Also a quick update and its not a good news but I called USCIS just now to check my case status. The representative said that there was a glitch in the systems and the statuses of hundreds of cases all across said transferred to local offices but it is not the case as the cases are still being processed in VSC. Right now they are working through Jan23 2017 cases. So a bummer! 

 

I almost got excited but I can wait more that's fine. 😊

Now when I check the other number it says I-751 Petition was sent to local office on Feb. 27.    It's beginning to look like it just says whatever date the person checks the first number. lol

Has nothing to do with Trump.  We went 3 years ago when my wife was denied and detained.  Stop throwing blame when you have no proof or factual information.  First of all it's the Mexican gov. that is requiring those document, NOT the U.S. and Pres. Trump. They want their citizens to flow freely to the U.S. but if you dare cross their border illegally and get caught you'll wish you hadn't for a very long time.

You are here because obviously you are trying to obtain a Visa or status LEGALLY.   This process and everybody on here wouldn't have to wait years if our borders were secure and there weren't so many ILLEGALS flooding the U.S. systems and slowing them down.

Better get a Visa for Mexico. They won't honor anything else if they don't want to. My wife had to spend the night in detention and got sent back home the next morning when we went there for honeymoon. They had told us we had the necessary paperwork, then when we got there it was a whole different story and they wouldn't accept anything but a VISA. Even the US Embassy couldn't help get her out. 

So...has anyone actually had luck applying for naturalization BEFORE the I-751 removal of conditions is approved/delivered?  Wife is eligible in Feb to naturalize but we aren't expecting any action on 751 until at least June.

Aug 11 sent "out of processing time" inquiry

Aug 12 received generic response stating that due to workload factors USCIS anticipates a delay in completing your case."

Aug 15 (Saturday@8am) received email stating a recent processing action has taken place on our case. Status:Card/Document Production

"We ordered your new card for MSCxxxxxxxx, and will mail it. You can expect your card within 30 days of approval of your application.

Not sure if it was just a coincidence or if the "out of normal processing time" inquiry compelled them to pull it out of the pile, but either way..... Yay!

So..... why is everyone's notice completely different? Ours said nothing about a welcome notice or a "decision".

Simply a new card is being produced.

Does anyone get this error msg when trying to fill out the "outside of normal processing time " inquiry on the USCIS site? I tried several different scenarios and got the same error.

Is this their way of keeping up from inquiring?!!?

Yes. The period between adjusting status and green card in the U.S. is a period of no status really. They want proof that you have legal status in the U.S. or produce a mexican visa.

So I asked USCIS today what our proof is that the petitioner has legal status and they couldn't answer. Simply said it's adjusting status. I said, how would I prove to U.S. authorities that she's legal then and the answer was a big circle of nothing stating it depends on who is asking.

My goal is not to spam but to save someone else the heartache and misery my wife went through. Not everyone reads "all" the posts.

If someone reads through the majority of these posts they can easily come under the assumption that the AP card will allow them easy access to other countries and re-entry to U.S.

They need to be aware of the negative scenarios as well so they may weigh the risks and make an informed decision.

Everyone is correct, you may apply and the fee was covered under the filing of the I-485. However, obtaining the AP card does NOT guarantee you can travel anywhere you want. It's simply a "re-entry" document into the U.S. (and still no guarantee you get in...at the discretion of customs/immigration)

Contact the country you wish to travel to and verify what they require from you specifically in your situation. Then proceed with caution, as they can change their minds and deny you admission to the country when you get there.

I will echo KayDeeCee that you have to contact the country you want to travel to. I will also CAUTION you that you are traveling to a foreign government that can and will change their minds/policies at the drop of a hat if they choose to.

So, take what that country tells you and proceed at risk. I know first hand that Mexico will tell you one thing and may require something different when you get there.

No other issues. They refused to recognize the AP and the pending I-485 status that she was in.

They want a U.S. visa, passport, or permanent resident card.

You are correct about them wanting her to have a U.S. visa or passport or permanent status.

He saw the expired K-1 Visa in her passport and that's what set everything in motion assuming she was illegal or something.

We re-entered at New Orleans (small airport) and the flight crew had called ahead so it was very smooth and they were very understanding. The lady (Mrs. Moon) that processed her had extensive knowledge of this because she had worked in INS before. She still maintained that it should have worked but the Mexican officials didn't comprehend the "no status" that my wife was in while waiting for the I-485 AOS to be finalized.

Please read my other posts about the use of the Advance Parole before you believe it when people say you can travel with the AP card with no problems.

It all depends on the country you are going to and the day they are having when you get there.

CAUTION......I repeat........CAUTION..........

In reference to using the Advance Parole card and/or letter, you better call BOTH countries and get validation that the AP will qualify to enter the country and re-enter the U.S. AND..... get it in writing by someone very high up! Yes, I know exactly what all the websites and government pages say about the AP but that doesn't mean a da&%! thing. Other countries can and WILL do what they want and can change their mind/policy anytime they want.

I made those calls(to our gov.) to verify, I read every piece of official website info, I read all the stories of people stating it would work....then booked the 12 day honeymoon trip to Cancun Mexico with the AP/EAD combo card in hand along with the approval letter, marriage cert, birth cert, valid Philippine passport(w/ K-1 expired visa inside), and a U.S. state I.D. Only to get my 4'9" 93lb wife detained and treated like a criminal and sent home on the next flight, NO QUESTIONS ASKED. No allowance for me to remain with her or know anything about the flight she would be placed on the next morning. Nothing. I was given 5 minutes with her and then forced to leave the airport.

The U.S. Embassy can't help you, or didn't in this case. The response I got was "They can change their policy at any given moment and nothing we can say to change their mind"

Biggest nightmare ever. Very scary for my wife. Placed in a detention/jail type room with locked door and cameras, 2 security guards outside the door, no windows at all, sharing food and beds with other detainees. No personal items or phones allowed. The next day escorted by Three then two individuals that never left her side until the plane door closed for departure.

At this point I wouldn't trust any government including our own when they say "sure, it will work". Obviously besides the emotional/scarring stress endured, now we are faced with losing the $4,500 for the trip because of last minute cancellations.

I promise you, it's not worth the risk.

I realize...or at least my thinking is that Canada wouldn't do such a thing, but at this point I wouldn't trust any government including our own when they say "sure, it will work". Obviously besides the emotional/scarring stress endured, now we are faced with losing the $4,500 for the trip because of last minute cancellations.

Also, The Customs/Immigration officer that processed her into the U.S. knew exactly what the issue was and it relates to what the above agrument is all about. Her words were "She has an "adjustment of status" pending which puts her in a state of "no status" and that's what confused the mexican authorities even though she was confident they have seen the AP many times as its been in place and being used for over 30 years.
