NoProblem reacted to geowrian in k1 neither denied nor granted
It's either an approval or a refusal. Since they didn't take the passport, it was refused (simply by nature of not being approved). That said, many cases are initially refused then ultimately approved.
It is odd they didn't give you a 221(g) notice, but presumably the visa was refused under 221(g) while they put the case into AP to verify documents, review the case, etc.

There is no timeline for AP. I'll defer to others from your consulate on how long it typically takes to hear back in cases where there is no request for documents nor (known) inadmissibility.
When they finish AP, if they determine to are eligible for the visa, they will request your passport to be sent to them so they can issue the visa.

Perfectly acceptable reason to be absent. But, they can do as they wish.

Tell them about the appointment, show them the letter, and let them write you up if they need to. But I would really be looking for somewhere else to work. I've never worked for an employer that was that much of a jerk for perfectly acceptable/legitimate absences.

They can do that. It depends upon their policy

However, question is, Is your job important than you being in legal status????

If I were you, I would have planned better. Well, didn't plan better then I would speak to my boss and explain the situation. Sensible people understand how important AOS. Even after explaining the importance of AOS, if they would fire me; I would simply resign because I don't want to work for or with people who are unreasonable

This is more of a rant then a request for help although if anyone has any to offer please do.
My husband is overseas (Scandinavia) Last night he left his wallet in his dads car cause he was tired and they were going out early the next day. The next day they get up and the car is gone. Stolen. Its a safe neighborhood and things like that never happen there. Im guessing it was just some kids cause its not a very valuable car. Hes getting a police report and is working on setting up an appt at the Embassy for a travel document/boarding foil. He has the 10yr card.
The Embassy website says to fill out the 131, pay for it and then make your appointment. 575$. Seriously. Five hundred dollars? And then another 500 dollars to file the i90 for a new card? Is this correct?
There should be provisions for people who get robbed overseas. Its bad enough you lose money being robbed but then you have to pay hundreds of dollars to replace immigration documents. Talk about kicking you when you are down.
Well, Im off to the blood bank- they still pay for donations right? How much blood do I have to give for 575$

    When Casa denies means denied
    no reason  is ever given
your AP just means sending case to the US
there is no appeal / it is allowed to expire
go and marry/ prepare to show a strong relationship for your CR1
this means family approval especially from the mother
in photos you send for CR1 make sure there are some Moroccan family members and label their names
do not show photos of the USC female in shorts (bare legs) or showing bare arms in any shirt (follow the culture norms for Morocco)
25 photos of both trips with marriage celebration is plenty
you can overcome the age difference / you need a strong and loving relationship to do this
it will take some time but worth it in the end
we are married now almost 9 years
prepare him well for the CR1 interview
he must know every big and litlte thing about u
he must answer honetly and quickly without elaborating on the answer
he must have a plan for life in the US like going to college or work
also make sure your income meets the 125% poverty level income for this  CR1
    good luck to you
write to me if you need anything/ sometimes i am slow to write as my hands still not good from breaking both wrists
    Jeanne
incha allah all will turn out well for u

Mother of two who brought OP to the US, made all the effort all of sudden start to sleep with other folks and somehow is this evil monster.  We should advise folks to somehow work the relationship and salvage it the best they can.  Most times we have a one sided story and we are quick to advise folks to divorce etc and file for ROC.  I personally really dont like to see relationships broken.

NoProblem reacted to Roel in Question about U.S citizenship of Baby
People are interested in giving birth in the US because they want their child to be US citizen - they also often think that giving birth in the US give parents some magical US legal residency or rights. Which it doesn't.

Also there is no "I want anchor baby" type of visa. You just apply for B2 visa, tell officer at POE your plans and hope for the best.

IMO the whole thing allowing babies of foreign parents to automatically become US citizens is ridiculous.

Lets see how this works out.  I think the OP has the information now to make informed decisions.  It can perhaps take more time if the girl is not from the same culture and/or religion.

Thanks all for your reply. We will get married in the US and not back home. I guess I didn't think that through well. We will just postpone the wedding until she is on the states. Thanks.

You CANNOT marry and then use the K1 to travel the US. The K1 is meant to bring your fiance(e) over to marry IN THE US. This might be your reason your passport was returned because you are not filing for the proper visa. If you want to marry in his/her country, then you must file the CR-1 visa to bring them over as your spouse.

Don’t cancel it. Use it to go to US. Take a vacation.  Just don’t overstay. Talk to your significant other. You might just be back together.

This will be looked at very hard by the embassy.  Usually the guy and their family would wants kids of their own and this is a big things in Pakistan eps. that he is 29.  CO would assume that your fiance or future husband will eventually remarry or second marry to fulfill this need.

Why would you wait? There is absolutely no pro in waiting. You will be out of status and it doesn’t matter who you are, if ice catches you, you’ll be in trouble before you can say married to USC. There will be more paperwork and if they deport you, more wait and more money because you will then have to file a CR1. If you file for AOS now, you’re not likely to get your interview before January, then just bring new tax returns then.

Pros - if you file 2 years after marriage you skip the ROC step and get the 10yr GC instead. Longer time to solidify your case if you dont have much from the get go. I filed for AOS a few years after my K1 expired. It never impacted my AOS approval... they never even questioned why I took so long to file my AOS

Cons - your out of status. Cant work or leave the country

I'm kind of shocked that you don't know each other in person, you're willing to believe everything the other person says - and it sounds like a lot, and you're willing to go through a lot of possibly finanancial burden and time on someone whose face you have never seen in real life. Visa fees, AOS fees, medical fees, lawyer fees... this will pile up.

Honestly? Before you commit yourself to anything meet in person first. You're not the first person blinded by love but be aware that it's very easy to scam someone online.

And another option- DCF for k1 doesn't exist. Asylum in China I doubt it will happen. Humanitarian expedite probably won't happen either.

Meet in person and do normal k1 or cr1 route and wait your time - you can try expedite but I don't think there is much chance there either. Reality is harsh

My concern is a bit different. You both spent a lot of time and money to go thru the K1 process. You were married about 2 weeks after arrival but had such a blow out argument that she left and flew back home. That must have been something you guys might not have discussed before .And it is a pretty severe reaction. It's not like you had to spend the night on the couch. You say you have reconciled. But you now have to repeat the process all over again for the spousal visa. If you intend to go thru the time and money a second time, please make sure all your differences are ironed out before you even start.

They only do that if the fiance left before marriage and with a darn good reason.

    Time to start the CR1.
