Since you just got here a little over a week ago, they probably just received your visa package from your POE in Texas (usually takes 1-2 weeks) and put it into a queue in order to be processed. Keep checking your profile on ELIS. When it says "optimized", then your file is being processed and your card ordered to be produced and you can enter your IOE # on the USCIS website.

    You don't have to update your profile on ELIS. They'll use all the information and address provided in your visa package. If you want to, you can enter your address and phone #, but that won't change anything. Other updates can only be made if you provide and upload proof (e.g. photocopy of passport).

  11. I did my POE on 23rd Dec and received my GC on 20th Jan... I think it was pretty quick.. :) !

    But regarding the SSN there is no update.. how can I check the status of my SSN Card ?

    Do you have anyone who could check your mail for you? Maybe a roommate or relatives?

    If you haven't received mail from the Social Security Administration by now (even though you checked the box on the DS-260), then they haven't assigned you a number nor printed your card yet (and most likely won't). You'll need to go by one of their offices and apply for a SSN in person when you're back in the US.

    If you already went to an office, applied and haven't heard/received anything from them within the 2 weeks after your application, then you also need to go by one of their offices again and talk to them in person.

    No problem. I really think staying in Germany is the best solution. The interview will be a breeze if you're doing it there and you won't have a problem obtaining all the necessary documents. In the meantime, you can still try to find a minimum wage (450€) or full time job to improve your current situation (and it'll be much easier since you're a native German speaker as opposed to being in the French/Creole-speaking environment you'd have to face in Haiti). You'll just have to be patient about your NOA2, that's all :)

    PS: I was only talking about getting English translations concerning your move to Haiti. With you staying in Germany, you obviously don't need to do that anymore ;)

  13. Congrats! Yes, this is a case complete! Call NVC to confirm and ask if they've scheduled an interview for you already (it could be since this is the time of the month when they usually do). If not, hopefully, they'll assign one for you soon (probably towards the end of the month when it's the 2nd round of their scheduling)

  14. Yeah, Marco&Bettina couldn't have phrased it any better. I also remember that you said on your other, older thread about moving that you had dual citizenship and so I told you that if you had that, then you could get a passport and prove citizenship/residency very easily, but that the Haitian embassy wouldn't interview you if you only went there based on a temporary tourist visa. But apparently, you don't have dual citizenship (yet).

    This is a whole different and complicated problem now. I really suggest you do a thorough research on your possibility to acquire Haitian citizenship in the week that you have left there in Germany. Worst case scenario: you'd have to go back to Germany to do the interview and the move to Haiti would prove an even more severe financial hardship on you than the current situation you were talking about in your other thread.

    Also, try to have your German legal documents translated into English for the interview (birth certificate can be obtained in an international form for 10€ though). Your German yellow vaccination record booklet (Impfpass) has translations in English (in a small font) for all categories.

  15. If your spouse is abroad and will also have his/her interview there, don't worry about it. We also oversaw this question completely, but NVC will automatically assign a case number starting with the 3 letter code of the consulate where the interview for the immigrant visa takes place and send the petition there after they have finished processing it.

    It might be one of NVC's generic answers. You can surely call them tomorrow and ask about your case number. I don't know how backlogged NVC is at the moment though. It used to take 30 days until assignment when we filed, but then in some threads I also read about 42 days for petitions received in the fall.

    We filed the I-129f for a K3 right after we had gotten our NOA1 from our I-130 petition. The latter was approved in April 2014 (5.5 months), the I-129f in July (9 months!), however. Of course, it was closed administratively because the I-130 was already being processed by NVC. In my opinion, it doesn't save you any time with the service centers being so severely backlogged right now and, in the end, it's also the more expensive option with having to file for AOS in the US for around $1k. It doesn't hurt to try it since filing an I-129f after an I-130 is free (as mentioned before in this thread), but don't get your hopes up too high as we unfortunately did in the beginning.   17. My port of entry is Dallas and not LAX... so I'm hoping they are a little more nicer than LAX :P

    Oh the people in Dallas are nice, just went through it as my POE 4 weeks ago :) If you're traveling with ESTA, you can also go to one of the self-scan kiosks where you can enter your ESTA # and scan your passport yourself. I didn't get to use it myself since I was immigrating with my CR-1 visa, but they looked very neat :D Good luck!
