    My experience exactly, and it started working again as soon as I got my 10-year card. A conditional green card is still a permanent resident card, so that makes no sense.

    You should have filed the I-130 as soon as you got the marriage certificate.  Spouse visa cases take 2 to 3 years via the consulate in Mexico due to the huge backlog in cases.  Wait time for an interview slot is more than 1 year AFTER petition approval and NVC review.  Also, you do not qualify for DCF for your spouse petition on the basis of your father's medical condition.

    Re-reading this, and taking into account the long period outside the US and essentially abandoning the ROC process, I tend to agree, probably best to sign an I407 (not really sure this is necessary with a 2 yr GC long expired), and start over with the I130.  The jump on a flight or head to a pre-clearance site option will most likely not work as the immigrant no longer has any valid proof of LPR status (2 yr GC and extension letter(s) long since expired).

    My ex husband also told me that I only got my GC because of him and I "should be grateful". We divorced before ROC and I've since naturalized, and I don't know if he tried to derail that but if he did, it didn't work.

    His mom's health might qualify him for emergency AP. 
     
    Also if you think working would help him try to get a job offer  and he can try to get the  EAD expedited.

    My friend’s lawyer said to my friend that ”You can work and pay tax since you are a spouse of US citizen. It’s nothing have to do with immigration process, but to work and put tax. She said it’s kind of special measures so that IRS can collect taxes because a lot of people work under table anyways and there is income limit of course. If you file tax for the income, you should file as a sole proprietor. “ 
     
    Anyone knows about this? If you know the information and or the link? I will help the friend’s tax file for this year, so I need to know but my friend didn’t ask her lawyer much about that..

    As a Canadian citizen, OP does not need to apply for a visa at a consulate after an approved I-129. If the OP is outside the US after the I-129, approval, OP goes to the POE with the approved I-129 and seek admission right there.

    You can absolutely adjust status from B2 to O1 while in the Unites States.
    If your petition is approved it will say whether or not your status is considered adjusted. If it is, you'll only need to go to a consulate to get a visa if you need to leave and re-enter the US for another reason.

    That's not true, since immigration is a federal issue. Same-sex couples could not apply for immigration privileges before Obergefell.

    We’ll, the reality is that there are Five Supremes with ideology and intentions other than current law of the land…and getting USCIS on board with granting same sex benefits took Presidential action….so hopefully voters turn out Because a Good President can keep the Supreme’s Laws in check…

    This is a critical point so please clarify -- where were you when your wife tried to enter with her IR1 visa?  If you were in Canada at the time, the CBP officer may have been right in refusing your wife entry as IR1.

    They can but OP is already out of status so uscis will ask for his status and will ultimately deny the AOS.

    They might ask your spouse about the contents of the withdrawal letter you sent. 
    And ask why two I-130s were filed. 
    This is something very serious.
    You should be open and honest about the chain of events with your spouse.
    This is not a secret you should keep because it is about their immigration process. 
    Also, your spouse will know you had to re-submit because they will get a second letter from NVC welcoming them to apply for a US visa.

    Nobody was familiar with it. There was a lot of phone calls and googling going on, and I felt like I was trying to talk my way into something or ask for a favor to skirt the rules every single time. Airline check in, entering/exiting other countries, hell, even entering the US! The worst was probably during exit controls in Iceland where I had three people in this booth looking at my passport, expired card, and extension letter for about 20-25 minutes shaking their heads and speaking to each other in exasperated Icelandic. It really felt like they thought I made the whole thing up. I legitimately worked through it in my head what it would look like if I couldn't make it home on that flight. There was also the US immigration guy who didn't believe my ROC was still pending because "these things get processed in three months or less, unless there something really wrong with your application" paired with a suspicious sideways look. Or when I lost the letter and had to go beg (it's what it felt like) USCIS for a stamp, and they only gave me six months because "you shouldn't need more than that".
    I have anxiety so that was probably worse for me than most people, but I wouldn't want to go through that again.

    I filed with a divorce waiver so slightly more nerve-racking than the normal process. It cost money to file, I also paid for a lawyer to help me gather evidence for my specific situation, and collecting evidence took A LOT of time and printing.
    I filed December 2015 and was approved February 2017 with no interview. In the meantime I had an expired green card and had to explain ROC every time I traveled, which was a lot, and when I got a new job. I also had to deal with the uncertainty of not knowing whether it'd be approved, so I didn't buy a house when I had the chance, and made other decisions with an eye on having to leave. Mentally, it was way more expensive than monetarily.

    How else do you expect the spouse of a USC to enter the States? On a visit/tourist visa? Highly doubt if that would be issued since the spouse has an immigrant intent. Hence why apply for a spousal visa/IR1. With that visa it does not matter if you enter States with or without your spouse.

    He entered using a visa he was not eligible for.  This is a big deal. If no lawyer will take on his misrepresentation case, he should probably go back home, if you want to be together.   He will not be able to petition you anytime soon.

    Intent is determined at the border when a person enters the US.  Since the OP was allowed to enter, the intent is now moot unless he/she misrepresented himself/herself when entering.

    Again, what country? 
     
    Was additional requested evidence provided to the embassy? Were they in touch with the embassy on this? What's the current status on the CEAC? 
     
    It would be foolish to start a new petition when you don't have resolution of the current one. Please have your friend join this forum and provide information himself. 3rd party account never convey all the answers needed to provide advice.
