No immigration lawyer can help with the issues she will face. If she has money for lawyer, another visit would be much more beneficial in lieu of the attorney fees.
You really need more face time to get approval for K1 at this embassy
Like stated above, not the age gap that will raise concern.....rather the lack of face time and the quick engagement.
I have the same problem......met online, spoke daily, visited after four months of communicating. Visit was for one week....filed K-1.....visited again just before NOA2 for another week. A/P at visa interview........came for third visit for one week to attend the follow up interview...and we were denied. By this time, we were dating for 1.5 years, engaged for one full year. Talk everyday, had three visits, with over 100 photos, receipts, evidence of meeting extended family. This consulate is big on face to face visits and time in the relationship.
There is always a chance of approval because there is honestly some luck involved.......what CO do you get in front of?....how is his or her day going? Did they have a good night's sleep? Do they "like" you? There is so many variables that nobody can say anything for sure, but this is definitely not going to be an easy one.

They always want all originals at the embassy at the interview, regardless of what was submitted to USCIS. Should be original marriage certificate, birth certificate, police report, and anything else you can think of. It's always better to have it and not be asked for it than to not have it and be delayed further. I know this doesn't help much now, but it may help anyone reading this thread that has an interview coming up. Please keep us posted as to any progress, best wishes.

Did you get married on the first time you met face to face in 2015? This has been a historic "red flag" in Ghana CR-1's. The other large rate of denial's for a "red flag" seem to be American woman much older that Ghanaian man. Haven't seen one of these cases on VJ been approved from Ghana being on this site over 2 years. Close to 100% denial on these two factors. Stay strong, your journey has at least a year or two until the possibility of a second interview. I am sorry for the bad news.

It's offensive to servers to receive no tip because generally they are paid around $2 - $3 per hour just to cover taxes and deductions. So essentially she worked to serve you for free. The tips are the entirety of the salary of a server. However, it is very unprofessional to chase you down and demand a tip. This generally results in immediate termination of the employee. It's crazy how they don't have the option to add a tip to a card, I feel bad for the servers there as it's quite common nowadays not to carry cash.

If you wait 6 months, you will be disappointed. The letter you receive from USCIS after a K1 denial in Accra simply states that the visa was unable to be issued, the current petition is now expired and therefore closed, and you are free to pay all fees and file again. They will not give you a reason, but like Boiler said, it sounds like you already know the reason. He means that the question was answered incorrectly about how you immigrated. You will have to marry and file CR-1, and the best way to overcome the reason for denial is to make sure he knows the answers to anything that may be asked pertaining to you. More visits and face time, and a front loaded petition with plenty of documentation, photos, and proof of bona fide marriage is the best route. Plan your wedding and start the process, currently takes about a year from acceptance of petition to interview dates.

So he was also put in front of the blond woman in Accra? She has about a 95% denial. Have only seen 2 or 3 approved for a K1 with her as the interviewer Over the past year. Its terrible that she conducts herself like this. No reasons given ever.... She told me i would receive a letter stating the reason......the letter stated simply, you were denied, the petition has expired, you are welcome to file and pay all fees again. We got married and filed the cr1 last month. Its a very long visa journey dealing with Accra. Don't give up.

If he was told they were unable to issue the visa and no 221-g form was given, plus the comment about "you will receive a letter in the mail" all mean he was denied. The fact that CEAC status says "Administrative Processing" is normal, because when they deny K1, they send it back to the states and it will continue to say that until it gets entered in as "denied" which can take several months. To say that you need to wait for the reason for denial, you will have this person waiting forever. You will get no specific reason, the reason for denial was already given, " they don't believe the relationship is valid" As far as waiting to file I-130, you don't have to. The NOA2 on a I-129F petition is only valid for four months. Then it expires, meaning it's no longer an active petition. To successfully overcome the denial, he simply has to "convince" the CO on his next interview. Put together a solid case when filing, maintain meticulous correspondence with each other, and perhaps more visits. This is the only way to overcome, I'm going through the same ordeal. This process will test your patience and love, as well as the policies of US Immigration Law. Sadly, we can do nothing about these things except keep trying, or give up. This is the true love test.

ivdvaccra@state.gov is the e-mail. Provide them with both the Beneficiary and petitioners full names and date of birth. You will need to reference the new case number assigned by NVC....it will start with ACC. Tell your fiancée to call NVC late at night and keep calling until they get through. Once it rings, expect another hour wait. You need this case number to communicate with the embassy in Accra. Ask for the invitation letter to pick up your packet for the K-1. If they have received your file from NVC and input it in their system, they will mail a letter to the beneficiary but most never receive it, or it takes long and the appointment is missed. Be patient because the embassy may take two weeks to respond to e-mails. If it is in their system, they will send an e-mail stating when they mailed the invitation letter. My fiancée has no post box so the embassy actually mailed her a letter to my address in the US. I had already gotten the information via e-mail however.

I understand how you feel, but hang on a just little, from my previous experience with I-129 and the people that have been waiting at the same time on vj, no one got approved later than 6 or 6,5 months.... so I belive you're almost there, its coming. Also the day I got Approved, I spoke to a Tier 2 officer and he said no news onmy case, it hasn't been assigned to an officer yet. And that they are working on December 31 cases, all of a sudden I get a text 4 hours later at 11 pm, with a case status update, that was the Approval. So don't loose hope, and uscis don't always know what the hell they are doing. PS. we had requested 2 expedited requests, all was turned down.... I keep my fingers crossed for you!!!! Good luck.

I agree with him too.....good for you for composing that letter and trying to take action. There is no line that you are jumping, nobody you're putting out by being proactive. We all care about our petition the most, and that's the way it should be. You worried about your situation and got proactive, I applaud you and thank you for your sample letter that you shared. People can simply take this and make some small edits to make it fit thier particular situation and hopefully have the same outcome.....I know I will. Thanks again!!!!

We have to remember....they get approved so quickly that they probably don't get on here and worry and see everyones heartache like we do at TSC. I don't think that they're doing it to rub it in our faces. They just don't understand because they won't have to endure the long waits and the anxiety. Don't get angry, just remember the most important case is your own, don't worry about anyone elses. It will make for a much more peaceful expeience. I know it's hard, but it will only upset you if you take their posts a little personal.
