Junior11 got a reaction from Ironman140 in Before citizenship or after for I-130
Ironman, please study the attachments below. Your step-daughter’s category:
    Right now: F2B
After her mom becomes citizen: F1
    After she gets married: F3
So your wife can now file I-130 in F2B category and get a priority date for her daughter. Then, if I understand correctly, your wife can move the category from F2B to F1, without loosing the priority date. And then to F3 after her daughter is married.
My second attachment shows which priority dates are being processed as of March 2019. You’ll immediately see, how faster it is, to bring unmarried daughters here.
You have a good guess that your step-daughter will get her visa under F3 category. Regardless, as other posters have pointed out, it’s best to get a priority date as soon as possible. It’s like getting in the line at a movie theatre before deciding which movie or even which time of the day you’ll see one. There will be plenty of time to figure it out
These attachments will come handy, when you’re having the long talk with your wife and step-daughter.
    Best wishes!

Naz, to be ready to upload everything on CEAC website when you get your case and invoice number, you can make your husband get these, take their photos and (if larger than 2MB) convert the photos to pdf:

-police certificate from his country and any country he lived for more than 6 months
-your marriage certificate and if any, marriage and divorce certificates from previous marriages.
    -bio page of his passport
    -his birth certificate
    -passport photo

For the affidavit of support part:
-your proof of domicile in US (electric bill, driver’s license etc)
-I-864 form filled signed by you
    -your 2018 tax transcript
    -bio page of your passport

Please note that even if you and your husband have some of these ready right now, it will save you time if you’ve already saved them in your computer in digital format.

When I got the case and invoice number, I immediately paid the fees. After 2 days, when the payment went through, I’ve uploaded all of the above in one sitting.

I’m not saying you have to. CEAC let’s you upload different documents on different dates as they become available to you. But they won’t review them until all of them are uploaded.

I hear you are in a hurry, so you can fly back here with your husband. If my advice above saves you only 2 days, maybe those 2 days will make a world of difference to your flight plans.

    Wishing you the best.

Yes the above is correct AS LONG AS the sisters income ALONE is enough to cover household size of 3. If it is enough technically sisters husband does not need to send the 864a, however many officers request one to be sure the spouse knows the financial obligation being undertaken by the other spouse. If it is possible get the 864a from the husband and include it now to avoid any delays. If you do not and one is asked for it will cause a delay.

It's the $220 USCIS Immigrant Fee. It can be paid online with credit card: https://my.uscis.gov/uscis-immigrant-fee/
    It's $220 per person.

Is your brother in USA single? If he’s married and has kids, his joint sponsor form should include his wife and kids plus your other brother, in the household size question.
For both your mother’s and your brother’s I-864 forms, please read official instructions in detail and try to fill them both correctly this time. If you’re unsure about any part of the form (after reading the instructions) come to this forum and ask for advice.
If your brother has both I-864s correctly filled with him at his interview, he will be fine. Otherwise, consular officer will not accept wrongly filled forms and your brother’s case will be delayed.

I think the “add ASAP” advice probably took into account the PD mentioned  - F4 is current for Jan 2006 now and document submission for August 2006 so it’s possible they’ll be asked for document submission in the next 3-6 months or so. For someone who just filed a couple of years ago like @Junior11agree no rush.

Most people do not, none of it is that relevant, the relevancy arises when the PD number is current.

Currently varies between 14 and 23 years and is getting longer, we are talking generational wait periods for someone filing now.

If you entered the suffix in all your forms, but THEIR noa2 paper doesn’t have it, it will not be a problem.
For example, my son’s school’s printing format is not designed to include suffix. So his school reports etc. doesn’t have his suffix, even though school’s digital records have it.
Consular officer won’t hold you responsible that NOA2 print design omits suffixes. He/she is probably well aware of it, don’t worry.

It's for the physical Green Card and to cover USCIS expenses, not for the Social Security card - which is free!

Yes it’s the Green Card fee. It’s $220 per person   It’s not paid at the interview. It’s an online payment to USCIS after the visa has been issued

Unfortunately our case took longer to be approved than average. So don’t take it as a reference. And you also have an expedited case so hopefully your case will move faster:

    PD: March 28, 2018
    RFE: beginning of December, 2018
    Approval date: ?
Sent to NVC: January 14th, 2019

We got RFE because in my country, birth certificate is not a hardcopy certificate. You go to Civil Records Office and submit a request for a print of your civil records (birth, marriage, divorce..etc) with the reason you need it. My mom wrote “to be submitted to American authorities for immigration” so they’ve printed the English version of it for her and stamped / signed it.
She got an RFE for not sending the original but only the translation!
So in December, my mom wrote the reason “personal use” and got a copy in her country’s language, then paid a translation office (to English again.) Then it got approved by USCIS. Crazy but true, what a comedy!

Mokhaleel, that June 4th case they put up there is the “newest dated” case they’re processing, among thousands of cases. It doesn’t mean the “oldest” case in process.

Theorically, the best place to check your status is https://egov.uscis.gov/casestatus/landing.do but unfortunately statuses aren’t updated real time. Many people got approval (or rfe) letters in the mail whilst their status still reading “we have received your case”.

Only time I’ve seen a different status there for my mom was “we have sent your case to the department of state” which meant they approved the I-130 and sent it to National Visa Center.

I’m attaching a screen shot of what that (approval status) looked like:

the CEAC site is quite temperamental and it does this for me whenever i have to add more than 5 entries be it addresses or education or employment..however, it will not allow any gap in addresses from age 16 - what id suggest is add 5 addresses to cover entire time from age 16 - meaning lie to trick the site on the duration to save it, go back and add another 5 and so on until you cover the entire time..and when u add another address, don;t wait to fill one before you click add another - in one go, click add another 5 times so that you can see 5 open slots and quickly add the five..it helps a lot if you save all the addresses ( and for that matter all data) on a word document and copy paste quickly..the site has a cycle length bug in it i think..meaning it will give you only a 5 or max 10 min window during which u should quickly put in all the data and hit save. else it will boot you off. also keep in mind, the volume of visitors on the site from all over the world is humongous at any time - it can only take so much.

I’m so glad your sister and your brother-in-law are so supportive of you.

About two sponsors with a joint tax return, you can start a new thread to get attention of people who have done so. I’m ignorant on that subject, but I can only GUESS their W-2’s will demonstrate which portion of the income comes from which person. It’s important that their AOS forms match their 1040s and W-2s, cause the officer will compare them.

Hopefully, consulate officer will approve the visa solely on your income (without their sponsorship) but if not, it’s good to have their forms filled correctly, so you get an approval on the spot.

My advise would be to file your taxes as soon as possible and get the 2018 tax transcript as soon as it becomes available from IRS.
Also, find a joint sponsor and get him/her to sign an affidavit of support and get 2018 tax transcript.
By the time your interview is due, 2018 taxes will be due and consular officer will demand 2018 ones.
During the interview, looking at YOUR tax transcript, consular officer may approve the visa without a joint sponsor. But if he/she doesn’t, you will have the joint sponsor’s signed affidavit and tax transcript handy. That way, you won’t be denied or asked to come back another time to the consulate, god knows when an interview slot will be available again.

Junior11 got a reaction from Ate in Applying for IR-5 while visiting on B1/B2 tourist visa
The fact that admission/refusal of a visitor is solely at the discretion of the port of entry officer, was my reasoning for the possibility. Officer’s main job is to screen visitors with immigrant intent out.
When the officer asks my mother if she has any intent to immigrate to US, she would have to give the honest answer (yes) Of course, she would show her return ticket, wedding invitation etc. to demonstrate she intents to immigrate in the future, not at this trip. There is no way of knowing that particular custom officer’s approach to such visitors. Therefore I made my mother aware that there’s a CHANCE of refusal.

If your father-in-law decides to visit after all, please advise him to carry evidence that he will return back to his country after his visit.
In fact all non-immigrant visa holders are advised to carry such, everytime they visit. Most are not asked to present them at the port of entry. Having an immigrant petition in process will make it almost definite that he’ll have to present all the evidence he can, to demonstrate he’ll return back after the allowed visit time.

I submitted everything on 3/7. Everything accepted on 3/8 and status said 'Accepted' . But on 3/13, I got two emails; one email says one of my documents is Invalid so Status changed to 'Invalid doc'. The second email said they've received all fees and documents so they will schedule me for interview (in CEAC it says I'm documentarily qualified. So I called them about the two conflicting emails twice today and both times I was told to ignore the invalid doc and don't have to do anything but just wait for an interview date because my case is marked as complete. Bizarre but I'm CC.

Congratulations Nastra. I’ve submitted everything on May 8th and constantly logging in to see any change, maybe 8-10 times a day.

Before your case complete, did some documents get accepted here and there, or were they all reviewed and accepted at once?

Now that your case is complete, what do you see at the status where it used to say “submitted”? Please let me know what changes you’ve observed when you logged in after case complete.

Thank you very very much 🙏🏻

I have to say it, even though I am SURE there will be backlash about it but whatever. I won't reply to it.

I think sometimes we forget that when we are talking about people's situations especially illegals, we are talking about other HUMANS. Family members. People that are very meaningful to others. We are all here on visajourney because somewhere along the way, we were separated from our loved ones so if anything, we should be understanding. It isn't easy. Do people make mistakes or poor decisions? Yes. Are they aware this was not a smart idea? Yes. But the OP's mother-in-law is still a person---a human being. And as far as we know, she isn't a murderer or did any type of dangerous criminal activity that hurts someone. Sometimes I feel like people act like those who crossed/overstayed did the WORST possible thing imaginable.

We know immigration is a hot topic and there are millions of illegal immigrants who have crossed/overstayed  in the US. But each one is a person with a story, family, etc.  But when these people want to try to fix it and do the right thing, there are literally ZERO options. If this country created some type of path to citizenship, these people could come out of the woodwork and  also become taxpayers. We could reunite families the right way.

For those of us who did it legally, that is great. We have nothing at all to worry about. I can sleep at night knowing my husband is not at risk for deportation and that is great. I'm glad we went the route we did and we were guided well. My husband was not in any type of oppressed situation and never once felt like he had to leave due to bad circumstances in his country. My husband's immigration status is not effected by anyone else. But it just drives me crazy when people who gained status through marrying in or whatever all of a sudden act like they are better and more deserving than anyone else. No, they were just lucky they met the right person. It is situational.

OP, I do not know enough about the system to advise you on how to fix your mother-in-law's situation. But I just want to say that I feel for you and your family and wish you the best of luck!

Junior11 reacted to USS_Voyager in Question about I-130 (Father)
Yes, I don't know what the person on the blog is talking about. I checked the I-130 I filed for my mom and 25.a-36 is "Information about Beneficiary's Family". My mom has two children, myself and my brother, so I put my name and his name in that part.

On the part preceding that one 21a-28, which is name of beneficiary's spouses, I put the names of her spouses. She had two marriages, one with my Dad, and ended when my Dad passed away, and another one after that, ended with a divorce. So I put both those in that part.

    Does that clear it up?
