  1. Not true - there is no requirement to file for AOS within the 90 days post-entry. The only requirement is that you marry within the 90 days. You can file AOS whenever you want. You do not need to file for a spousal visa if you file after the 90 days is up.

    If you happen to marry after the 90 day window, that is when you would need to file form I-130 together with form I-485.

    However the sooner you file, the sooner you can get your EAD and eventually green card, and it will make life easier in general.

    Please I need more info about this.

  2. Once the beneficiary enters the USA, a new clock of 90 days begins. The AOS should be filed at some point during these 90 days. The visa expiration date no longer matters - that date is only there to give an expiration on the time the beneficiary must travel to the USA. Others have adjusted status after the 90 days ends, however that begins a new topic. You'd have to file a spousal visa request and AOS together at that point.

    Long story short - 90 days from the day of Point of Entry is the time frame to file AOS.

My fiancé visa was approved but not issued yet we booked gis ticket for March 18th so scared.he had tuff questions though after the questions they asked him to give our pictures together which he did. The lady said we all done then she gave him a paper saying that if your fiancée abuses you or whatever call this number. My fiance did not take the affidavit of support package cause they did not ask so she told him to bring the next day and drop his passport off.I almost cried when he said she didn't take his passport

    I will call uscis and request that they expediate since this was their error.

    However, it wasnt posted on my account on uscis that it was found at the record center.

    Im in deniel, would it be possible he lied to me? Im thinking about it too much. I hope its truthful.

    Also, recieved an email thats obudsman also contacted uscis on my behalf... After i finally got my answer where my file located... I get an remail stating they are going to help.
