    No offense, but it sounds like your lawyer is approaching the problem from the wrong angle. Based on the info you've provided us with, this is NOT a LGBT issue. The information you need to find out is exactly why you got denied, so if I were going to contact anyone in power, it would be my senator/representative. I would also have my lawyer filing a FOIA request ASAP, which someone else mentioned already a couple pages back.

    But lying about the nature of their relationship on the application for the B2, and inventing this "nanny" story as the motivation for the OP's fiancée to travel to the US back in 2010, is misrepresentation.I can't provide one set of circumstances to the government because same-sex marriage isn't legal, and then when it becomes legal provide another set of circumstances. The COs are going to see right through that and know that at least one of the times, the applicant wasn't being truthful.

    If she was always your fiancée, and you lied about this when you/she applied for the tourist visa, that's a problem now. It doesn't matter if DOMA existed or not when it happened. That does not make it OK to lie about your relationship to get around the laws in place at that time. I'm 99% sure your denial has something to do with that, so you need to address that issue specifically with your lawyer. If your lawyer told you to lie back on the tourist visa application, then it's time to find a new lawyer and report that one to the appropriate bar association or equivalent.

    I also sympathize with you and your situation. However, my original point still stands. If you said she was your nanny four years ago just to try to get her into the US on a tourist visa, and now you're saying she's your fiancée...which is it? That's how the CO probably saw this situation.

    Can you correct your timeline to show that you were not transferred to CSC? You were routed but not transferred. This is an important distinction that affects the timeline estimates for TSC customers.

    Is it possible that he's the victim of discrimination, or is being shunned, by his Mexican coworkers? I'm betting on this. If it's true, this would add massive stress to that of uprooting his life to move here.
    I highly recommend that you seek out the Dominican organizations in Houston -- and do it "yesterday."
    Although Mrs. T-B. had been to the U.S. before, she was homesick and felt like a fish out of water upon moving here "for real." On perhaps her second weekend here, I dropped her at a Spanish church service and picked her up afterwards. She came out late, chatting merrily with new acquaintances, and she introduced them to me in bubbling fashion. We repeated this for 2 weeks. She felt much more connected.
    None of those direct contacts have endured, but she met others through their networks and then continued on her own. Of note, Mrs. T-B. was never particularly religious.
    Church-goers are typically decent people, so you wouldn't have to worry about his falling into a wrong crowd. There are also support groups available at or through these churches. Strongly consider the potential benefits of this path.

    Did you already send a letter of intent with your original package? If not, then it should be enough. Keep in mind you need one for each person and they must have original signatures.
    If you already sent that the first time, then they're asking for additional evidence, so simply re-sending the letter will not be enough.

    Don't get snotty. Realize your situation of your choosing does not sit well with law abiding US citizens. You choose to break our laws. Don't pass judgment on others wHen you don't know their situations while asking for help with your illegal situation. That takes brass balls.Realize that your only path to a green card is marriage to a USC.

    I'm not sure why your fiancée used the past tense. Probation is part of your punishment, and you're still facing it right now and will be for the next few years. Probation isn't supposed to be convenient.
    It sounds like you're in a tough place with regard to the relationship. She (probably) can't come to the US, and you can't leave the US. That doesn't leave you a whole lot of options...

    Were it myself I'd use some of my rainy day funds for an expedient... relocation... of the lot of them.

    so it seems like the fastest way to come to the US is just get a tourist visa and marry? those that file a K1 or CR-1 (and have tourist visas or on the VWP) are pretty much wasting their time. Is that correct?

    From 10/16/2014 to 2/18/2015 is four months, not five. And it doesn't say anything about your chance of getting an RFE. Be prepared for at least a couple more months of waiting for your NOA2, unfortunately.

    If you do plan on going to the K-1 interview and seeing what happens, I would definitely hold off on that "wedding ceremony" you mentioned. I realize you have family pressures weighing on you, but you're playing with fire when you do things like that, especially in non-Western countries.

    If the document you've prepared deviates from the examples found in the guides in some way, it's up to you to use a little common sense and decide whether or not you have a problem. In this case, the address on the letters isn't going to make a bit of difference, especially since it's not explicitly required by USCIS that you use one specific format.

    It seems as though the general tone of last year's article was anti-DACA, while most of our complaints are about the service center discrepancies. Since nobody can know for sure (not us, not media, not even some congressmen) exactly WHAT the cause of the backlog at TSC is, how is she going to write an article in the NYT about it?
    If she focuses just on the discrepancy, she could rely more on facts and statistics (such as VJ timelines), but by leaving out the DACA part the piece would not have the same appeal to a general American audience opposed to illegal immigration/amnesty.
