AOS received 26 July

Disappointed they must have reviewed my AOS on 16 September and saw that I had not completed the other steps yet. I was still working on the old process of do one bit and then the next. They were obviously ready to look at my AOS and use the new process of having all of the documents ready. Bummer.
So I guess I have to wait for them to review my DS-260 before they even look at my AOS and IV documents?
Don't feel guilty about the way you handled things. The checklist you got for DS-260 was maybe an indicator that they looked at and actually approved your AOS package. We received a false checklist for that too. Our AOS was approved on 9/24 (scan date: 7/31) and although they had received and scanned in the IV package on 8/14, they didn't review them together and I doubt they would have in your case - unfortunately. So don't worry about it. But you could try to call NVC and ask if your AOS package has been approved because those 60 days are surely over

So you can just go do your medical whenever you like (the Frankfurt physicians do walk-ins without appointments). You could get it done right now because I think you will have your interview within the next 6 months (since you're doing DCF), so it would stil be valid for the visa. Most VJers get it done 2 weeks before the interview date, which gives the physician enough time to get all the results they need from the lab tests, evaluate them and send them to the embassy. This way, your visa is valid until the 6-month-mark of your medical, leaving you enough time to pack all your things here and get on a plane to the US.

I guess nvc is just doing checklist today, My friend also got an email a bit ago from Nvc asking for her Iv doc. her scan date was also 7/31. I haven't seen no cc today hopefully they continue tomorrow..
No, our AOS package actually got approved today. We just happend to receive a false IV checklist for it. I knew we wouldn't get a cc today because the scan date for our IV docs is 8/14
(which also proves that NVC is not reviewing packages together right now). But at least NVC got some work done today

Ok, so if you really want to get married in Germany, remember that you have to apply for a permit at the OLG that has jurisdiction over your area, so your American husband can actually marry you here (maybe this just applies to Bavaria, if so please ignore the following sentences). This includes just filling out some forms at the Standesamt, submitting a current paycheck (the fee for the permit is around 10% of his income - since you're a student - and is determined by the OLG), his birth cert and a notarized/sworn statement of never having been married before (unless divorced, then submit divorce decree). It will take a few weeks or months until you actually receive your approved permit from the OLG, depending on how busy they are. I'm just giving you a heads up because we found this whole process very stressful and figured out that it would have been easier for us to get married in Texas.
Regarding the costs, it is cheaper to do the CR-1 since it already includes the temporary green card and a work permit upon approval, just have to file for removal of conditions (ROC) within the 90 days before your 2-year-green card expires . If you go the K1-route, you also have to adjust your status (AOS - apply for temporary green card) and apply for employment authorization (EA) after your wedding. And then, of course, you need to file for ROC, too. Altogether, going the K1-route costs you about $1,000 more.

AOS checklist with scan date of 7/31 was just approved (we received a false checklist for mailing our IV docs, but they were already scanned in on 8/14). So it took them 56 days to review it
In the email they sent us (it was an updated one with NVC's new askNVC.... email address in it) it says it's currently taking them 30 business days to respond to checklists. I wish...

This does not apply to K-1 right? Because I was under the impression my Fiancee can already do the medical even before interview is scheduled.

You were actually right. You don't need the appointment letter - I confused it with the medical for teacher training in Germany. It just says "You should note that the medical examination is only valid for 6 months! This means that the validity of your immigrant
visa will conform to the expiration date of the examination. We therefore request that you do not schedule themedical examination until instructed to do so by our office." But you definitely should have your medical done before the interview.Good luck! -

I am only familiar with the CR1/IR1 process. Maybe it's different with K1s since they're technically considered non-immigrant visas.

You have to bring the interview appointment letter to the medical, otherwise they have no right to examine you so thorouhly
I think what they mean is that you have an interview appointment set up for you, which will not be changed/canceled, if your results come out alright at the medical. If they actually did discover something wrong (e.g. missing vaccination, TB,...), then your interview would be shifted back.
But generally speaking, the Frankfurt consulate requires people with immigrant petitions to have their medical done before their interview.

You don't have to include an explanation at this point. But you will have to answer if you husband has ever received a visa (or if a visa has ever been refused) later on in the process when you fill out the electronic DS-260 (Immigration Application). I'd just be completely honest about it then.

Go to you local Buergerbuero and apply for a Einfaches Polizeiliches Fuehrungszeugnis. Mine cost 13 Euros back in 2012 and I had it in my mailbox within 3 days of my request - don't know if that has changed in the meantime though.
You're right. Just the timeframe between the request and issuance/delivery can vary sometimes due to their current work load, but it usually takes no longer than 7 days as of right now.
As far as I know (concerning DCF), you don't have to include the police cert when filing your petition initially, only at the stage when they specifically ask for your civil documents. And some consuls ask for them not to be older than 6 months.

We included affidavits from US relatives stating that they attended our wedding (date, location) and explaining how/when we started dating, when they met me for the first time... etc. Make sure you also include pictures of your wedding, maybe a purchase receipt of your rings. Maybe you also have additional proof of flight itineraries, hotel rooms booked under both of your names, copies of passport stamps that show you visited each other during your long distance relationship, old email/facebook conversations, gift receipts, cards/letters... But even if you only included all the things you mentioned above, I'm sure you'd be fine

I'm super annoyed at the moment because my little brother moved out yesterday. If it weren't for all the backlogs, I'd have been the first to move out. I'm older than him and married, yet still living at home with mum and dad xD Just what has my life become?!

OK here we are so no one can complain about our complaints and I for one know they all will miss us. But hey that's what they wanted. Here we can be sad, angry and complain about waiting time's and NVC etc. Your welcome to whine, cry and just let us know how your feeling in general.

I just wanted to give a heads up in case it applied (because a lot of J-1 people don't know about it). I returned to finish grad school, so I automatically fulfilled my two years of residence at home. Just like you, I also met my now husband during my J-1 year
We went for the spousal visa and are now stuck in that lovely NVC stage like so many other people here

I just looked at my visa on my passport and it says "Bearer is not subject to Section 212(E). Two year rule does not apply.
So I guess I am okay?
It also said that on the visa in my passport, but unfortunately, it was on my DS-2019 (the long printed form which states exactly where you'll be studying; has a barcode and was officially signed by the consul who conducted the interview). The information is often conflicting and embassies/consulates sometimes get it wrong on the printed passport visa itself (like in my case). I'd say you're fine if it says it doesn't apply on the DS-2019 as well.

I hate to throw it in here, but some J-1 visas require a two-year-home-residency after finishing your program in the US, i.e. you have to be physically present (living) in your home country for 2 years before you can apply for a visa serving for immigration. I studied in the US on a J-1 and this rule was stated on every official paper (e.g. DS-2019) and the visa itself, so you may wanna check on that again. Someone else in the NVC September thread experienced the same today. I think it's either that your IV Bill is being put into their system and can be paid within the next few days, or they are having problems with their database/server again. You should recheck tomorrow and if it hasn't changed by then, just call NVC to see what's up. I'm sure everything is fine

That is fairly normal since the current processing time for K-1s at TSC is around 6 months (see http://egov.uscis.gov/cris/Dashboard/ProcTimes.do). The time stats section on your timeline *can* also give you a hint as to when you might receive your NOA2. Just gotta play the waiting game. Good luck!

Hmm.. did you add the G-1145, E-Notification of Application/Petition Acceptance form to your petition? If so, you'd also receive an email which states that your petition was accepted and also shows your receipt/case number. Then you can always track the state of your case on here: http://egov.uscis.gov/cris/Dashboard.do

Our case was transferred from NBC to NSC after 5.5 months "to speed up the process" as well (that was in March). It then took them another 30 days to approve our petition. So you might have your petition approved within the next few weeks. In case it is not and outside of the normal processing time, you can just file an e-request concerning your case: Here is the link to it: http://egov.uscis.gov/e-Request/Intro.do

Whenever I have gone back to the CEAC site I have been able to look at the DS-260 and change the information entered. So maybe you can resubmit? Definitely call the NVC. Do not rely on an email. It took 60 days for them to let me know my address had been updated from an email inquiry.
But usually, the DS-260 is locked after it was submitted. You'd have to call NVC and ask them to unlock it for you to edit it again. OP be warned that this would also change the receipt date to whenever you re-submit it. But yes, best case: you could just correct the mistakes at the interview if they let you OR your wife just filled out the DS-260 and saved it on the CEAC site without submitting it. Then you can still review and edit everything.

When was your case transferred? Just recently? Give it another 30 days and you might actually get that speedy approval. Our case was approved one month after it had been transferred from NBC to Nebraska. However, many people here have (or had) been waiting for 5+ months (including us) to finally get an approval.

I'm very happy for you! I had been following your progress a little bit since we both had that 7/31 scan date (ours was just for AOS though) and I am glad the problem got solved. Hope you get an interview soon and then this nightmare will finally be over for you
