Sounds like you're more about the green card rather than the marriage. Marriage first, than worry about the green card. Where are you living? How are you surviving? Are you certain that you're still married? Is he in contact with you?

Ok, so I am going to punch some holes in your reasoning for studying at MTSU. First I live 25 miles from that college, second MTSU is the college in Nashville that locals go to if they don't have any better options. If your true intent for getting a F-1 Visa to study was to actually pursue a degree in Economics you should be looking at Belmont and Vanderbilt, both of which have Nationally accredited Ph.D programs in Economics, and both have great programs for international students to come and study. Vanderbilt is ranked 27th in the country for MBA programs, MTSU doesn't rank.
Your F-1 visa for studying is a little bull, I suspect your true intentions are just to be with your girlfriend, and felt that the F-1 was your easiest option.
Oh and final note. The University of Melbourne in Australia is ranked 11th in the world for best Economic programs.

This is you and your fiancé's future, personal information, and life ahead of you. If you can't spend some time to handle something as important and simple as calling the NVC yourself, then you're going to find a lot of other problems ahead. Frankly, it's irresponsible.

I agree with your first three respondents.
Financial woes, arguments, and incompatibilities are one of the chief reasons behind failed marriages and relationships. You might not think so now, but this ended as it should have. You've been saved untold time and misery.
Far better to live as a temporarily unhappy single person than as a miserable married one. Marriage is a lot more permanent than people think. You've dodged a big one here.

He can't afford it? Now you're asking if he should commit fraud to gain immigration? Unbelievable.

If he been out of the states for more than a year without re-entry nor staying here, it is a very high possibility that he needs to surrender his greencard and be revoked, then sent back to Turkey. I've seen it at least two or three cases in the immigration at POE.
Then the other things is like the others said.. If you don't like him, don't let him stay at your place; it is a free country, he is free to come, and you are free to receive him or not. You can't do anything about him if his entry is allowed, doesn't matter you like him or not, being your uncle or anybody else.

This is not true. Married is married regardless on whether or not your spouse has an SSN. You can either MFS and put NRA for spouse's SSN or MFJ if you spouse has an ITIN.

Knowing if she tried to get her green card is very important.

If she didn't try to get her green card at all, then she came in July 2007, her visa would have expired Janurary 2008. Instead of leaving, she got married August 2008, then divorced 2 years later July 2010, THEN finally left May 2012.

If she DIDN'T even attempt to get her green card, she's looking at a 4 year and 4 month overstay, which is without a doubt a 10 year ban.

If she DID get her green card, did she remove conditions on it?

These are things we -need- to know before you can recieve any help. It doesn't matter in this case that she left on her own good free will, if she stayed for almost four and a half years past her visa date.

Also agreeing about not lying. They will know if she applied for a green card, they will know the dates of when she entered the US and when she left. They will know if she stayed here illegally.

Never heard of someone having a deportation order, not leave, and everything is peachy afte 10 years.
Hey, you've been deported but if you stay illegally for another 10 years, the deportation is closed, but you can stay. What???????

    Hello Everyone,
Today is the day, my status on the CEAC finally changed to "Issued." It has been 4 looooong years since I last saw my family. There are some new family members that I haven't even met yet. I have attached my complete time line below to give an idea to those still waiting:
    1. August 10, 2013 - Married (Finally!!!)
    2. November 14, 2013 - I-130 Received at NVC
    3. May 12, 2014 - I-130 Approved
    4. June-August 2014 - Submitted DS-260, Affidavit of Support, etc.
    5. January 3, 2015 - Received Appointment Letter
    6. Feb. 18, 2015 - Attended Interview, Denied
    7. March 12, 2015 - Filed I-601
    8. August 12, 2015 - Contacted Senator
    9. Sept. 3, 2015 - I-601 Approved
    10. Sept. 21, 2015 - Instruction Letter Received
    11. October 6, 2015 - New Medical, Police Clearance, and Passport Received at Consulate
    12. October 27, 2015 - CEAC Status Updated to "Ready"
    13. October 28, 2015 - CEAC Status Updated to "Issued"
The status read "Refused" up until the day before yesterday, October 26, 2015. There were date changes when I contacted the consulate and when I sent my documents, that's it. It took one day to be updated from "Ready" to "Issued."
This has been one of the longest and toughest legal processes I have ever experienced, but it looks like it's finally over. To those that are still waiting, keep your head up, giving up in this is not an option.

    Let me summarize:
    1) you have a person that you have kids with from your home country;
    2) This person married USC and gained citizenship.
    3) this individual, once obtained USC divorces his wife, marries you, and is trying to get you and your kids to US.
    So far so good??
Now, you are asking why CO turned you down??
    I can only praise CO.

What is wrong with obeying our border folks? Disobeying can (and likely will) have long term consequences for her...like the end of her visiting privileges, never being able to convince a CO to give her a tourist visa for a long long long time (since credibility and adherence to our laws are two of the most important things an applicant must have and/or convince a CO they have before a B2 visa will be issued)...having her thumb her nose at our border officials will not enhance her chances of visiting the US for years....and it says something about you thinking that the rules don't (or shouldn't) apply to her....which is sad...but then, some folks believe they are special....but they're not.

I'm shocked, shocked that the law enforcement officers at Customs and Border Protection were enforcing the customs and border laws. THE NERVE.
You will find literally zero sympathy here. You are in a 10 times better position than most of the people here (getting to be in each other's physical presence, among other benefits of having somehow begged your way through in an afternoon what others spend a year or more and thousand of dollars accomplishing). As always, it's the rule breakers getting all the perks, and those who are doing it the way you're supposed to paying the price.

If you peruse the U.S. Constitution, what you will not find in it is some particular 'right' that your foreign born spouse be by your side 24/7, in the US, no matter what. I am not sure why so many apparently uninformed USCs believe otherwise. Visas are privileges, not a right. Admission to the US is not automatic to an alien just because they are married to an American citizen. That is the way it is under our laws.

USCs are not above the law....tourist visas are for tourists, not for camping out in the US to change status...the border folks were overly generous to allow her to enter the US...be glad about that....but as to attempting an AOS, well, USCIS and ICE are now alerted to the fact that you had been interested in an AOS....to do so now would court a finding of misrepresentation and fraud (against your wife)....no doubt, you might claim the ever popular excuse of 'gosh, we had no intentions to stay...' which will not be believable...

Look at this from their point of view. You married him and as soon as you got your green card you left for two years. You didn't return until it was time to remove conditions. Add in the fact that you have left him since the ROC was denied and want a divorce. So from 2010 to now you lived together as man and wife for like two years? You are going to have a really hard time convincing an immigration judge that USCIS erred in their decision. Even with an abuse waiver you still have to prove it was a real marriage and you have failed to do that twice so far.
