    They can still file for AOS. They are just no longer eligible to file for AOS based on the K-1, since they married after the required 90 days. They can file an I-130 and AOS(I-485) concurrently. See this guide > http://www.visajourney.com/content/i130guide2
    However, being out of status is violating immigration laws and they are subject to being detained. Being married to a USC does not protect them from being here unlawfully. Once they file for AOS, they will be a new period of authorized stay while their case is being processed.

    We were happily living together in my in-law's house until May 2013, we had some fights and I decided to go back to visit my parents for 2.5 months to give us some space to think it through. I tried to call my husband a few times during those 2.5 months but he did not answer. I contacted his father and he said my husband moved out of his house and nobody knew where he went. When I came back to the US, I tried to find him using all the resources that I had, but with no luck. I thought we could not resolve our problems since he had been avoiding me, I filed divorce paper and got approved in April 2014 without his presence at court..
    I am glad those condemning her are not adjudicators otherwise most of us will never be approved. Critical thinking people. This was so easy.
    Congratulations OP and sorry for your tough journey and loss of your ex.

    hmmm its funny how when someone comes on here and lays their whole sob story out and tells all kinds of details people yell at them saying this is an immigration website we don't deal with counseling. but yet she comes on here and talks about her immigration process and gets beat up for not being emotional? im sure she has her tail of stories and her whole situation written in a book somewhere that will sell for millions. no one knows all she went through while with him and leaving and coming back not being able to find him, moving on with her life alone , having to start all over ect.. she came on an immigration website and spoke of her immigration process. that's what the site is for! isn't it? she doesn't have to be emotional about her story or tell anyone how sad she felt or how bad she went through it all.
    her post is about encouraging people that were divorced how she went though it without a interview. yes maybe she didn't have an interview because he died. listen someone will be divorced and have lost their spouse and will be worried about if they can ROC and this post will help them! no where in her post did I see that she used him for immigration benefits. he sent her home to cool off and after she came back and searched for him he was gone. well anyways im happy op you got to stay here and got approved. may the next part of your life be full of amazement!

    They can still do it themselves, it's been done many times. Stop scaring him, no need for a lawyer.
    He will have to pay a tad more and supply an extra form, that's all.
    Not too different from people marrying on tourist visas and adjusting in the US.
    And, and Op - no one expects you to have proof of genuine marriage at this point. That is for the ROC stage, but it would help if you started gathering them now. Put your name on the lease as well, if possible, and on the car title and insurance.

    Attorneys only want money. You're getting good advice here.
    Just let it runs it's course. If your wife insists on getting an attorney, tell her she needs to pay for it.
    It's an absolute waste of money and to be honest they may try to get her to go a route that ends in the same results that will only cost MORE money.

    My personal opinion is everybody is just guessing why a date changes. Every time somebody is sure of a pattern, the next person has something different happen. I don't have a guess.
    You have an interview. Stop checking status. Go pack.
    (Hahaha, I say that because my fiancé procrastinated until the last weekend then fell off a bike and broke bones. He was in a sling and packing the massive amount of stuff he was bringing just one-handed wasn't going so well. So I had to go catch a flight that afternoon to arrive Saturday morning and help. Oops...I got on a soapbox. Getting off now since I am the worst procrastinator alive. Cheers!)

    I flew out there Wednesday the 19th,
    Visa came to the door at 15:30 on the 21st,
    We flew back together on the 23rd.
    POE immigration officer was a nice fella, even cracked some jokes.
    Over all, the whole experience was very anticlimactic...
    We met in punta cana sept 2013, she came to visit me a month the later and ended up staying for 90 days. Then, I went back with her for a week and she came back with me for 90 more days. After she left in April, I went to visit her in england every month. She came here in sept for 2 weeks, then this month I've been there twice. We were very lucky to be able to see each other so much during the whole process, which made it a lot easier than expected. So, that's why it feels so anticlimactic, cuz we're always together anyways.
    Weddings 1/10/15 in my parents basement. Then, in 2016 we're going back to the beach we met on for a destination wedding.
    Couldn't be happier.

    I actually do understand how much you wished you had answers. It is fine to share and find a buddy to compare notes with and wonder when your time will come, but you were getting mentally ill about it. I only wanted to give you something else or think about before you got locked in the psycho ward.

    You lot have stirred each other up into pure insanity. There is nothing wrong with your cases except you haven't given them enough time to assign an interview. You've created stories of what each update means. You've set yourself up for daily disappointment over and over by checking the status and thinking it will give you answers. You are paranoid they lost something.
    RW365, your timeline says your medical was October 8, so maybe the results were couriered to the embassy on Tuesday Oct 14 at the earliest. The embassy was closed Monday which means more stuff to catch up on. Do you really think you would have a letter in the post just four working days later? They don't work that fast. It will happen in due time and all this frenzy you've created is clouding your common sense. Did you expect your petition to be approved in a week? No. Your expectations for the embassy are unrealistic.

    I SUBMITTED MY FORMS WHY HAVENT I RECEIVED AN INTERVIEW DATE?
    It takes approximately 6 weeks for forms to be received and registered on an individual applicants file from the date on which they are mailed to the Immigrant Visa Unit. An interview will not be scheduled until the Imigrant Visa Unit is in receipt of all of the forms required to process the application and a medical examination. If it has been more than 6 weeks since you submitted the forms and attended a medical examination with the panel physician, please contact us using the Visa Contact form . Please note that if it has been less than six weeks since you submitted the forms in support of your application, you will not receive a response to your inquiry.
    The bolded part might be why they are not in a hurry to answer your emails. You are choosing to make yourself miserable with all this. The embassy will get to you when they get to you and all your guessing is wasted effort. Why not start studying AOS paperwork. Here's a preview of things to do.

    Was informed of my interview today! No letter yet (packet 4), but the senator in the US we were in touch with informed us.
    Nov 6th at 8am
    Hopefully all of our letters are in the post right now!

    We found out we were expecting just before he left and i thought Fiance Visa was our only option.
    DON'T DO IT!!!

    I have spent the last 4 months pregnan, alone and eagerly anticipating him to come home. (It's been rough, to say the least)

    If I had know, we would have married and filed for AOS. Once you file for AOS overstaying is NOT an issue., unless your AOS is denied but that's a whole new ball game.
    But seriously though... just get married.
    Don't make the mistake we did.

    I've known my husband 12 years and have lived with him over 5 years. That "pants" topic still does not compute with me. Yes. I know the difference but my brain won't acknowledge pants as under garments. If you say pants to me, you are talking about your jeans.
    I can live with "aluminium" and "yoghurt" and "garage" as cute and quaintly British. But you know what drives me up the wall?? Vitamins. It is like fingernails on a chalkboard to me.
    Here's one on phrases I use--
    Me: I need to run to the store. Out of cokes. (Means quick trip for one or two items).
    Him: Since when have you ever run anywhere?

    Every year my family gets together for holidays. Every holiday at that..
    My fiance was in the country during Easter and we weren't allowed to attend.
    To be precise, I was told that the children and I could come but he needed to stay home.
    My family is unable to look past the color of his skin.
    I am sure you can imagine their reaction to finding out that we were having a baby together. HA!
    The way I see it, they'll either get over it or we'll likely never see each other again (my family). I'm okay with either.
    My fiance and children will always come first. I will not subject them to the negativity that idiocy creates.
