    We just answered the question:

And that was for the last 2 years portion. We first met each other in the 90's (ouch)
    That was it.

    A few things:
Texas does allow the K1/I-94. But as you are considered temporary, they should issue a license till the I-94 expiration date. So that's 2 trips to DMV within 90 days
They also accept an I-797 with a pending AOS. Validity of that license is 1 year, but some states issue for longer and some DMV employees give them out for full length.

    For all DMV's regardless of state;
When applying for a license you need to get around the potential uninformed employee, and pass thru the S.A.V.E. system. The employee you can try to educate with a printout from the website. The S.A.V.E. needs to be done by the (now educated) employee and they need to enter the correct code for the I-797. If they enter the code for an greencard (the one most of them know) it will throw an error on everything but a greencard. That's when you get the "you have to come back with an EAD or a greencard"  or, if you are lucky, they will contact USCIS to get an approval that way. (that takes several days to several weeks).
All DMV's have been issued with an USCIS S.A.V.E. manual that has all the codes. it requires the DMV employee to get up and find the book. This has been known to be the biggest hurdle to overcome.

The federal government allows AOS candidates to get/maintain a license without an EAD. Some states have not so you may still have to wait depending on your state.

Filing he N-400 basically halts the I-751 in place. For the N-400 your file needs to be at to the NBC. Regardless of what your I-751 current status is, your file will be sent to the NBC so they can do the N-400 review.

    So..........
If your file is currently stuck in a box somewhere, being ignored. The N400 speeds the thing up.
If your file is out of the box and the I-751is ready to be approved at the CSC or transferred to your field office for an interview. The N-400 delays everything.

I filed the N400 to help my I-751 get "unstuck" after waiting for a response some 130 days after the interview. It worked.

You should already have an exact copy of everything you ever sent in to them. Bring that and of course anything new you haven't sent to them

You only have 1 file. And you have 2 petitions. It is very well possible that both petitions are in your file already. Depending on local office you may or may not get a combo interview. Never hurts to prep for the N400 al you really need extra is to study the 100 questions for the N400.

This could be something as simple as them having to change your status in the system from married to divorced. Legal gun ownership is not a reason to delay.

I had the ROC interview as I did not have an AOS one.

Bring all your stuff (new and old). I found the whole thing to pretty easy, it was more a conversation than a real interview. We did not have co-mingling finances, or photos and it was all fine (we still don't have those). They can see pretty quickly if you are a real couple or not.

I would file the N400 straight away. You are not limited in your daily life by being on an extension letter vs a 10 year card. The N400 will not be delayed by having a pending I-751. An I-751 sometimes does get a slight delay by filing the N400. My opinion is that that is worth the risk. There actually is a higher change that your ROC will get sped up by filing the N400. I also suggest to file online vs paper. Less change of stuff getting lost.

I seriously doubt they will have any questions about your previous marriage. Your current martial status is printed on the certificate so that's why they need the divorce decree.
Having said that, bring everything for the very reason you stated. "In case they ask for it".
Stuff goes missing all the time and it's so much easier to supply it right there at the interview than to have to sent it in later. They most likely will not ask too many questions, but they can go every step if they feel like it.

    Short answer:
    Everything!

    Longer answer:
Everything you have ever filed with them or could be requested during your interview

    My most complete answer:

I hope you made copies of all packages you have sent to the USCIS since the beginning of your journey. Bring those.
Anything that you have an original for but have filed a photocopy. Bring the originals (and the copies)
Any co-mingling evidence that has not yet been submitted (again if you don't want to hand over the original, bring a copy as well)
    copies of tax transcripts.

Any other documents specifically asked for in the interview letter that do not fall under the above 4 categories.

If your file got transferred correctly you are bringing a lot of paper that you don't need. But if even one item fell out of your file during transfer, they can add it right there and it saves you an RFE for something you already submitted.
My file had been slightly mishandled so my ROC evidence never made it into the file when I sent in the application (that was an RFE during processing). The wife's divorce degree got lost (that was spotted by the IO and corrected at the interview) and my original I-129 entry envelope went AWOL for 5 years. (It was either not put back during my AOS of was never put in after my arrival) and it did not meet up with my file until a week before my N400 interview.

I would change it myself (as a matter of fact that is what I did).

I had most of them with me apart from the wife's passport, birth certificate, divorce decree and some more things. I had copies of those though but was never asked about any of them.

I would not reschedule. (but you weren't planning on that anyway)

Fr8dog got a reaction from Meisha&Jake in Worried about our evidence (already a natural worrier lol)
You got way more than I ever sent or was asked for.

Do not forget to have both names tied to the same address. (I was so busy trying to prove I lived there I forgot to include the drivers license of the wife)

I did not include any of the evidence from the AOS part (it stated on the form that already submitted evidence did not have to be resubmitted).
The ROC RFE I got stated what they had on file (all evidence of AOS petition) and what was missing (all evidence submitted with ROC petition).
There is no harm in sending paperwork they already have so you might as well include it.

More stuff ended up missing during the interview (and the following N400 petition). So I strongly recommend to keep an exact copy of all petitions and supporting documents you file and bring anything and everything you have ever filed with you to any interview or even bio-metric appointment.

I think that this is your actual problem. 👆

They cannot proceed until they have your file and it is all complete. Time to start contacting them, it's very likely one person is waiting on the file while another person assumes it has been sent. Neither one of them will look into it until someone else tells them to.
Could also be they lost your file, parts are missing or it's stored in a wrong location, regardless you need to start shaking the tree and see what falls down

I noticed you have several posts out here and they all appear to have a common theme, your mothers English language skills. You may want to read through this page
    https://www.uscis.gov/policy-manual/volume-12-part-e-chapter-2
It covers basically everything that has to do with the language requirements. The IO has to be somewhat lenient during the interview but if your mother is not able to understand or answer the questions on the N400 application (it's ok if the interviewer needs to reformulate the questions in easier to understand language) she will have a hard time meeting the English requirements, unless she able to use one of the exemptions (also explained in the link).
The way I read the manual an interpreter is allowed to prep the application but cannot be used during the interview unless the applicant meets the exemptions.

I got one for my ROC.
    - Bring spouse
    - Bring everything you have ever submitted with you (just in case something goes missing last minute)
    - Bring originals of important documents and a copy.
    - Bring any additional co-mingling evidence not yet submitted
There is a decent change you won't have to show much but better be over prepared than to receive an RFE at the interview

To answer your question; Type or write, either are fine. (or try the Javascript trick)

Now, for the important thing. Please do everybody (including yourself) a favor and file online. it is much easier for all parties involved, your application can't go missing during shipping.
It is set-up so you cannot forget anything. It's a much much better way of filing.
"Unemployed" in the history section does not mean you filed for unemployment benefits. It means you were not employed.

You are asking the wrong question (as is the HR department).

The I-551 stamp can be used to establish legal present, but it is not the only document. HR is overstepping their boundaries by insisting on that. If you have their requirement in writing you actually have a pretty solid legal case against them.

HR is allowed to ask if you are legally present and allowed to work. But they are not allowed to demand certain types of prove for this. This is a very important difference. All they need to do is enter your data into the SAVE system and they will get an OK from that system.

Your problem is that you want the job and don't want to piss off HR. Understandably, but it is not like they will give you the job if you don't push back. So depending on how much you want this job, you need to get a little more aggressive with them.
I would suggest to try to get this demand in writing. sent them an email and tell them you need their demand in writing so you can obtain the I-551 stamp. Than wait a few days and tell them you are not able to get the stamp in time, but that you have enough documents to meet the I-9/SAVE part and casually include a statement that their request is against the law and that you really want to help them staying out of trouble.
If that does not work, threatening legal actions may change their mind, but that would also mean they are likely to fire you the first change they get.
Getting the stamp in a timely manner is, unfortunately,  not very likely..
