    Trying to figure out why anyone would pay a third party site to give you information that may or may not be better than you can get elsewhere, but that in any case you have no control over and does not actually make a difference to you. Especially if it is not even accurate enough to make, for example, travel plans around.
     
    But hey, if anyone has ideas for an app I can start that people will pay me for when I don’t have to do much effort on getting the info I pass on to them and am not held to account for its  accuracy … let me know! I like the business model as a seller !!

    I still never understand why people sign up and give their data for these various apps when uscis publicly has all the info 
     
    then wonder why they get weird spam calls (“but how did the spam caller know I had a case at uscis?”)

    So some number less than 6k is - maybe - due to side effects.
    on the other hand we have just in the US, 608k deaths, and the global number is known to be underreported especially in Africa and india but is already over 4 million.   What do those numbers say about the balance of probabilities? Like any vaccine out there, the chances  of serous side effects exist but are minuscule compared to what happens if you get the disease. Gee, I wonder why we don’t need to have smallpox vaccinations anymore yet no one dies of smallpox these days, And the people talking about “experimental drugs” yada yada clearly do not understand how scientific trials work. 
     
    (What gets me is that so many people who are anti dismiss it as some kind of left wing push, yet even Trump - who got COVID so knows how bad it is , luckily for him he had the best medical care you can get - got the vaccine pretty much as soon as he could.)

    There’s a lot more to the story than your husband is telling you. There was no COVID-19 outbreak in the US in the summer of 2019. I remember this clearly as I have several Nigerian friends who traveled to the US as late as November 2019 as a matter of fact, corona virus wasn’t a major concern then. He didn’t attend the interview and changed his plans to go to school in Canada, but didn’t follow through. Then he claims someone filed out the DS160 form and listed him as married when he clearly wasn’t - someone planning on coming on a student visa who is unable to fill out a simple immigration form for themselves? Hmmm, smells fishy!

    Siblings are F4 category, regardless of age or marital status, and this is not going to get your sister in law here in any kind of time frame that allows for short or even medium term planning. it has been taking around 20 years for Philippines. Likely to take longer in the future than the past. 
     
    Separately, aside from the length of time this will take it’s pretty sad that a graduate like that would be acting as a nanny or housekeeper, why would she not look for a job she was qualified to take whenever she can get here? If she’s that qualified she could maybe explore a work visa of some sort, get her here much faster if she can find an employer to sponsor her and with may I say far superior work.

    Just an FYI for this thread, KCC can answer exactly zero questions about the AOS process other than confirming the payment for/notice of intent to AOS  has been received. They are an administrative arm of the Dept of State, not USCIS. They process the entries for DV, process documents for consular processing, and arrange the interview schedule with embassies/consulates.  Their role in AOS is limited to accepting the DV fee payment.
     
    I personally would also run a mile from most lawyers for this. Around 1000-1500 DV AOS cases a year are processed (in a normal year) across the entire US, mostly DIY, so the number of lawyers that actually have any significant experience in DV and understand how the DV AOS process differs from normal AOS (and it does in significant ways, an example already arose upthread) is probably tiny. Bad legal advice is worse than no legal advice. Unless there is a potential inadmissibility there is no reason for lawyers.

    Not quite. A DV based AOS application may be submitted 2 months in advance of the month the CN is deemed current. This is call what we refer to as “early filing” in DV world - DV based AOS allows for this. The case simply wouldn’t be adjudicated before the first day of the month in which it actually becomes current. 
     
    For visa availability, check the latest month's DOS Visa Bulletin. Section B contains a chart showing the current month's visa availability in the Diversity Immigrant category. The chart shows when the Diversity Immigrant cut-off is met. When the cut-off is met, visas will be available in that month for the applicants with Diversity Immigrant lottery rank numbers below the specified cut-off numbers for their geographic areas. 
    Section C contains a chart showing the Diversity Immigrant category rank cut-offs for the following month, which represents the advance notification of Diversity Immigrant visa availability. As soon as a monthly Visa Bulletin is published, anyone with a lower rank number than the rank cut-off number shown in Section C is eligible to file for adjustment of status. This provides lottery winners the opportunity to file for adjustment of status up to six or seven weeks before a visa number can actually be allocated. This gives USCIS additional time to determine your eligibility for adjustment of status before the end of the fiscal year. 
    A Diversity Immigrant-based adjustment application cannot be adjudicated until a visa can be allocated, as indicated in the Visa Bulletin’s current Diversity Immigrant rank cut-offs for a particular month.

    To be honest, this pandemic has been used as an excuse by some people to use a visa as a green card. Not sure if this is the case here but I keep reading people overstaying and using it as an all around excuse to justify overstaying for a huge amount of time. There has been ways for nationals of any country to go back home.....as long as they want to. Just saying. 
    At least there are consequences for those that try to play the system.

    I’m sorry, this is why there is so much skepticism here about lawyers. 
     
    By the way: my understanding of why you got to interview is this: (1) i130 was approved because the basis of the petition was valid - that’s all they look for (2) now I stand corrected on this but on my understanding lockbox can only reject i485 for a technical factor (wrong fee, not signed, outdated form etc), and a decision to deny a petition or adjustment application can only be made by a qualified immigration official. They could have done that at a later stage without you coming in for interview, but, it sounds to me like the guy wanted to check that your wife had not become a citizen in the interim, which would have allowed you to adjust. In other words, they didn’t want to reject you before being sure there was no alternative. This view is backed up by what you say the guy said yo you at the end. So rather than being angry, maybe rather look at it from  the perspective of a guy who was really trying to help you get there.
     
    Hopefully your wife can naturalize relatively quickly and you can file i485 again. Good luck.

    UPDATE: My wife woke up this morning, receiving a letter stating that she has been approved, the request for additional information (arrest record) CANCELLED and her swearing in letter has been sent out to her.

    Talk about a wild, anxious 20 hours!

    I mean, I sent them tons of photos (more than they needed), each with explanations, letters of explanations for other things, documentation of business plans, evidence of joint purchases and so on. They did not ask for these things, but it showed overwhelming proof our marriage was all around solid and that my wife was also of great moral character, which she really is.

    Thank you all for your responses and I apologize for completely missing that part of the documentation process.

    My suggestion would be to attend the interview. Let him travel. You wait for the card and apply for a reentry permit and select to get it delivered at the embassy at the place you will be staying. You can either stay and wait for the biometrics or travel and then come back for the biometrics. It would be your choice if you want to stay in different countries for couple months.

    Eligibility is based on country of birth, not citizenship. That means you only have one eligibility option.

    Hmm. With the children’s birth dates meaning it will be impossible to hide the adultery from an n400 form (of course one should always be truthful anyway), it seems adultery is still considered a conditional bar to naturalization regarding good moral character. So clear evidence of that in the 5 years before applying to naturalize could be a problem. Puts both citizenship and an adjustment of status for next wife even further away.
